    June 6, 2005 - The Government of Mexico does not fully comply with the minimum standards for the elimination of trafficking; however it is making significant efforts to do so.     Immigration Issues and Travel Restrictions By Suzanne B. Goldberg Immigration refers to the permanent resettlement of an individual from one country to another, either with legal authorization or without. Travel refers to shorter stays that are intended to be temporary. Both immigration and travel are subject to a variety of restrictions in countries throughout the world, and immigration has often been a source of social and political controversy. The government's ability to restrict entry is rooted in the core principle of national sovereignty that every nation has a basic right to protect itself by controlling its borders. Among the long-standing grounds of inadmissibility have been health-related reasons, along with disfavored political views, affiliations with terrorist organizations, involvement in international political conflicts, convictions for certain types of crimes, and personal characteristics such as sexual orientation. In the United States, a federal law, known as the Immigration and Nationality Act (INA), sets the terms for who may be admitted and lists several of these grounds. Since 1987, the United States has banned noncitizens with HIV from entering the country without a special waiver. Regardless of HIV status, every person who is not a U.S. citizen must establish that he or she is admissible to receive official permission, by a visa or otherwise, to enter the United States for any length of time. Few issues in U.S. immigration law have caused as much controversy as this exclusion. The reasons behind it are complex, reflecting ignorance and bias about HIV together with insular instincts that long have shaped the entire body of U.S. immigration law.

    MEXICAN GOVERNMENT BEGINS NEGOTIATING IMMIGRATION ISSUES WITH BUSH ADMINISTRATION The Mexican government is urging the Bush administration to allow more Mexicans to enter the US legally and to legalize the status of those already working in the US. In a meeting last Wednesday, Mexican representatives presented the proposal to US officials, hoping that the promises made during the February meeting between Mexican President Vicente Fox and US President George W. Bush to improve the cross-border relationship between the two countries will lead to an easing of immigration restrictions.
    The meeting was between high level representatives of both countries, with Secretary of State Colin Powell and Attorney General John Ashcroft representing the US and Foreign Minister Jorge G. Castaneda and Interior Minister Santiago Creel representing Mexico. The Mexican representatives presented four primary issues: legalizing the status of Mexican workers in the US, border safety, increasing the number of immigrant visas available to Mexicans, and creating a guest worker program.

    IMMIGRATION ISSUES STRAIN US-MEXICAN RELATIONS This past month, there were a number of developments indicating that immigration issues are causing tension between the US and Mexico. U.S. Border Patrol officers tie much of the stress to the increasing use of violence. In the past few weeks, four unarmed, undocumented immigrants have been shot, two fatally. A third was seriously wounded. The Border Patrol officers claim the victims were throwing stones or rushing at them in cars. Border Patrol agents have also been killed, one shot fatally earlier this year by drug smugglers illegally crossing the border. A number of Mexican government and human rights officials have expresses shock and concern about the sudden increase in violence. Earlier this month, for example, a number of human rights experts from Mexico toured the Chicago area to investigate INS detention procedures. This is believed to be the first Mexican delegation to visit the United States on a human rights investigation. The delegation consisted of six representatives of some of the largest human rights organizations in Mexico. The delegation's report is expected to be released before the end of the year. The Chicago INS appears to be concerned about the accusations of human rights abuses. Shortly before publication time, the INS announced that it would notify the Mexican Consulate in Chicago of planned INS raids. Chicago-are detainees would then have the right to phone the consulate or a lawyer before they are processed for possible deportation.

    in Counter-Terrorism Legislation Human Rights First welcomes progress, but calls for improvements on detention language – and removal of troubling new provision that could hurt asylum-seekers In the aftermath of the September 11 attacks, the U.S. government has the authority, indeed the duty, to take every reasonable step to ensure security for everyone in the United States. As one of its first official responses, the Bush Administration has proposed counter-terrorism legislation for fast-track approval by Congress. Congress is now debating and negotiating this legislation, and Human Rights First welcomes the progress that has been made. For example, we are relieved that the Attorney General’s decision to label a non-U.S. citizen as a threat to national security would, under the current proposal, be subject to, at least, limited judicial review. At the same time, we remain deeply concerned that the proposed legislation would still allow for the indefinite detention of some non-U.S. citizens. We are also disturbed that a new provision in the House bill could put genuine asylum seekers and their families in serious danger by allowing U.S. officials to disclose sensitive information to the governments from which the refugees have fled.
