Seventh Circuit Reverses Summary Judgment in Title VII Retaliation Case

Chicago:(7/20/05): On July 20th, the Seventh Circuit reversed a finding in favor of the employer on summary judgment in a retaliation case under Title VII, where the plaintiff had a favorable evaluation but was terminated shortly after she complained of gender discriminination. The court found that her supervisor complained about her attitude only after she made the gender discrimination complaints, and noted that she was fired only three days after threatening to file a gender based discrimination charge. She also failed to mention anything about the plaintiff's attitude at her deposition. To see the actual decision, click on "more" below.

Seventh Circuit Reverses Summary Judgment in Favor of the Employer in FMLA Case
Chicago: (7/19/05): On July 19th, the Seventh Circuit reversed a finding of summary judgment in favor of the employer in a Family Medical Leave Act case where the employer required the returning employee to submit to an examination by a doctor chosen by the company before it would allow the plaintiff to return. The court held that the FMLA permits an employee to return to work based on a report issued by the employee's treating doctor and if the doctor says they can return to work, the employer must accept the employee back. Illinois General Assembly Passes Big Gay Bill
This morning the Illinois House passed an amendment to the Illinois Human Rights Act (the Senate passed it yesterday) banning discrimination based on sexual orientation in matters of employment, housing, public accommodations (restaurants, hotels, etc.) or credit. The Senate passed the bill with a 30-27 vote and the house passed it 65-51 Activists have been trying to get a bill passed adding "sexual orientation' to the Human Rights Act for decades and the House passed it twice in the last 12 years, but it stopped short in the Senate. The amendment just barely made the deadline as the new legislature will be sworn-in tomorrow and it would have died if it wasn't passed before then. Though he hasn't yet said it himself, Blago will sign the bill and made a number of calls yesterday to lawmakers encouraging them to get it passed. Opponents of the amendment claimed it wasn't about discrimination (though it's pretty clear in the text that it is), but about changing Illinois' standards of acceptable behavior. OH NO! NOT A MORE ACCEPTING SOCIETY! OUR FAVORITE ACTIVITY IS JUDGING PEOPLE ARBITRARILY RATHER THAN BY THE CONTENT OF THEIR CHARACTER! Some critics also feared it would allow cross-dressers to use their opposite sex's bathrooms. FUCKING GROW UP! As Rep. Lou Lang, D-Skokie said "This bill isn't about cross-dressing, it isn't about animals. It's not about anything except basic human rights for the citizens of Illinois." Uhm...what about animals? Oh, oh, oh, all gay people, and no heterosexual people, have sex with animals. That's right.

Community Benefits Reporting in Illinois: Definitions and Standards for Reporting
The Illinois Community Benefits Act (PA 93-0480) was enacted on August 8, 2003 and requires certain non-profit hospitals to file several types of reports with the Attorney General's office, including an annual community benefits report. The legislation outlines ten types of community benefits that must be reported: charity care, language assistant services, government-sponsored indigent health care, donations, volunteers, education, government-sponsored program services, research, subsidized health services and bad debt. Compliance instructions were issued in February 2004 by the Illinois Attorney General's office that provided broad guidance on types of costs to include in the annual report. But, quantifying the many and varied benefits that a hospital provides is a challenging task. Especially so as many organizations are increasingly complex and provide such diverse benefits to their communities based on the individual community needs. It is therefore unwise to attempt comparisons among hospitals as they are responding to their unique communities in the benefits they provide. It is important for hospitals to maintain consistency from year to year in what types of benefits they are including and if there is a significant change in what is counted, to make a note in the report as to the nature of the change. Also, hospitals that are a part of a system, should maintain consistency across the system as to what types of community benefits are reported.

I know of no other way to describe the NBA Commissioner's complete failure to impose any sanction designed to redress the actions of unruly fans in Detroit. Today David Stern announced severe, and warranted, suspensions of the NBA players involved in the Friday's courtside riot in Detroit. Yet Stern announced no measures indeed, could not even bring himself to directly condemn the actions of the fans addressed at the misbehavior of the guilty fans. No penalties were assessed on the Detroit Pistons organization for insufficient security; season-ticket holders who assaulted players did not have their tickets revoked, nor were any such measures recommended by the Commissioner in his statement. All David Stern offered was empty platitudes about how tyhe league must "redefine the bounds of acceptable conduct" for fans and players alike. Note to David Stern: If fans get to assault players without any penalty, the league is not "defining the bounds of acceptable conduct." Rather, the message of Sterns actions is that wealthy folks who spend lots of money on courtside seats can act like juvenile thugs because they are the NBA's "customers" without fear of penalty while players who act to defend themselves merit no mercy.

