A Historical Tutorial On Impeachment, Censure
By Bill Schneider/CNN
WASHINGTON (March 11) Impeachment means indictment, the act of bringing charges against the president. The House of Representatives has the sole power to impeach a president, by majority vote. After impeachment, the president goes on trial in the Senate, where a two-thirds vote is needed to convict him and remove him from office. Only one president has actually been impeached: Andrew Johnson in 1868, for defying the will of Congress by removing a cabinet official without the consent of the Senate. But President Johnson survived. The Senate failed to convict him, by a single vote. In President Richard Nixon's case, the House of Representatives voted to authorize the Judiciary Committee to investigate the Watergate affair in February 1974. In July, the committee voted to report three articles of impeachment to the House. Ten days later, Nixon resigned. The House never had to vote on impeachment. The Constitution says the president "shall be removed from office on impeachment for, and conviction of, treason, bribery or other high crimes and misdemeanors." What does that mean?

Wahid's supporters continue to congregate on the streets of Jakarta By staff and wire reports JAKARTA, Indonesia Indonesian President Abdurrahman Wahid has given legislators a week to call off moves to impeach him. The deadline was imposed by the embattled leader on a day in which he also warned of the need for "firm action" to protect the country. "I will give them until Friday. After that we will see what happens," Wahid said after weekly prayers at a Jakarta mosque. "The government is working hard to handle the security problem so that the political situation can be stabilized," he said. Historic Background on the Impeachment and Trial of President Andrew Johnson
The Significance of President Johnson's Impeachment and Trial Johnson's impeachment trial is considered to be important because it checked the attempt among certain Members of Congress to establish congressional control of federal policy and relegate the President's role in governance to that of a chief minister's. The acquittal of Johnson also prevented later Congresses from using the threat of impeachment as a means of settling policy differences with the executive. Finally, the acquittal meant that in future impeachment trials the defendant would have to have committed an actual crime in order to be convicted. The Impeachment of Andrew Johnson »Name: Salmon Portland Chase back to Who Was Who S In one of his first acts as Chief Justice, Chase appointed John Rock as the first African-American attorney to argue cases before the Supreme Court. In March 1868, Chase presided over the removal trial of the impeached President Johnson in the U.S. Senate. The Chief Justice brought to the trial a much needed air of dignity and impartiality. As the first impeachment trial of a President under the Constitution, Chase realized that the procedure would set important precedents. He insisted that the Senate conduct itself as a court of law, not as a legislative body. Chase was unable to forge a solid majority during his tenure as Chief Justice and often found himself in dissent on such important cases as Ex parte Milligan (1866), Bradwell v. Illinois (1873) and the Slaughterhouse Cases (1873). In Texas v. White (1869), however, he authored the majority opinion that ruled secession unconstitutional and reaffirmed the Congressional right to guarantee republican government in the states. This decision essentially endorsed Congressional control over the Reconstruction process.

Zambian parliament votes overwhelmingly against impeachment
President Levy Mwanasa in 2002 Story Tools RELATED Zambia LUSAKA, Zambia (AP) President Levy Mwanawasa survived an attack on his presidency Wednesday when lawmakers voted overwhelmingly not to impeach the southern African leader. The vote brings to an end two days of intense debate over a motion to impeach the president and threats from his own ruling party members to back the opposition. Mwanawasa has angered many senior officials in his own party with his corruption-busting drive, and he has infuriated opposition parties by poaching some of their top leaders. But after 159 lawmakers cast their ballots, Mwanawasa's leadership was still intact with only 57 votes against him, 49 short of the required two thirds. The president was not present in the house to witness the victory.

BRASILIA, Brazil (Reuters) Lawyers have filed two impeachment requests against Brazilian President Luiz Inacio Lula da Silva claiming he is responsible for alleged corruption that has thrown his government into crisis, the country's Congress said Thursday. The lower house of Congress will decide whether there are legal grounds to consider an impeachment process or whether to shelve the requests, as was the case with four previous ones filed against Lula since he took office in January 2003, the chamber's secretary said in a statement. Lower house President Severino Cavalcanti is responsible for the final decision on such requests. He said earlier this week he saw no grounds for Lula's impeachment. "Within a few days, I will have a position," Cavalcanti told reporters on Thursday. "I will do nothing hasty."

