Procedures for Investigating and Reporting Misconduct
and Incidents at State Facilities State Official Employees Ethics Act established among other things, the Office of Executive Inspector General (“OIG”) to investigate misconduct in agencies, boards and commissions directly responsible to the Governor. Title 20, ILCS Section 2605/2605-50 established the Illinois State Police, Division of Internal investigation (“ISP/DII”) to (i) initiate internal State Police investigations and, (ii) investigate allegations of official misconduct by State office holders and employees directly responsible to the Governor, as directed by the Governor. To clarify the duties and responsibilities of the OIG and the ISP/DII, I hereby establish the following procedures for investigating and reporting allegations of misconduct by state office holders and employees, vendors of the State, and incidents at State facilities. Except as outlined in Section III of this Order, the OIG must be notified immediately of all alleged acts of misconduct by any employee in, or any entity that has a contract with, an agency, board or commission directly responsible to the Governor. The OIG will determine whether to investigate the allegations, refer the allegations to the ISP/DII for investigation, or request that the reporting agency conduct an internal investigation. The ISP/DII shall be the primary agency responsible for the investigation of criminal conduct by state employees or criminal incidents at State facilities, as further described in Section III.

Criminal Codes
Criminal law defines conduct that is prohibited by the government and the range of penalties that can be imposed for violating these prohibitions. Persons who violate criminal laws incur penalties ranging from fines to imprisonment or, in some states, execution. All crimes are defined by statutes. These statutes are collected and organized into books of rules known as criminal codes. In addition to the Illinois State Criminal Code, which applies only in Illinois, the federal government has a criminal code that regulates certain crimes nationwide. Most criminal activity violates either a state law or a federal law, not both; however, an important exception is drug crimes, which can be prosecuted in either state or federal court or both. Every crime is defined by a list of elements. In a criminal trial, the prosecutor attempts to prove all the elements of the crime the person is accused of committing. If the judge or the jury decides all the elements of the crime have been proven beyond a reasonable doubt, the accused person is guilty of the crime. If the prosecutor cannot prove all the elements, the accused cannot be found guilty of the crime.

There are some cases in which Illinois criminal law will not be applied. In some circumstances in which the details of a crime will make it necessary to apply federal criminal law. Most crimes are defined by local and state government; however, Title 18 has been adopted by the federal government as its criminal code. This applies to crimes that cross state boundaries and create an interest applicable to federal courts. Some examples include politicians that violate ethics rules, insurance fraud or a stockbroker that steals from client funds.
There are many Illinois lawyers that are experienced in defending criminal charges in state court. However, if you have a federal criminal charge it is very important that you are represented by someone with experience defending federal crime cases as they are much different than Illinois state court matters. Fortunately we know many good Illinois lawyers with a lot of experience defending federal charges, including many attorneys that used to work for the Department of Justice and now are in private law practice in Illinois.

The Policy and Advocacy Committee of the AIDS Committee of Toronto developed the first policy of any community-based organization in Canada on the use of criminal sanctions as a response to the transmission or threatened transmission of HIV. Unless specifically exempted by statute, any Illinois resident who acquires or possesses firearms or firearm ammunition within the State must have in their possession a valid Firearm Owner's Identification (FOID) card issued in his or her name. APPEAL ARMED VIOLENCE COLLATERAL REMEDIES ... [NEXT] Defendants, members of the Gangster Disciples, engaged in a shootout with members of the Black Disciples. When the Black Disciples returned fire, a member of the Gangster Disciples was killed. Defendants were convicted, as accomplices, of the first degree murder of their fellow gang member. The trial court found that defendants were accountable because it was "foreseeable" that when they fired in the direction of the Black Disciples, fire would be returned and the decedent killed. The Appellate Court held that the defendants could not be convicted under 720 ILCS 5/5-2(c), which provides that a person is legally accountable for the conduct of another when either before or during an offense, and with the intent to promote or facilitate the offense, he "solicits, aids, abets, agrees or attempts to aid, such other person in the planning or commission of the offense." The Appellate Court concluded that the evidence did not show that the defendants either solicited members of the Black Disciples to kill the decedent, or aided or abetted in the killing. Rather than reverse the murder convictions outright, however, the Appellate Court remanded the cause with instructions to determine whether the defendants had been prejudiced by the State's failure to charge felony murder. If the trial court found on remand that the defendants were not prejudiced by the omission of a felony murder count, it was to determine whether the evidence established the defendants' guilt of felony murder beyond a reasonable doubt.

Defendant was charged with domestic battery in this case and in a separate case. He pleaded guilty in this case in return for a sentence of thirty months probation. The separate charge was dismissed. Before imposing a sentence, the trial court found that defendant had previously violated the domestic battery statute in the incident involved in the separate charge.
Two months later, the State filed a petition to revoke probation, alleging that defendant had been charged with the first degree murder of the complainant and the theft of her car. Probation was revoked, and defendant was sentenced to a three-year sentence to be served consecutively to a thirty-five-year sentence for first degree murder. On appeal, defendant argued that the trial court erred by sentencing him as a Class 4 felon for domestic battery because he had no previous convictions for domestic battery.
