    Education and Religion Before the Civil War
    Schools that were built before 1851 were funded by the county, city, or township they occupied. Many of these early schools charged tuition. Churches and individuals maintained many good private schools, but they were generally not free (i.e. Notre Dame). The Quakers probably had the best elementary schools, while many ministers, especially Presbyterians, taught schools. There were several obstacles to public schooling. Taxes would have to be charged, Indiana still had a very sparse population, transportation difficulties and the preference by some families for schools to be under church or private control. The state of Indiana had plunged itself into so much debt building, a now inoperable, canal system that it was unable to support a public school system. There were several colleges and universities throughout the state, but they barely survived financially and had meager enrollments.

When is Disproportionality Discrimination?: The Color of Discipline Moving Towards Equity: Addressing Disproportionality in Special Education in Indiana This report, entitled Moving Towards Equity: Addressing Disproportionality in Special Education in Indiana Local Equity Action Development To the Top Context of Minority Disproportionality: Local Perspectives on Special Education Referral Documentation on the disproportionality of culturally diverse students in special education has been extensive, yet our knowledge of what causes disproportionality and how to address it is limited. This report describes an intensive study undertaken across 14 schools within seven Indiana school corporations to improve our understanding of the factors which may contribute to the disproportionate referral and placement of minority students in special education. We interviewed 66 educators-teachers, principals, schools psychologists and special education directors-about their perspectives on the challenges faced in urban education, the process of special education, available and needed resources, and the specific topics of disproportionality and diversity. To the Top Disproportionality and Discipline Among Indiana's Students With Disabilities: A Status Report Disproportionate representation of minorities in special education has been and continues to be a central concern for the field. Although the presence of minority overrepresentation has been well documented, it is fair to say that the full complexity of the problem has not yet been fully understood, nor is there a clear picture of the causes of disproportionality. This report is the second phase of a study conducted by the Indiana Education Policy Center for the Indiana Department of Education Division of Special Education on the status of minority disproportionality in special education in Indiana, and on the disciplinary provisions of IDEA 97.

Indiana School Law and the School System of 1886 The educational mandate of the new constitution still left the legislature with the thorny problem of how to establish a system and more importantly how to fund and administer the schools. The Common School Fund of Indiana was a major source of income for the schools. A number of established funds, such as the Sinking Fund, the Swamp Land Fund, and other funds of equally colorful nomenclature funneled into the School Fund. These monies, along with township and local tax sources established over the years, were responsible for the support of the public school system by 1886. (See attached – School Funding) The administration of the schools at the state level was left to the Department of Public Instruction, headed by the elected office of State Superintendent of Public Instruction. As to the administration of schools at a local level, various systems were enacted over the years, but the County Superintendency Law of 1873 established the system that would govern the local schools of 1886. (Boone:240) Superintendent of Public Instruction and the State School Board The new Constitution of 1851 established the office of Superintendent of Public Instruction. The office was a two-year elected position and the School Law of 1852 laid out the responsibilities of the office. According to that law, the superintendent was required to: spend time in each judicial district to examine the schools; supervise school monies, receive reports from county auditors and trustees; recommend books and supervise township libraries; examine all applicants for license; make reports to the Governor and General Assembly and chair the State School Board. (Cotton: 19-20) The most extensive of these reports was the Biennial Report of the Superintendent. This report gave in detail all the workings of the entire department statewide and, by 1886, included the minutes of professional meetings, curriculum, all teacher exams and the all statistics for education in the state of Indiana. Teacher Institutes Most district schoolteachers in 1886 Indiana did not have the benefit of a complete Normal School education. Many had only recently left the district school system themselves. The luckier teachers had the benefit of a high school education or even a summer course at a local normal college. But the State Law made no demands as to the amount of education a teacher had, only that an applicant be able to pass the licensing examination. Teacher institutes were an efficient and quick means to add to the knowledge of large numbers of classroom teachers. Some handbook authors regarded their potential usefulness highly. G. Dallas Lind especially recommended institutes for the intellectual betterment of district school educators.(Lind: 32) Institutes, as a means of teacher education, had been used in the state as early as the 1840s. These earliest institutes were usually conducted by local academies and colleges with the goal of raising the educational level of the district school teachers in the area. (Mock: 611-612) Everything from basic curriculum to teaching methods to conducting opening exercises was taught at the institutes. Regional institutes were common by the mid-1850s. The Northern Indiana Teachers’ Institute was first held in 1849. The sessions could last up to ten days and were held alternately in Elkhart, South Bend, and Logansport. (Boone:394) The Institute of 1852 employed eight instructors teaching all subjects in the elementary curriculum as well as some high school subjects. (Mock: 629-632)

Overview of the Issue
Like many states, Indiana is reviewing its tax structure and its relationship to school funding. At center stage is the issue of property taxes. Specifically, policymakers and taxpayers want to know the implications for eliminating property taxes as a revenue source for the school general fund. In March 1998, the Indiana Association of School Business Officials (IASBO) released a report showing Indiana taxpayers contribute nearly $1.4 billion to the school general fund through their property taxes. This figure represents only about 30 percent of all property taxes collected by the state. The lion's share of property taxes comes from businesses, farms, and utilities (nearly 64 percent in 1992). Hence, analysts note that any shift in the tax structure will result in a shift in taxpayer burden. Businesses stand to gain if property taxes are eliminated. Individuals, on the other hand, stand to lose, particularly if the state replaces the lost property tax dollars with increased state sales and income taxes. The cost of common goods (e.g., food and clothing) would rise under such a scenario due to a hike in the state sales tax. Likewise, the average citizen's take-home pay would decrease due to an increase in the state income tax. Many believe that renters and senior citizens would be especially hard hit by this shift in taxpayer burden.

Law - Judicial Conference Supports Citing Unpublished Opinions
A news alert from Law.com reports that: The federal judiciary's policy-making board endorsed Tuesday a sweeping rule change that would allow lawyers to cite unpublished opinions in federal appeals courts nationwide as of 2007, ending a practice that brought charges of a hidden justice system against major appellate courts. The Judicial Conference also voted not to take a position on whether the 9th Circuit should be split in two. But members agreed to oppose any circuit-splitting bill that does not provide adequate funding to cover costs. The feds are different from the states (see posting about the State of NJ immediately below) the feds "unpublished" opinions are in fact published, at least online. Their issue is whether they may be cited. Tony Mauro of Legal Times writes The citation rule change, if ratified by the Supreme Court and untouched by Congress, would end a practice that brought charges of a hidden, unaccountable system of justice against some of the nation's largest and most important appellate courts. The 2nd, 7th, 9th and federal circuits ban citation of unpublished opinions outright, while six other circuits discourage it. Passage of the resolution by voice vote followed "a great deal of debate," said Judge Carolyn Dineen King, chair of the executive committee, at a post-meeting news conference.