In the summer of 1981, the Attorney General's Task Force on Violent Crime recommended that each United States Attorney establish a Law Enforcement Coordinating Committee (LECC). The bi-partisan Task Force included eight distinguished national criminal justice experts who closely examined federal, state, and local law enforcement needs. The recommendation to establish LECCs came as a direct result of the group's finding that local law enforcement cooperation was crucial, but that cooperation nationwide was uneven. The Attorney General responded to the Task Force recommendations, and on July 21, 1981, issued an order instructing each United States Attorney to establish an LECC. Each committee has a U.S. Attorney's Office staff member as its coordinator. Today, all United States Attorneys' Offices have an LECC consisting of federal, state, and local agencies involved in district law enforcement. The goal of these committees is to improve cooperation and coordination among law enforcement groups, thereby enhancing the effectiveness of the criminal justice system. The LECC program has become a cornerstone of joint federal, state and local law enforcement efforts.

Unemployment Insurance Background The unemployment insurance (UI) system is a unique federal-state partnership , grounded in federal law but executed through state law by state officials. Compulsory unemployment insurance (UI) was created during the depression of the 1930's by the Social Security Act. Funding for the program was provided through the Federal Unemployment Act. UI was designed both to alleviate personal hardship and stabilize the economy by providing insured workers with temporary and partial replacement of wages lost by involuntary unemployment. Get the most recent IDES Unemployment Insurance Trust Fund Report Benefits are available as a matter of right to unemployed workers who meet state qualifying and eligibility requirements. State laws vary regarding eligibility for benefits, the amount of benefits, and the amount of weeks which may be paid. State Funding and Administration State unemployment benefits are financed through state payroll taxes which are held in individual state trust fund accounts in the U.S. Treasury's Federal Unemployment Trust Fund. These funds are invested by the Secretary of the Treasury in government securities in the same manner as social security trust funds. Federal law prohibits the use of these funds for any purpose other than payment of unemployment benefits.

The Lieutenant Governor may also have programs of his/her own. The Attorney General is the state's chief lawyer. The Attorney General is the lawyer for all of the elected state officials, departments and agencies. The Attorney General also is responsible for protecting the people of Illinois from things such as pollution, fraud and crime. The Secretary of State has a very interesting job. The Secretary of State is responsible for maintaining all of the official state records and the state seal. In addition, the Secretary of State issues all driver's licenses and license plates. The Secretary of State serves as the state librarian. Sometimes people get the Comptroller and the Treasurer mixed up. The Comptroller is the chief financial officer for the state and is responsible for keeping track of the state's money. The Treasurer is the state's banker. The Treasurer decides where the state should invest its money. The legislative branch consists of the Illinois House of Representatives and the Illinois Senate. The House of Representatives consists of 118 members. The members are elected by the people in their district or area of the State. A Representative serves a 2-year term. The Senate has 59 members who are elected from districts throughout the State. A Senator serves a 4-year term. Together, the House and the Senate are known as the General Assembly. The General Assembly makes the laws for the State of Illinois.

Home General Overview With the signing of Public Act 91-173, the Dyed Diesel program in Illinois became effective January 1, 2000. Aligning Illinois' program with the Federal dyed diesel/low sulfur program, Illinois law now requires that all special fuel used for non-taxable, non-highway use must have red dye added. The dye provides the identifier which serves as an enforcement tool during field audits and inspections. The importance of this program is recognized and supported by the motor fuel industry as it serves to "level the playing field" and enhance compliance in an industry vulnerable to tax-evading schemes. Funding secured from the Illinois Department of Transportation, the Illinois State Police, and the Illinois Commerce Commission to purchase vehicles and testing, sampling, and safety equipment, has allowed IDOR to enforce this program.
