      Automated Telephone Calling Card with a Free Sweepstakes Game Piece as a "Lottery"

    Dear Speaker Madigan:
    I have your letter wherein you inquire: (1) whether sales of the "Lucky Shamrock Prepaid Emergency Phone Card", an automated telephone calling card which also contains a free sweepstakes game piece, constitutes a "lottery"; and, if so, (2) whether the "Lucky Shamrock Prepaid Emergency Phone Card Dispenser", an automated telephone calling card dispensing machine, constitutes a "gambling device." For the reasons hereinafter stated, it is my opinion that the sale of a Lucky Shamrock Prepaid Emergency Phone Card that also contains a sweepstakes game piece, in the circumstances you have described, constitutes a "lottery" as that term is used in Illinois law. Further, it is my opinion that the Lucky Shamrock Prepaid Emergency Phone Card Dispenser is a "gambling device", as that term is defined in Illinois law. A review of the materials submitted with your request indicates that Diamond Game Enterprises, Inc., is marketing the "Lucky Shamrock Prepaid Emergency Phone Card" (hereinafter referred to as the "Phone Card") through the sale of the "Lucky Shamrock Prepaid Emergency Phone Card Dispenser" (hereinafter referred to as the "Lucky Shamrock Dispenser"), an automated telephone calling card dispensing device which resembles a slot machine. A person who inserts a one dollar bill into the Lucky Shamrock Dispenser receives, in return, a Phone Card good for two minutes of long distance telephone service on a touchtone telephone. Each Phone Card contains a toll-free number by which to access the long distance network and a personal identification number to validate the call.

    Gentlemen: You have inquired regarding the scope and application of section 10-20.14 of the School Code (105 ILCS 5/10-20.14 (West 1994)) as it relates to the reciprocal reporting of information between school districts and local law enforcement agencies. Specifically, you have asked whether a reporting agreement must be limited to occurrences for which a minor has been adjudicated delinquent. For the reasons hereinafter stated, it is my opinion that a reciprocal reporting agreement may include the sharing of information regarding acts of students who have not been adjudicated delinquent. Section 10-20.14 of the School Code provides:

    The History of Sodomy Laws in the United States

    "The existence of such an offense is a disgrace to human nature." The Post-Revolution Period, 1776-1873 After the Revolution, Illinois, as part of the original Northwest Territory, received the English buggery law with a 1795 Northwest Territory ordinance, thus making sodomy a capital offense for males only. In 1809, the Illinois Territory was created and a statute adopted all laws of the Indiana Territory, in place of the Northwest Territory law. The harsh code of Indiana adopted by Illinois provided for a penalty of up to five years in prison, a fine of $100-$500, and up to 500 lashes. This statute remained until a new law was adopted after statehood. In 1819, a law was adopted to revise criminal penalties. The sodomy penalty was changed slightly to set the jail term at 1-5 years, and the flogging penalty at 100-500 lashes. The fine remained unchanged. A supplemental law adopted the common law of England and all English statutes in support of the common law adopted prior to the Jamestown settlement.

In the meantime, the size of the web and the power of search engines have both leaped forward. The growth of the web has made representative or comprehensive link pages more difficult to produce, and the improvement of search engines has made them less necessary. Link pages can still be very useful, but to make them more useful than the best search engines takes more work than they are usually worth. So I won't be updating this link page (from the previous iteration of the course) but I leave it online in case it has any remaining utility. When I know of specific web pages helpful for a class discussion, then I'll mail out the URLs to the class email list during the semester (and I encourage you to do the same). For general online research on the many topics of the course, I recommend Google There are hundreds of good web pages that collect links to U.S. law. The only excuse to make another one is to customize it for (1) undergraduate students (2) studying law as a liberal art (3) in Indiana (4) for my course, .
