Web posted at: 9:56 p.m. EST (0256 GMT) (CNN) Those who watched the House Judiciary Committee's hearings on the impeachment of President Bill Clinton may have noticed Chairman Henry Hyde's liberal use of the gavel in the last minutes of the proceedings. "I just want to announce that I have been given several ceremonial gavels, which I am to use up here, and then they are to be given to people for what purpose, I don't know," Hyde said. Their purpose, like the 100 pens for the impeachment trial oath signings by the 100 senators: They are all souvenirs. But many who watch the market for memories say there's not much call yet for the pens and gavels that have punctuated the historic proceedings. Mort Berkowitz of New York has a collection of more than 800,000 political items. Unless something changes, Berkowitz said, there's nothing from Clinton's impeachment that he would buy.

WASHINGTON (AllPolitics, October 6) The House of Representatives faces a historic vote Thursday over whether to approve a formal impeachment inquiry against President Bill Clinton. House Majority Leader Dick Armey House Majority Leader Dick Armey (R-Texas) has scheduled the vote on a House Judiciary Committee resolution recommending an inquiry into allegations of perjury and obstruction of justice by Clinton in the Monica Lewinsky affair. On Monday, the committee voted 21-16 strictly along party lines to send the full House a Republican proposal for a free-ranging probe that could extend beyond Independent Counsel Ken Starr's report on the Lewinsky matter and would have no deadline for completion. The partisan vote in the Judiciary Committee is likely to be repeated in the full House, though a number of Democratic defections are expected in light of the upcoming election.

Once before in American history, during the turbulent era of Reconstruction that followed the Civil War, a president was impeached by the House of Representatives and tried before the Senate. This was Andrew Johnson, like Clinton a Southerner who had alienated a majority of Republicans in Congress. There, however, similarities between the two impeachments begin and end. Johnson’s Reconstruction policy is often described as one of "leniency" toward the South. It was lenient enough to white Southerners, whom Johnson quickly restored to control over local affairs. To the four million emancipated slaves, however, Johnson’s lily-white plan of Reconstruction was extremely punitive. Johnson ordered black families evicted from land on which they had been settled by the U. S. army, and through the notorious Black Codes, the southern governments he created attempted to reduce blacks back to the condition of dependent plantation laborers. Between 1865 and 1867, Northern Republicans slowly became convinced that Reconstruction must recognize blacks as American citizens entitled to equality before the law and, for men, the right to vote. Johnson, a thoroughgoing racist, opposed these policies. The 1866 Congressional elections, a sweeping victory for the Republicans, demonstrated that unlike Clinton, Johnson had little popular support. Nonetheless, Johnson attempted to use the patronage and his command of the army to obstruct Congressional policies.

Barney Frank said late Monday that Congress should begin an impeachment investigation into the Bush administration's handling of the Leakgate scandal and not wait for Special Proscecutor Patrick Fitzgerald to determine whether any laws were broken.
"During the Clinton impeachment, the Republicans kept saying, remember, impeachment does not mean the end of the process. It is the beginning," Frank told MSNBC "Hardball" substitute host Campbell Brown. Story Continues Below "I must honestly say, I do not trust the president to do an independent investigation here," Frank explained. When reminded that the Leakgate probe was in the hands of a special prosecutor, Frank sounded confused, telling Brown: "Yes. But it is still also the president, because I don't think not being convicted of a crime [should] be the only qualification for being deputy chief of staff." Moments later, Frank was asked whether Democrats should really be "pursuing impeachment proceedings on this" rather than addressing issues like Social Security reform.

Pursuant to Section 595(c) of Title 28, the Office of Independent Counsel (OIC) hereby submits substantial and credible information that President Clinton obstructed justice during the Jones v. Clinton sexual harassment lawsuit by lying under oath and concealing evidence of his relationship with a young White House intern and federal employee, Monica Lewinsky. After a federal criminal investigation of the President's actions began in January 1998, the President lied under oath to the grand jury and obstructed justice during the grand jury investigation. There also is substantial and credible information that the President's actions with respect to Monica Lewinsky constitute an abuse of authority inconsistent with the President's constitutional duty to faithfully execute the laws. There is substantial and credible information supporting the following eleven possible grounds for impeachment: 1. President Clinton lied under oath in his civil case when he denied a sexual affair, a sexual relationship, or sexual relations with Monica Lewinsky.

Executive Summary As the scandal surrounding the Clinton administration grows, the possibility of impeachment looms ever larger. It is an appropriate time, therefore, to examine the function and history of the impeachment provisions of the American Constitution. The Constitution divides the impeachment power between the two houses of Congress. The House of Representatives has the "sole Power of Impeachment" while the Senate has the "sole Power to try all impeachments." That division of responsibility guards against potential abuse of the impeachment power. Only the House can initiate the impeachment process. But the Senate determines if the charges are appropriate and if the evidence warrants conviction.

And three enormous factors weigh against it: 1) Republicans control Congress. 2) Most congressional Democrats are routinely gutless. 3) Big media outlets shun the idea that the president might really be a war criminal. The leak of the memo weeks ago, providing minutes from a high-level meeting that Prime Minister Tony Blair held with aides in July 2002, may be the strongest evidence yet that Bush is guilty of an impeachable offense. As Rep. John Conyers, the ranking Democrat on the House Judiciary Committee, wrote in late May:
  • "First, the memo appears to directly contradict the administration's assertions to Congress and the American people that it would exhaust all options before going to war. According to the minutes, in July 2002, the administration had already decided to go to war against Iraq." "Second, a debate has raged in the United States over the last year and one half about whether the obviously flawed intelligence that falsely stated that Iraq possessed weapons of mass destruction was a mere 'failure' or the result of intentional manipulation to reach foreordained conclusions supporting the case for war. The memo appears to close the case on that issue stating that in the United States the intelligence and facts were being 'fixed' around the decision to go to war."
