House of Representatives

On Monday, February the 24th, 1868, the House of Representatives of the Congress of the United States resolved to impeach Andrew Johnson, President of the United States, of high crimes and misdemeanors, of which the Senate was apprised and arrangements were made for the trial. On Monday the 2d of March, articles of impeachment were agreed upon by the House of Representatives, and on the 4th they were presented to the Senate by the managers on the part of the House, who were accompanied by the House, the grand inquest of the nation, as a Committee of the Whole on the state of the Union. Mr. BINGHAM, chairman of the managers, read the articles as follows: Articles exhibited by the House of Representatives of the United States, in the name of themselves and all the people of the United States, against Andrew Johnson, President of the United States, in maintenance and support of their impeachment against him for high crimes and misdemeanors. ARTICLE I.

The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors. U.S. Constitution, Article 2, Section 4 Introduction On September 11, 1998, Independent Counsel Kenneth Starr delivered an official report to the House Judiciary Committee detailing his investigation into the conduct of President William Jefferson Clinton. Following review, the committee may begin an impeachment inquiry, which, if carried to ultimate conclusion, may render the sitting President an ordinary citizen, and elevate the Vice-President to the Oval Office. Such action derives from Congress' Constitutional mandate and represents the most powerful check and balance granted to the Legislative Branch. As such, it is also the most difficult to implement, especially against the Presidency. To this date, only two Presidents have faced Articles of ImpeachmentAndrew Johnson in 1868 and Richard Nixon in 1974. In Johnson's case, the Senate's vote fell short of the neccessary two-thirds, while Nixon resigned before the House could vote on the Articles.

WASHINGTON (October 2) House Democrats unveiled their alternative Friday for a limited, six-week review of Independent Counsel Ken Starr's allegations against President Bill Clinton, saying the Republicans' proposal could lead to a two-year "fishing expedition." At a Capitol Hill news conference, Rep. John Conyers (D-Michigan) said Democrats' proposal would mean a "focused, fair, expeditious and deliberate" process. The chances that the Republican-led House Judiciary Committee will adopt it next week appear slim, though. Judiciary Committee Democrats
spoke Friday on their proposal
for a limited investigation of
the president
Under the Democrats' plan, the committee would first define a standard for impeachable offenses, then review Starr's referral on Clinton's sexual affair with Monica Lewinsky and his subsequent legal testimony. The House proceedings would start October 12 and end by November 25, with the option for a two-week extension.

37th U.S. President About President Nixon: He served as vice president under Republican President Dwight D. Eisenhower from 1953-61. Nixon ran unsuccessfully for the presidency in 1960, losing by a very close margin to John F. Kennedy. In 1962, Nixon ran unsuccessfully for Governor of California. This second loss led Nixon to bitterly announce he was leaving politics, telling reporters "...you won't have Nixon to kick around anymore." However, he re-emerged as a presidential candidate in 1968 and ran a successful campaign against Democrat Hubert Humphrey, squeaking out a victory in one of the closest elections in U.S. history. In 1972, Nixon ran for re-election against Democrat George McGovern and swept to victory in a landslide with 60 percent of the popular vote, winning in every state except Massachusetts. Events Leading to Impeachment: A break-in occurred on the night of June 17, 1972, as five burglars entered the Democratic National Committee offices inside the Watergate office complex in Washington. Discovered by 24-year-old night watchman Frank Wills, they were arrested at the scene by police at 2:30 a.m.

Thus far in the history of the United States there been three Presidential impeachment proceedings in 1868 against President Andrew Johnson for his removal of Secretary of War Edwin Stanton in violation of the Tenure of Office Act - 1974 against President Richard Richard Nixon for the Watergate coverup (106 years after Johnson) - 1998-99 against President Bill Clinton for concealing an extramarital affair (24 years after Nixon). Modern Impeachment Procedure:
  • Impeachment resolutions made by members of the House of Representatives are turned over to the House Judiciary Committee which decides whether the resolution and its allegations of wrongdoing by the President merits a referral to the full House for a vote on launching a formal impeachment inquiry. The entire House of Representatives votes for or against a formal impeachment inquiry, needing only a simple majority (a single vote) for approval.

WASHINGTON (Sept. 10) The White House is planning to mount an aggressive push designed to persuade the American people, and the House of Representatives, that President Bill Clinton's conduct in the Monica Lewinsky matter does not warrant impeachment, White House aides and advisers tell CNN. But there is some disagreement and disarray in the White House response to Independent Counsel Ken Starr's report to Congress, outlining his case for impeachment. White House aides have not been allowed access to the report, complicating efforts to compile an alternative document designed to challenge Starr's key conclusions. House Democrats are expected to push Thursday to give Clinton attorney David Kendall access to the report before it is released by the House on Friday. It was not clear if the Democrats would succeed in that effort, or how hard they would fight if Republicans resist the move.
