I. Introduction Most legal scholars agree that a recognizable body of international criminal law does exist. However, the precise parameters of this body of law are often unclear, perhaps due to the rapid and complex developments of our global society. In its widest context, the source of international criminal law might be derived from the general principles of international law recognized by civilized nations; and therefore, found in the customary law accepted by states, the general criminal law recognized by nations, and the treaties which govern particular conduct. International criminal law can also be categorized according to whether the conduct in question is international, constituting an offense against the world community, or whether the act is transnational, affecting the interests of more than one state. For example, international crime would encompass acts that threaten world order and security, crimes against humanity and fundamental human rights, war crimes, and genocide; whereas the transnational crime category would include drug trafficking, transborder organized criminal activity, counterfeiting, money laundering, financial crimes, terrorism, and willful damage to the environment. This chapter provides information on the major electronic sources for researching international and transnational crime, as well as current issues common to both categories, such as efforts to codify international crimes, activities aimed at crime prevention, cooperation in law enforcement, jurisdictional questions, international judicial cooperation, and the effects of bilateral and multilateral treaties.

INTRODUCTION Chapter 7 of the UNIDROIT Principles of International Commercial Contracts is significant on at least two levels. In practical terms, it is the substantive heart of the whole Principles. It is where the Principles’ solutions to a large proportion of real world disputes in commercial transactions are to be found. It is here that the remedial consequences of serious failures of performance are defined: orders of performance, damages, contract termination by rescission, and restitution. These are difficult and central substantive issues. Indeed, Chapter 7 is probably the most imaginative synthesis to emerge in this generation of some of the most difficult practical questions of contract law. It will be a powerful support for the harmonization of actual outcomes and improve the reliability of the often unpredictable results of disputes. The substantive content of Chapter 7 is important as an illustration of the creative power of the UNIDROIT Principles. Chapter 7 is also important as an example of how the Principles work and of their usefulness in the emerging pattern of harmonized international commercial law. Chapter 7 brings closer together the substantive outcomes in courts, arbitral tribunals, and institutions of alternative dispute resolution in different legal systems, thus providing a prime example of how harmonization of international commercial law can improve the law. I have pointed out elsewhere that harmonization is not always the equivalent of substantive reform that improves the operation of the law.

VI. - CIVIL LAW AND COMMON LAW : RESULTING DIFFERENCES IN LAW A study of several differences in substantive law as between the civil law and the common law is very instructive in illustrating the diversity of basic juridical concepts underlying the two legal systems. 1. INTERNATIONAL COURTS AND TRIBUNALS 1. International Criminal Court (ICC) The International Criminal Court (ICC) is a permanent international judicial institution designed to help bring to justice those individuals responsible for genocide, crimes against humanity and war crimes. The Rome Statute of the International Criminal Court (the Rome Statute ) entered into force on July 1, 2002, having obtained the required 60 ratifications. As of September 29, 2004, the number of ratifications has increased to 97. The ICC complements, but does not replace, national courts, and may exercise jurisdiction only where national courts are unable or unwilling to prosecute. The Rome Statute contains extensive safeguards and checks and balances to ensure that the ICC focuses on the most serious international crimes. Canada signed the Rome Statute on December 18, 1998 and ratified it on July 7, 2000. Canada was the first country in the world to adopt comprehensive legislation, the
