This is a revision of a document prepared for presentation at the 1992 Annual Meeting of the American Association of Law Libraries. It may be reproduced for non-profit educational use if this notice appears on the reproduction. This paper was originally produced in 1992, prior to the INTERNET and the explosion of information it has engendered. BECAUSE Unitarian Universalists affirm justice, equity, and compassion in human relations; the goal of world community with peace, liberty, and justice for all; and respect for the interdependent web of existence; BECAUSE Unitarian Universalists value the diversity of human cultures and appreciate the insights and truths in other religious and cultural traditions; and BECAUSE we have much to learn from indigenous peoples about respect, responsibility, and living in harmony with one another and with the earth; and WHEREAS the General Assemblies of 1967, 1970, 1973, and 1975 addressed the need to promote social justice for the indigenous peoples of Canada and the United States and insufficient progress has been made; WHEREAS a legacy of injustice with regard to indigenous peoples persists:

Indigenous Peoples Information Note on the mandate of the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous peoples Mr. Rodolfo Stavenhagen Over the last two decades the situation of the indigenous peoples worldwide and the enjoyment of their human rights has become a key issue in the international arena. This development is reflected in the establishment of the Working Group on Indigenous Populations (WGIP) in 1982, the proclamation of the International Decade for Indigenous Peoples 1995-2004, by United Nations General Assembly, and the establishment of the Permanent Forum on Indigenous Issues in 2000. In 2001, the Commission on Human Rights, appointed a Special Rapporteur on the situation of the human rights and fundamental freedoms of indigenous people, Rodolfo Stavenhagen, from Mexico , in response to the growing international concern regarding the marginalization and discrimination against indigenous people worldwide. The mandate, created by Commission on Human Rights resolution , represents a significant moment for the on-going pursuit of indigenous peoples to safeguard their human rights and is complementary to those of the WGIP and the Permanent Forum and aims at strengthening the mechanisms of protection of the human rights of indigenous peoples.

    Following is UN Secretary-General Kofi Annan’s message on the International Day of the World’s Indigenous People, observed 9 August:
    On this International Day of the World’s Indigenous People, we rejoice in the richness of indigenous cultures and the special contributions they make to the human family.  We also recall the tremendous challenges which so many indigenous peoples face, ranging from unacceptable levels of poverty and disease to dispossession, discrimination and denial of basic human rights.
    Launched in 1995, the first International Decade of the World’s Indigenous People helped to make the voices of indigenous peoples heard more clearly around the world, and to focus greater attention on indigenous issues.  This year, we enter a Second Decade, and as we do so, let us remember that dialogue alone is not enough.  Our focus must be on action to protect the rights of indigenous peoples and improve their situations with respect to their lands, their languages, their livelihoods, and their cultures.
    The recent Fourth Session of the United Nations Permanent Forum on Indigenous Issues focussed with renewed energy on the importance of indigenous peoples achieving the Millennium Development Goals, particularly those of eradicating extreme poverty and ensuring primary education for all.  The Forum stressed the need for a human rights-based approach to poverty reduction and the full and effective participation of indigenous peoples in all stages of programmes.  It also recommended bilingual and intercultural education for indigenous children.  The Forum sent an important message to next month’s World Summit in New York that the partnership and trust built between indigenous peoples and the United Nations needs to translate into concrete action at the regional, national and local levels that empower indigenous peoples and strengthen their identities, languages, cultures, and traditional knowledge.

    ( 9 August 2005 ) In 1994, the General Assembly decided that the International Day of the World's Indigenous People shall be observed on 9 August every year during the International Decade of the World's Indigenous People ( Resolution 49/214 of 23 December). The date marks the day of the first meeting, in 1982, of the UN Working Group on Indigenous Populations of the Subcommission on the Promotion and Protection of Human Rights. The UN General Assembly had proclaimed 1993 the International Year of the World's Indigenous People, and the same year, the Assembly proclaimed the International Decade of the World's Indigenous People , starting on 10 December 1994 ( Resolution 48/163 ). The goal of the First Decade was to strengthen international cooperation for solving problems faced by indigenous people in such areas as human rights, the environment, development, education and health.

    I. Introduction Who are Indigenous Peoples? People who inhabited a land before it was conquered by colonial societies and who consider themselves distinct from the societies currently governing those territories are called Indigenous Peoples. As defined by the United Nations Special Rapporteur to the Sub-Commission on Prevention of Discrimination and Protection of Minorities, Indigenous communities, peoples and nations are

    INTERNATIONAL LAW and INDIGENOUS PEOPLES
    International law (IL) is a system of norms, customs, and binding agreements designed to regulate the behavior of nation-states. IL is dependent upon the notion of states and sovereignty (effective control of territory). Traditionally IL has been applied by states and international organizations to interstate actions; more recently it has been expanded to actions states take toward social groups, individuals, and corporations. IL was historically understood as the Law of Nations and did not include law for individuals, save for how states could legitimately subjugate or subsume so-called "uncivilized peoples" (i.e., peoples with "non-state" social organizations: clan, kinship, tribe). In the West, formal codes of IL began with Roman laws to manage relationships with outsiders on the frontiers of the empire. IL developed into its modern form with efforts by European nation-states to consolidate control over expansive territories. This expansion was fueled by resource acquisition and motivated by a zeal to proselytize and convert in the name of Christianity. (See

    Dear Friends, Here amidst of the Andes in Peru, the enormous contributions of indigenous peoples to human civilization are everywhere on display – from the sacred ruins of the Inca empire to the crops that grow on the mountainsides. In the jungles of the Amazon too, indigenous communities have lived for millennia in harmony with the rainforest, and they continue to do so today. And throughout Latin America, one sees the extraordinary diversity of indigenous cultures and the potential contribution their knowledge and values can make to poverty reduction, sustainable agriculture, and indeed to our conception of life. From here in Peru to the Philippines, and from the deserts of Australia to the ice-covered lands of the Arctic circle, indigenous peoples have much to teach our world. But to come to the Andean region is also to appreciate how fragile the existence of many indigenous peoples is. In the region – and in other parts of the world, too – indigenous lands, waters, languages, health and cultures, long devastated by the legacy of colonial oppression, continue to be under grave threat. The environment is being destroyed, and indigenous people are too often excluded from decisions that crucially affect the life of the communities. They suffer from prejudice, poverty, and disease.     The development of European Union policy on Indigenous Peoples is relatively recent. The Agenda of the Development Cooperation Group of the Council held on 18 March 1997 mentioned for the very first time the issue ‘Indigenous Peoples’. At its meeting on 5 June 1997, the Development Council invited the European Commission to present a policy paper on EU development policy on indigenous peoples. Indigenous peoples were involved in the development of the European Commission Working Document of 11 May 1998 on support for Indigenous Peoples in the development co-operation of the Community and the Member States. This Document was rapidly followed on 30 November 1998 by the adoption of the Council Resolution on Indigenous Peoples within the Framework of the Development Cooperation of the Community and Members States which provides the main guidelines for support to indigenous peoples.
