FOR MOST DANGEROUS SEX OFFENDERS
Governor signs additional laws tightening restrictions and registration,
and defining parameters to better help citizens keep track of sex
offenders residing in their communities
Madigan initiated several of the proposals in the package the Governor is signing, including a proposal for lifetime supervision for sex offenders, a proposal to protect residents of nursing homes from sex offenders and other convicted felons and a proposal that will better equip law enforcement to crack down on non-compliant sex offenders. Sponsored by Rep. Careen M. Gordon ( D-Coal City) and Sen. Don Harmon ( D-Oak Park) and authored by Attorney General Madigan, House Bill 2386 creates the possibility of lifetime parole supervision for some of the highest-risk sex offenders convicted of predatory criminal sexual assault of a child, aggravated criminal sexual assault or criminal sexual assault, on or after July 1, 2005. Currently, all sex offenders released from prison serve a parole term of a maximum of five years under the Illinois Department of Corrections (IDOC), where they are closely supervised by a parole agent who has the authority to return them to prison for exhibiting high-risk behaviors. Under this new law, these three categories of offenders will be mandated from a minimum of three years to a maximum of lifetime of parole supervision as determined by the Prisoner Review Board.

Provides that a person commits the offense by knowingly alleging that a person is the biological father of a child when that person knows that the allegation is false. One of the first steps in reframing the issue is to enact state legislation similar to federal policy which condemns the use of controlled substances in perpetrating violent crimes. Current state legislation must therefore be changed to: (1) classify Rohypnol under the strictest category of
substances under the Controlled Substances Act of 1970, Schedule I; and (2) acknowledge drug related sexual assault as a felony under the criminal code. As mentioned previously, Illinois law only censures the non-medical use of Rohypnol, thereby framing the issue of the drug in medical/health terms. However, Rohypnol must be explicitly recognized as a drug used to facilitate violent and serious crime. Those individuals in positions to develop and alter policy must be made aware that Rohypnol is not only illegal and poses physical danger, but that it is utilized as a stealth weapon to perpetrate violent acts of sexual assault against women. If Rohypnol was classified as a Schedule I drug, and drug-related sexual assault was designated a felony
under the criminal code, this crime would be punishable by a mandatory jail sentence of 30 years. Therfore, implicit in this new legislation would be a broad social goal of intolerance of violence against women.

Posted by KTK Edit This The anti-choice blogosphere is all a-flutter over this report of a recent preliminary decision in an Illinois lawsuit. A couple sued an IVF clinic which inadvertently destroyed some stored, frozen conceptuses, on grounds of wrongful death two murder convictions in the case of the death of one pregnant woman being only the most egregious example). It could have indirect implications for the abortion debate - it would more directly make IVF procedures and embryo research all but impossible. Already sex-negatives are crowing over this precedent. ). This ruling certainly sets up a legal showdown over that principle, but it does nothing as far as actually overriding it. (In fact, the ruling merely states that the case can proceed - it does not even state that the legal theory the couple is banking on is valid - only that they have the right to argue their case.) The judge is relying - as a trial judge pretty much has to - on the fact that the laws exist - he is not asserting as legal precedent that the laws are Constitutional.     The critical question in this case is whether, under the circumstances, the refusal by the police to honor petitioner's request to consult with his lawyer during the course of an interrogation constitutes a denial of "the Assistance of Counsel" in violation of the Sixth Amendment to the Constitution as "made obligatory upon the States by the Fourteenth Amendment," Gideon v. Wainwright, 372 U.S. 335, 342, and thereby renders inadmissible in a state criminal trial any incriminating statement elicited by the police during the interrogation.
    On the night of January 19, 1960, petitioner's brother-in-law was fatally shot. In the early hours of the next morning, at 2:30 a.m., petitioner was arrested without a warrant and interrogated. Petitioner made no statement to the police and was released at 5 that afternoon pursuant to a state court writ of habeas corpus obtained by Mr. Warren Wolfson, a lawyer who had been retained by petitioner.

    Originally published in the Belleville News-Democrat , May 18, 2003 If a person molests a child in Illinois, he faces up to 30 years in prison. If he molests his own child, he can get probation. The reason is a special provision in the Illinois criminal code that allows for a lighter sentence if a person commits incest rather than molesting a stranger's child. And it has caught the eye of national children's rights groups and state legislators, who want to put an end to Illinois' incest exception. A deliberate loophole In 1981, legislators added an exception to the sentencing code for sexual assault, allowing prosecutors to offer probation in incest cases in an effort to keep troubled families together while addressing their problems. Madison County prosecutor Kyle Napp said she has never had a judge actually sentence probation unless the state's attorney's office agreed. But St. Clair County State's Attorney Robert Haida said judges have imposed probation in some cases when his office wanted imprisonment. "We've had cases where we have asked for jail time, and it's not a case where the judges always follow our recommendations," Haida said.

    Special session on criminal justice
    Will it be the governor's Class X or the legislature's H.B. 1500?
    IT SEEMS a near certainty that sweeping criminal justice reform will result from the special session of the General Assembly called by Gov. James R. Thompson for October 24. For one thing, that is the avowed major purpose of the session, for another it is clearly the will of both the legislature and the governor. The real question is: What kind of reform will be adopted and who will get the credit for it? Gov. Thompson announced a compromise anti-crime package August 26 designed to break the legislative deadlock on divergent crime bills. In the regular session last June two forms of criminal code overhaul vied for acceptance. One was House Bill 1500, a House Judiciary II Committee bill that was drafted after two-and-a-half years of study on crime sentencing procedures. H.B. 1500 passed the House 153-6, but was squelched after the main competing concept — Gov. Thompson's Class X package — was amended onto it in the Senate. (The Senate had passed Class X earlier, 33-10, in the form of S.B. 165, sponsored by Sen. George Sangmeister (D., Joliet)). That the two concepts both died was seen by some to be the result of an unsavory scramble for political credit for cracking down on criminals. Yet there were several very basic differences in the substance of the reforms, differences which both sides tended to obscure in attempts to vilify the other.
