      Personal Injury Law: General
      Personal injuries, as their name implies, are injuries to an individual person. Crimes are wrongful acts against society. The government punishes those who commit crimes with criminal penalties. For personal injuries, the government does not punish the wrongdoer but gives the victim the right to pursue a private, civil lawsuit, called a tort action, against the wrongdoer. Some wrongful acts are both crimes and torts, and can subject the wrongdoer to both criminal penalties and tort remedies. This chapter outlines the actions that lead to most personal injury lawsuits, including general accidents and injuries, use of defective products, and injuries occurring to workers on the job.       General Concepts of Tort Law
      Tort laws are based on the premise that when someone does something to harm another person physically, mentally, or financially, the person harmed ought to be compensated for the loss. Tort lawsuits are governed by a set of rules that are different from the rules that govern criminal lawsuits.

In comparison to federal legislative history documentation, there are far fewer sources to determine legislative intent for Illinois legislation. One good (but dated) source about Illinois legislative research is Wendt, Illinois Legal Research Manual (St. Paul: Butterworth Legal Publishers, 1988) (R,REF KFI 1275. W4 1988). Chapter Six discusses Illinois Legislative History. This chapter originally appeared at 1982 Southern Illinois University Law Journal 601. Suggestions The recent explosion of technological devices capable of recording and monitoring employee conduct come at a time when employers are seeking new methods for trying to prevent the above problems and for avoiding liability based on negligent hiring and employee misconduct. It also comes at a time when social concerns about the erosion of individual privacy have increased, resulting in the enactment of laws designed to significantly restrict the use of such devices in the workplace and elsewhere. Employers are now faced with a dilemma: using more sophisticated methods for monitoring conduct can lead to claims of violation of privacy rights, thereby negating the beneficial effects intended. Consequently, it is increasingly important for employers to be aware of statutory and other limitations imposed on such monitoring and to comply fully with their legal obligations. This memorandum examines requirements of various Federal and Illinois laws as they relate to electronic monitoring of employees.

Illinois Legislative History
Attorneys use a legislative history to ascertain the meaning of a word or statute. It is traditionally thought to consist of the debates, committee reports and committee hearings. For the majority of states these materials are largely unavailable. For the State of Illinois, a legislative history consists of comments made at the second and third reading of the act, the Governor’s veto message, where applicable and committee reports from the House. Legislation is assigned a bill number as it is introduced. The bill number is the key piece of information to do a legislative history. Before legislation is enacted and becomes law, it is a bill. To do a legislative history, the researcher must work backward from the law as published in Smith-Hurd Illinois Compiled Statutes Annotated to the bill number and then track the bill forward through the legislative process. Constitution In 1970, Illinois adopted a new constitution that required that floor debates be recorded. Illinois Constitution of 1970, Article 4, §7(b). These transcripts are the primary source of legislative intent. The recording of these transcripts began in October of 1971. Smith-Hurd Illinois Compiled Statutes West’s Smith-Hurd Illinois Compiled Statutes Annotated contains a compilation of the laws of Illinois by subject. Following the statute, the enacting statute and any amendments are listed as Public Acts. In addition, there is a section titled ‘Historical and Statutory Notes’ which contains an abbreviated discussion of changes effected by each amendment.

Delay in New Orleans
From the Washington Post via the St. Louis Post-Dispatch : " New Orleans mayor postpones re-entry ," by Ceci Connolly With Tropical Storm Rita bearing down on the Gulf of Mexico and growing political pressure from federal leaders, Mayor Ray Nagin said Monday that New Orleans residents could not return home after all and that any people already in the city should evacuate. Nagin had been allowing business owners to return over the weekend, and on Monday, residents of one dry neighborhood were to return to their homes. But Nagin reversed himself and ordered another mandatory evacuation, to begin Wednesday, just hours after President George W. Bush questioned whether the city was safe enough for people to return.
