The globalization of information, facilitated by the Internet, has significant implications for intellectual property regimes domestically and internationally. Assessment of these implications and their probable outcomes is unavoidably value-driven. Many commentators foresee harmonization of intellectual property laws but some predict disparity in political economy outcomes. Some also see profound effects on sovereignty. A critical review of recent literature on these topics discloses a prevalent and rather persuasive view: that globalization of information and the impact of the Internet tend toward an international standard of strengthened intellectual property laws and the erosion of sovereignty notions, with the economic benefits flowing primarily to developed nations and transnational corporations. The prevalence of this view in the recent literature may reflect an effort to bring less heard voices to the forefront of the discussion.

"One of the biggest mistakes one can make when considering the globalization of intellectual property law is to assume away the increasingly contentious politics of the phenomenon. This is not to say that the emerging politics of international intellectual property law are simple, easy to understand, or unchanging - quite the contrary is true. However, we should resist the understandable tendency to reach for a quick, technocratic set of Procrustean tools that assume away the 'messiness of the world' and make it seem that concepts such as 'sovereignty' and 'property' should be, are, or always have been, particularly stable constructs" (Aoki, 1998b).

About the Program
Duke Law School has made Intellectual Property a major priority. Since 2000, Duke has hired four new faculty members, designed innovative courses , created new centers and programs , hosted significant conferences and lectures , and set up an Internet journal Duke has made a deliberate decision not to specialize in only a few areas of intellectual property law - such as high tech patents. Instead, the program stresses the links between intellectual property subject areas, while providing tightly focused classes on particular specialties. This approach allows students either to aim at a generalist education in intellectual property law and policy, or to concentrate on a specific area, such as biotech patents, or media and entertainment law. The second defining quality of Duke's approach to intellectual property is that it goes beyond the merely technical or technocratic. In an information society, intellectual property law presents fundamental questions of politics and policy; what is the correct balance between the public domain and intellectual property, or between intellectual property rights and free speech? Gene patents, Napster-like peer-to-peer file sharing, fair use and parody, the role of private investment in scientific research and innovation - such issues present complex questions of morality, economic effect, constitutionality and competitiveness. Both in class, and through a variety of scholarly, practical and law reform activities, Duke Law School's Intellectual Property Program explores these policy questions, engaging in public service and helping to prepare its graduates to shape the groundrules of the information society, whether as lawyers, entrepreneurs, policy-makers or citizens.

What is Intellectual Property (IP) Law? Intellectual Property Law involves evaluating the need for, and types of protection available for, inventions and trade indicia and artistic creations. Protection and enforcement are matters of national law. Consequently, the property owner must seek protection and enforcement in each country of interest. Attorneys may be generalists in the IP field or may specialize in one of many unique areas. What kind of undergraduate degree is required in order to specialize in IP Law while in law school? Students planning a career in IP Law may have different backgrounds. Patent Law requires an undergraduate degree in science; chemical, mechanical, electrical or polymer engineering; or computer science. Other areas of IP law do not require a technical background as a prerequisite. IP Law is among the fastest growing areas in the legal profession. According to The National Law Journal, IP is the most highly compensated segment of the legal profession for both trial and non-trial attorneys. (June 2, 1997, p.B8)
