Interior Department settles lawsuit over snowmobiling
By Major Garrett CNN White House Correspondent WASHINGTON (CNN) The Interior Department Friday settled a lawsuit with snowmobile manufacturers and outdoor enthusiasts that opens the way for wider recreational snowmobile use in Yellowstone National Park and Grand Teton National Park. The settlement does not override a Clinton administration rule banning recreational snowmobiling in these two national parks and the John D. Rockefeller Memorial Parkway. But it does allow for more public comment on the issue, and some environmentalists fear settlement of the suit foreshadows a loosening of the Clinton-era ban. "The settlement guarantees that local communities, business owners and others who have told us their voices weren't sufficiently heard during the rushed snowmobile rulemaking process will have an opportunity for comment," said Mark Pfeifle, a spokesman for the Interior Department. "Ultimately, recreational use of snowmobiles in National Parks will only be permitted if the cherished environment and natural resource values are protected for the enjoyment of our children and future generations of Americans."

U.S. DEPARTMENT OF THE INTERIOR SCORCHED BY GAO REPORT ON FUNDING TO MARSHALLS AND FSM MAJURO, Marshall Islands (June 9, 2000 – Marshall Islands Journal)-The U.S. General Accounting Office has criticized the Interior Department for its inability to accurately report on the $2.6 billion in funding provided to the Marshall Islands and the Federated States of Micronesia under the Compacts of Free Association since 1986. The just-released report, "Better Accountability Needed Over U.S. Assistance to Micronesia and the Marshall Islands," is the first in a series of GAO audits of federal spending in the RMI and FSM that is being conducted at the request of the U.S. Congress. "We found inaccuracies and inconsistencies with the data used by Interior to supervise and monitor federal assistance programs," GAO said. In one example, DOI figures differed from other federal agencies by $71 million, and DOI was "unable to provide documentation for about $27 million." Nor did it use the annual audits available from the RMI and FSM to check its figures, GAO said. "Interior’s ability to accurately report on assistance provided is called into question," GAO said, adding that it was recommending that the reliability of DOI’s data and accountability be improved.

Senate to vote on Norton to lead Interior Department
WASHINGTON (CNN) The Senate is scheduled to vote early Monday afternoon on president George W. Bush's nomination of controversial former Colorado Attorney General Gale Norton to head the Department of the Interior. Norton is one of President Bush's most controversial candidates and has been labeled by some environmental groups as an 'anti-environmental extremist' The Senate Energy and Natural Resources Committee recommended Norton's confirmation last Wednesday on an 18-2 vote. During her hearings, Norton sought to assure Democratic skeptics that she would enforce federal environmental laws and improve the national park system as the first woman to lead the Cabinet-level department. Norton's nomination has drawn heavy fire from environmental groups, including Greenpeace and the Sierra Club. In television, radio and newspaper advertisements, the groups have derided Norton as an "anti-environmental extremist" who would favor logging, grazing and mining interests over land conservation.

WASHINGTON, D.C.///February 26, 2004///The nonprofit Campaign to Protect America's Lands (CPAL) announced that it is sending an email today to 59,684 Department of Interior employees urging them to use a confidential tipline (1-866-LANDTIP or http://www.landtip.org) to report any new anti-environment rules or other steps related to America's public lands, parks or wilderness areas that may crop up in the coming months. CPAL's goal is to thwart a whole new round of special-interest proposals that are expected to clog Interior if panicked industry executives come to believe that President Bush is unlikely to serve a second term. "Our concern is that industry demands for special treatment at Interior will go beyond the fever pitch they've been at already if companies start to worry that President Bush is fighting a losing re-election battle" CPAL Director Peter Altman explained. "These companies literally will start grabbing for anything that they can get their hands on, and the Bush Administration likely will go even further to subvert the democratic process in order to accommodate its powerful friends. As we saw it, we had two options. The first was to sit back and then lament the damage done after it is too late to do anything about it. Dennis Gingold, the lead attorney for the plaintiffs said that trust reform in June 1999, seeks to force the Interior and Treasury departments to fix the accounting system that determines what the government owes approximately 300,000 American Indians for handling oil drilling, grazing and other economic activities on their property. We have demonstrated beyond question to the Court that the individual Indian trust account system is a scandalous disrepair, that it needs fundamental, top to bottom reform and that the federal government is neither willing nor competent to do it. After a long trial on trust reform issues in 1999, District Judge Royce C. Lamberth agreed with us that the Interior and Treasury Departments have been violating their trust responsibilities to Native people since the end of the 19th century. Web posted at: 9:26 p.m. EDT (0126 GMT) From Correspondent Don Knapp WEST YELLOWSTONE, Montana (CNN) The U.S. Department of the Interior is wrestling with how to protect the endangered American bison in Yellowstone National Park without threatening cattle herds near the park with brucellosis, a disease that causes cows to abort their calves. Bison, once abundant in Yellowstone and throughout the West, were hunted nearly to extinction by the turn of the 20th century. Only 23 animals in the Yellowstone herd survived. But through conservation, and transplants of animals from other herds, the bison population in Yellowstone rose to more than 3,500 by 1996. Then came that winter's killing snows, a natural process that Park Service officials believed would cull the herd. But the bison, driven by hunger to find food, followed paths out of the park on roads groomed for recreational snowmobilers.

Facts of the Case
The National Federation of Federal Employees, a federal employees' union, proposed to include a provision obligating the Interior Department to negotiate midterm matters not in the original contract between the union and the Agency. The Federal Service Labor-Management Relations Statute, that created the Federal Labor Relations Authority, requires federal agencies and their employees' unions to negotiate in good faith to arrive at a collective bargaining agreement. Initially, the Authority held that the good-faith bargaining clause did not extend to union-initiated proposals during the term of the basic contract. The Court of Appeals did not agree and, in turn, the Authority reversed its decision. The Interior Department refused the proposal on the ground that union-initiated midterm bargaining is inconsistent with the Statute. The Authority then ordered the Agency to comply with the bargaining.

In an opinion published Friday, the U.S. Court of Appeals for the District of Columbia reversed the earlier decision, saying that the district court erred in disregarding Interior Department security certifications and in failing to hold a hearing that would have given the department a chance to argue that its computers were secure. Under the March 15 ruling, all Interior computers were disconnected from the Internet except systems deemed essential for public safety reasons, as well as the systems of the National Park Service, Office of Policy Management and Budget and the U.S. Geological Survey.

Monday 25 October 2004 Theresa Chambers has become a poster child for the destruction of enduring American institutions. In this case, the National Park Service and the national monuments it protects. Until last July, Theresa Chambers was the U.S. Park Service Chief of Police. She was responsible for security and public safety at U.S. National Parks and Monuments in urban centers, including the Washington Monument and the Lincoln and Jefferson memorials on the Washington Mall along with many other parks and monuments in the nation's capitol. On December 2, 2003, Chambers was interviewed by a Washington Post reporter. She spoke candidly of the challenges the Park Service Police faced with stepped up demands for homeland security and declining Park Service budgets. "My greatest fear," she said, "is that harm or death will come to a visitor or employee at one of our parks, or that we're going to miss a key thing at one of our icons." On December 5, 2003, the National Park Service stripped Teresa Chambers of her gun and badge and placed her on administrative leave for "violating federal rules" regarding the discussion of budgets and for "giving away critical public safety information."
