Click here to download it. The Individuals with Disabilities Education Act (IDEA), 20 U.S.C.  1400 et seq., provides federal funds to assist state and local agencies in educating disabled children. The IDEA conditions the receipt of such funds upon a state's compliance with certain goals and procedures. State legislatures and departments of education have enacted statutes and promulgated regulations respectively to ensure compliance with the IDEA requirements. While the federal IDEA statutes and regulations require schools to conduct functional behavioral assessments (FBAs), they provide little to no guideance on what an FBA is or how to conduct one. Therefore, states have begun to step into the void and pass laws and regulations that are more specific. Disability Rights - Attorney General's Select Committe on Special Education Approximately 287,500 students in Illinois receive special education services. The Attorney General Select Committee on Special Education addresses issues affecting students with disabilities. Members include people with disabilities, attorneys with expertise in special education law, special education directors and disability advocates. Some of the issues that have been addressed in recent years are briefly described below.
Due Process Hearings for Students with Disabilities.
(P.A. 89-652) The committee was instrumental in the drafting and passage of HB 2230 which substantially revised the system for conducting due process hearings in Illinois. Changes include the selection, training and assignment of hearing officers, one rather than a two level system of hearings, grounds for dismissing a hearing officer and a screening committee to monitor the system.

For Admission and Assessment of Student Tuition Effective Fall 1997 General The University of Illinois is a land-grant institution supported by funding from state of Illinois tax revenue. As a state tax-supported institution, the University (with some exceptions) extends preference in admission and tuition to residents of the state of Illinoisthat is, to persons whose circumstances conform to the University's definition of resident status stated below. Principal elements which determine residency are domicile in Illinois and actions which evidence the intent to make Illinois the permanent residence. A person has but one domicile at any time. Mere physical presence in Illinois, regardless of how prolonged, is insufficient to establish residency without action and intention to make the place a permanent residence and principal home. To establish bona fide residency in Illinois under this policy, a person must demonstrate presence and intent to reside permanently in Illinois for reasons other than educational objectives The burden of establishing that a person is domiciled in Illinois for other than educational purposes is upon the person. The regulations, factors, and procedures enumerated in this policy will be considered by the University in determining residency status.

To help advance local school improvement efforts in Illinois, U.S. Secretary of Education Richard W. Riley today announced he has awarded the state the authority to waive federal education rules and regulations that can hinder community efforts to improve teaching and learning. The authority comes under the Education Flexibility Partnership Demonstration Program (Ed-Flex). Under the Ed-Flex partnership, states can waive for their school districts and schools federal rules and regulations if a waiver would likely promote effective innovation and other school improvement efforts. Riley said this break with the old top down approach to government was made possible by the Goals 2000: Educate America Act, designed to promote and support state and community efforts to help students learn the basics and core subjects to high standards. "Ed Flex is a striking example of new partnerships the Clinton administration is forming with states and communities to invigorate schools, help raise academic standards and enhance student achievement," Riley said. "The state of Illinois has worked to improve schools by eliminating constraints that can stand in the way of better teaching and learning, and by holding all schools, districts and the entire state responsible for better student performance."

Illinois
Registration/Licensing/Accreditation: There is no general requirement in Illinois that non-public schools register with, be licensed by, or be accredited by the Illinois State Board of Education, although certain non-public school facilities need to be approved to serve public school special education students. However, non-public schools have the option of applying for registration and recognition on a voluntary basis. A school is registered when it has filed with the Board a "Nonpublic School Registration, Enrollment, and Staff Report" furnishing such evidence as required to assure compliance with federal and state laws regarding health examination and immunization, attendance, length of term, nondiscrimination, and applicable fire and health safety requirements. Minimum requirements for the recognition of nonpublic schools cover the organization, administration, instructional programs, instructional programs, extra-classroom activities, pupil services, school facilities, and personnel.