Impeachment: A primer
(AllPolitics, Sept. 14) If the House Judiciary Committee institutes impeachment hearings, it would then have to decide what constitutes an impeachable offense. The U.S. Constitution says a president can be removed from office if he committed "treason, bribery, or other high crimes and misdemeanors." It does not, however, provide any guidance as to what "high crimes and misdemeanors" are or what the burden of proof might be. Searchable U.S. Constitution Web site
A formal accusation
Impeachment is the act of formally accusing a public official of crimes or serious misconduct. Under the Constitution, the power to impeach lies with the House of Representatives. The Senate conducts any trial that might result from an impeachment. An official found guilty of impeachable offenses is subject to removal from office and disqualification from holding other federal posts.

Clinton's lawyers get 30 hours to make case against impeachment
Senators start talking about procedures for possible trial
WASHINGTON (AllPolitics, December 6) President Bill Clinton's attorneys will have 30 hours on Tuesday and Wednesday to make their case to the House Judiciary Committee that he shouldn't be impeached for his role in the Monica Lewinsky affair. On Sunday afternoon, the White House issued a statement accepting that schedule, which was put forward by the Judiciary Committee earlier in the day. But the statement made it clear that White House was not happy that the committee refused to give Clinton's lawyers four days to present his case, as they had requested Friday. "The Independent Counsel (Ken Starr) spent four years and $40 million investigating the president. The committee is spending four months doing the same. Our request for just four days has now been cut in half," the statement said. "Nevertheless, we will work to defend the president despite these restrictions."
Lott says he now expects Senate trial
On Sunday, senators on both sides of the political aisle said the time has come for the Senate to consider what procedures it will use to try Clinton if the full House of Representatives approves any articles of impeachment.

Senate grapples with impeachment trial rules
Clinton's trial gets under way with ceremonial flourishes
January 7, 1999
Web posted at: 6:25 p.m. EST (2325 GMT) WASHINGTON (AllPolitics, January 7) In a renewed attempt at bipartisan compromise, Senate Republicans and Democrats will meet at 9:30 a.m. ET Friday to discuss how to proceed with the impeachment trial of President Bill Clinton. Senate Majority Leader Trent Lott and Minority Leader Tom Daschle, at a joint news conference, said the two sides will try again to agree on procedures for Clinton's trial, which opened Thursday with a solemn, scripted ceremony. Also in this story: "We think that the best way to keep calm and cool and dignified is to look at each other and talk to each other," Lott said. Senate Majority Leader

Prosecution, defense wrap up impeachment arguments
Senate will begin deliberating Tuesday
February 8, 1999
Web posted at: 8:32 p.m. EDT (2032 GMT) WASHINGTON (AllPolitics, February 8) With a call to "let right be done," Rep. Henry Hyde, the chief House prosecutor, concluded the Republican managers' case Monday for removing President Bill Clinton from office. But White House Counsel Charles Ruff said nothing Clinton did justifies throwing him out of office. Rep. Henry Hyde When the court of impeachment reconvenes at 1 p.m. EST Tuesday, the 100 senators will begin their final deliberations, with an up or down vote on the two articles of impeachment expected Thursday or Friday. "If you agree that perjury and obstruction of justice have been committed and yet you vote down the conviction ... you raise the most serious questions of whether the president is, in fact, subject to the law or whether we are beginning a restoration of the divine right of kings," Hyde, an Illinois Republican, warned the Senate. Yet throughout their closing arguments, House prosecutors seem resigned that they will not convince the Senate to remove Clinton over charges of perjury and obstruction of justice relating to his illicit sexual affair with Monica Lewinsky.
