This chapter outlines how the criminal justice system operates and describes the most serious criminal violationsfelonies, and lessor violationsmisdemeanors. It also includes information about the rights of persons accused of crimes and the rights of crime victims.
Criminal Codes
Criminal law defines conduct that is prohibited by the government and the range of penalties that can be imposed for violating these prohibitions. Persons who violate criminal laws incur penalties ranging from fines to imprisonment or, in some states, execution. All crimes are defined by statutes. These statutes are collected and organized into books of rules known as criminal codes. In addition to the Illinois State Criminal Code, which applies only in Illinois, the federal government has a criminal code that regulates certain crimes nationwide. Most criminal activity violates either a state law or a federal law, not both; however, an important exception is drug crimes, which can be prosecuted in either state or federal court or both. Every crime is defined by a list of elements. In a criminal trial, the prosecutor attempts to prove all the elements of the crime the person is accused of committing. If the judge or the jury decides all the elements of the crime have been proven beyond a reasonable doubt, the accused person is guilty of the crime. If the prosecutor cannot prove all the elements, the accused cannot be found guilty of the crime.

PRESIDING JUSTICE BURKE delivered the opinion of the court: STATEMENT OF FACTS Plaintiff's cause of action against defendant involves defendant's alleged breach of its statutory duties, by its refusal to pay plaintiff's claims for unearned premiums, under the Illinois Insurance Guaranty Fund Act (the Guaranty Fund Act) (215 ILCS 5/532 et seq. (West 2000)) as set forth in article 34 of the Illinois Insurance Code (Insurance Code) (215 ILCS 5/1 et seq. (West 2000)). In plaintiff's ultimate third amended complaint, plaintiff alleged that it was the assignee of National IPF Company (National) and was in the business of financing insurance premiums for insurance contracts. Plaintiff had "advanced loan proceeds directly to *** insurance compan[ies] to finance premiums on behalf of *** individual borrower[s] to be insured." Plaintiff advanced funds, at various times, to pay for the premiums of 68 individuals insured by the Coronet Insurance Company (Coronet) and, pursuant to finance agreements, all claims to any unearned premiums of the policies financed were to be returned to plaintiff in the event that the policies were cancelled. On December 24, 1996, Coronet was declared insolvent. Defendant is a nonprofit unincorporated entity created pursuant to article 34 of the Insurance Code, and, subsequent to Coronet's insolvency, National filed a claim with the Office of Special Deputy Receiver (the Receiver) because, among other reasons, it was told to do so by defendant. Specifically, in April 1998, defendant told National that it could not consider any payment to National on its claims because it had not received any of the necessary information from the Receiver. On April 23, 1999, National assigned several claims to plaintiff, including the claims against Coronet.

PART 1 CIVIL SERVICE COMMISSION The General Assembly's Illinois Administrative Code database includes only those rulemakings that have been permanently adopted. About CSC
The Civil Service Commission is a 5-member body established by the Personnel Code. It is an integral part of the State of Illinois system of personnel administration based on merit principles and scientific method. Its specific duties and powers are set forth in Section 10 of the Personnel Code. ( 20 ILCS 415/10 Generally, the Commission hears and determines employee appeals of discharges, suspensions, transfers, allocations, layoffs and demotions. It also approves exemptions from Jurisdiction B of the Personnel Code for those positions which, in the judgment of the Commission, involve either principal administrative responsibility for the determination of policy or the way in which policies are implemented. The Commission also approves or disapproves proposed additions or amendments to the Personnel Rules or position classification plan. The Commission has the authority to direct compliance in writing with the requirements of the Personnel Code or Rules when a violation is found. The Commission meets once a month, typically on the third Thursday, in either its Chicago or Springfield office. Commission meetings are open to the public.

Chapter 815 Sec. 380 Thursday, September 22, 2005 Chapter 815, Section 1 This Act shall be known and may be cited as the New Vehicle Buyer Protection Act. (Source: P.A. 85-1350.) Chapter 815, Section 2 Definitions. For the purposes of this Act, the following words have the meanings ascribed to them in this Section. (a) "Consumer" means an individual who purchases or leases for a period of at least one year a new vehicle from the seller for the purposes of transporting himself and others, as well as their personal property, for primarily personal, household or family purposes. (b) "Express warranty" has the same meaning, for the purposes of this Act, as it has for the purposes of the Uniform Commercial Code. (c) "New vehicle" means a passenger car, as defined in Section 1-157 of The Illinois Vehicle Code, a motor vehicle of the Second Division having a weight of under 8,000 pounds, as defined in Section 1-146 of that Code, and a recreational vehicle, except for a camping trailer or travel trailer that does not qualify under the definition of a used motor vehicle, as set forth in Section 1-216 of that Code. (d) "Nonconformity" refers to a new vehicle's failure to conform to all express warranties applicable to such vehicle, which failure substantially impairs the use, market value or safety of that vehicle.

New Vehicle Buyer Protection Act This Act shall be known and may be cited as the New Vehicle Buyer Protection Act. 815.380.2 Definitions. For the purposes of this Act, the following words have the meanings ascribed to them in this Section. (a) "Consumer" means an individual who purchases or leases for a period of at least one year a new vehicle from the seller for the purposes of transporting himself and others, as well as their personal property, for primarily personal, household or family purposes. (b) "Express warranty" has the same meaning, for the purposes of this Act, as it has for the purposes of the Uniform Commercial Code. (c) "New vehicle" means a passenger car, as defined in Section 1-157 of The Illinois Vehicle Code, a motor vehicle of the Second Division having a weight of under 8,000 pounds, as defined in Section 1-146 of that Code, and a recreational vehicle, except for a camping trailer or travel trailer that does not qualify under the definition of a used motor vehicle, as set forth in Section 1-216 of that Code. (d) "Nonconformity" refers to a new vehicle's failure to conform to all express warranties applicable to such vehicle, which failure substantially impairs the use, market value or safety of that vehicle.
