Question 1. How does an individual obtain a temporary visa to enter the U.S.? TOP

One can enter the U.S. temporarily for a variety of other reasons: as a visitor or tourist, business person, student, or employees etc. These temporary visas are known as "non-immigrant" visas and are issued at U.S. embassies and consulates located in most countries. At the issuing embassy or consulate, the visa officer must be convinced that the visa applicant will not remain in the U.S. after expiration of the authorized stay. The burden is on the applicant to demonstrate through strong personal, professional, or other evidence that his/her intent is to depart the U.S. within the prescribed time frame. Visas may be valid for one or more entries into the U.S. and are accordingly referred to as single entry or multiple entry.
A visa, however, does not automatically guarantee entry to the U.S. The immigration Officer at the U.S. port of entry makes that final determination.

Monday, February 28, 2005 President Bush and his pal, Mexican President Vicente Fox, want to solve the problem of illegal immigration by allowing "guest workers" to pour over the border, as long as they promise to return home after three years. Some anti-immigration activists maintain that's inviting reconquista , a retaking of the American Southwest by Mexico. Which means there is little chance a guest worker plan aimed at providing cheap labor for farmers and large businesses will get through Congress. That's because nothing not gay marriage, the war in Iraq, abortion, you name it gets Americans arguing as harshly as illegal immigration. We can't even agree on nomenclature or numbers. "Your article quite often refers to illegal aliens as undocumented immigrants," snorted an irate reader of a previous column. "That is exactly how some people try to change the thinking of others." The other side: "It's very degrading for any person to be called illegal or an alien," contended Fabian Nunez, the Democratic speaker of the California Assembly. "A person may be an illegal resident, but alien is not a fitting word." If we can't even agree on what to call the millions of immigrants (between 9 million and 15 million; there's no consensus on that, either) who snuck into America and now constitute a major presence, why expect agreement on anything else? Disputes rage over whether the undocumented are an economic burden or contribute as much in taxes as they use in public services, whether they help produce more jobs or take jobs from Americans.

Tens of thousands of highly skilled immigrants enter the United States each year on temporary visas. Their visas, under the H-1B program as it is known, are often sponsored by high-tech companies which intend to employ them. But once here, they are in a sort of legal limbo. If they try to switch companies or are laid off, they must start the immigration process all over again. Even the sponsoring company cannot promote them if it will change their basic job descriptions.
  • The annual allotment of temporary six-year visas has grown from 65,000 in 1990 to 115,000 in 1998 and it will temporarily increase to 195,000 if legislation now before the Senate is approved.
  • Existing limits have never been reached, however, because the Immigration and Naturalization Service has become increasingly unable to cope with its growing work load.
  • Consequently, the wait for a green card has stretched to several years with some immigration lawyers advising their clients to be prepared to wait for five year.
  • A green-card applicant must specify a job and an employer, which cannot be changed leading to what some workers describe as indentured servant status.

Welfare Reform And Food Stamps For Immigrants
Welfare reforms passed by Congress in 1996 included a provision to deny food stamps to legal immigrants who have not yet become U.S. citizens. Since then, 935,000 legal immigrants have been cut from the food stamp program.
  • The food stamp cuts are expected to save taxpayers $27 billion over six years more than half the savings under the welfare reform law.
  • Of those savings, $3.7 billion would come from denying aid to immigrants.
  • In the first year under the new law, the number of people receiving food stamps fell by nearly four million to about 21 million.
  • Bowing to political pressure, 13 states have restored some aid to about 235,000 immigrants mostly to children, the elderly and disabled.
The Clinton administration wants to restore legal immigrants to food stamp rolls. But congressional Republicans argue that restoring benefits to immigrants who are not citizens would be a major retreat on welfare reform. There are two visa types which are most often used by persons engaging in international education activities. These two visa types are F-1 and J-1. The F-1 is the most commonly used student visa. You will be considered for an F-1 visa, for example, if you intend to pay expenses using your own personal resources, or if you have been awarded a graduate assistantship at USF. If you are given an F-1 visa, your dependants will enter on F-2 visas and are not eligible for employment authorization. The J-1 is an "exchange visitor" visa which is managed under the auspices of the Exchange Visitor Program (EVP) and administered locally by USF which is a J-1 program sponsor. The J-1 visa is used primarily by exchange students (non degree-seeking) and by research scholars at USF. To qualify for USF's J-1 program, you must be "sponsored", in other words funded by your home university, USF, a government agency, a foundation, or an international organization authorized to conduct an exchange visitor program. Students cannot be placed on USF's J-1 program if the sole source of support is personal funds.

When the Immigration and Naturalization Services Agency contacted him as part of its homeland security campaign to publicize a new program requiring male immigrants from selected, predominantly Muslim countries to register with the federal government, Taheri was happy to oblige them. After all, it was in the post-9/11 spirit of halting terrorism, and so he agreed to printas a public service the registration information in his magazine, not knowing that the program would result in the detention and deportation of several hundred Muslim immigrants for minor immigrant-status violations. University of Iowa faculty and staff who work with international students and scholars are invited to discuss the new rules and other issues that have arisen from these changes at a forum, "From Security Checks to SEVIS: How International Student Regulations Impact UI." Led by Scott King, director of the Office for International Students and Scholars, the forum is scheduled from 2 to 4 p.m. Tuesday, March 2, in Room W401, Pappajohn Business Building. King says new government regulations and foreign student/scholar tracking programs are having a big impact on the way our campus works. "As more and more international students face situations that prevent them from reaching or re-entering the country, faculty and staff need to deal with delays in course work and research," he says. Even students who have studied here for several years without incident now are subject to security delays when applying for new visas, often leaving their academic departments with a scramble to fill teaching positions when they cannot return for the beginning of a semester, King says.     The Bahamas has been adversely impacted by a U.S. policy that allows Cubans who reach American soil to remain in the country and those apprehended on the water to be repatriated, Cuban Consul General to The Bahamas Felix Wilson said in a recent interview with the Bahama Journal.
    Mr. Wilson believes that the so-called “wet-foot, dry-foot” policy provides an incentive for Cubans seeking to flee their homeland to try to reach America.
    “There are some of these migrants who when they leave Cuba illegally decide to go by raft to the U.S. In many cases they end up in The Bahamas and The Bahamas is now suffering the consequence of the policy by the U.S.,” he said. The government of the United States has been roundly criticized by various groups for the controversial policy, which Mr. Wilson insisted is a bad one.
