- Unfortunately, the negotiations on this issue are not as sincere. No one can show us a system that is proven, nor a benchmark for statistical comparison. We have suggested that the Secretary of State (SOS) collect the data from every stop thru an automated system. This would require the race of each driver to be entered into the database which proponents of the statistical data collection believe would take too long. However, if the stop data was collected beginning this year and the procedures were put into place to update the race of each driver, the stop data could be saved and compiled once the ethnic information was completed. This will be on the fast track and will be tied to Primary Seat Belt Legislation according to reliable sources.
EXPUNGEMENT STIPENDS LABOR ISSUES - HB 2416 - Amends the Uniform Peace Officers' Disciplinary Act. Provides that a peace officer shall not be interrogated without written notice of his or her rights under the Act, delivered in person or by certified mail no less than 3 days before the interrogation, unless this requirement is waived by the officer. The Illinois Civil Justice League is a coalition of Illinois citizens, small and large businesses, associations, professional societies, not-for-profit organizations and local governments that have joined together to work for fairness in the Illinois civil justice system. The League's agenda is limited to working for, and preservation of, a civil justice system that is fair to all Illinois citizens and interests. The League, with its members, was the principle author and proponent of major tort liability reform in the Illinois General Assembly in 1995. One of the immediate impacts of the new law was a sharp reduction in the number of civil lawsuits in Illinois following enactment of the law by Governor Jim Edgar, a reduction that saved Illinois taxpayers and consumers millions of dollars. Yet in a controversial and highly questionable ruling, the Illinois Supreme Court overturned that law in 1997. The conditions that necessitated sweeping tort reform legislation in 1995 have not disappeared; in fact, they have worsened since the Supreme Court's ruling and thus the agenda and objectives of the Illinois Civil Justice League continue, with a concentration in specific areas:
  • The League believes a fair and impartial judiciary is essential to a fair civil justice system. Thus the ICJL and its members will closely monitor the performance of judges and will evaluate the qualifications and experience of candidates for the judiciary.

    Seventh Circuit Reverses Summary Judgment in Title VII Retaliation Case

    Chicago:(7/20/05): On July 20th, the Seventh Circuit reversed a finding in favor of the employer on summary judgment in a retaliation case under Title VII, where the plaintiff had a favorable evaluation but was terminated shortly after she complained of gender discriminination. The court found that her supervisor complained about her attitude only after she made the gender discrimination complaints, and noted that she was fired only three days after threatening to file a gender based discrimination charge.     Seventh Circuit Reverses Summary Judgment in Favor of the Employer in FMLA Case
    Chicago: (7/19/05): On July 19th, the Seventh Circuit reversed a finding of summary judgment in favor of the employer in a Family Medical Leave Act case where the employer required the returning employee to submit to an examination by a doctor chosen by the company before it would allow the plaintiff to return. The court held that the FMLA permits an employee to return to work based on a report issued by the employee's treating doctor and if the doctor says they can return to work, the employer must accept the employee back.     "Genetic testing" means a test of a person's genes, gene products, or chromosomes for abnormalities or deficiencies, including carrier status, that (i) are linked to physical or mental disorders or impairments, (ii) indicate a susceptibility to illness, disease, impairment, or other disorders, whether physical or mental, or (iii) demonstrate genetic or chromosomal damage due to environmental factors. Genetic testing does not include routine physical measurements; chemical, blood and urine analyses that are widely accepted and in use in clinical practice; tests for use of drugs; and tests for the presence of the human immunodeficiency virus. "Insurer" means (i) an entity that transacts an insurance business and (ii) a managed care plan.     our petitioner, though humble in position, and having no political status in your State, notwithstanding I have resided in it for twenty-five years, and today am paying taxes on thirty thousand dollars, most humbly beseech you to recommend in your Message to the Legislature... the repeal of the Black Laws of this your State." Thus began John Jones's letter to Illinois Governor Richard Yates, November 4,1864. By the time Jones wrote this letter he was the best-known and wealthiest African-American in the state. Though wealthier by far than most Illinoisans, still Jones could not vote. Born in North Carolina in 1816 or 1817, Jones had arrived about 1841 in Madison County, Illinois, where he took up residence illegally. It was not until three years later, as he prepared to move to Chicago with his wife and infant daughter, that he filed the necessary bond and received his certificate of freedom, a document required by every black person in the state. Because he had been born out of state, under the law of 1829 he was required to file a bond of $1,000 to insure that he would not become "a charge to the county," or violate any laws. Although Illinois entered the Union nominally as a free state in 1818, slavery had existed there for nearly one hundred years. It would continue to exist, albeit under increasing restrictions, until 1845.
    But the elimination of legal slavery did not mean the removal of the Black Codes. Indeed, it was not until the passage of the Fifteenth Amendment to the U.S. Constitution and the adoption of the Illinois Constitution of 1870 that the last legal barriers (but not the societal) ended. Like their midwestern neighbors, most early Illinois settlers believed in white supremacy and African-American inferiority. Consequently, Illinois' constitutions and laws reflected those views.
