Text of Opinion
Motion by defendant Riverdale Riding Corp. d/b/a Riverdale Equestrian Center, s/h/a Riverdale Riding Club, Inc. a/k/a Riverdale Riding Corp. d/b/a Riverdale Riding Club [Riverdale], for summary judgment is granted. This personal injury action on behalf of decedent, Lori Desena, arises out of an accident on or about November 4, 1995 at the Riverdale Equestrian Center located at Broadway and West 254th Street in the Bronx, New York. Decedent died of an unrelated asthma condition on December 8, 1999. Plaintiff's complaint alleges that decedent was injured when her horse reared and she was thrown to the ground. It is further alleged that decedent's horse reared because it was either bitten, attacked or frightened by another horse in the fenced-in area where the deceased was taking a riding lesson from one of defendant's instructors. Plaintiff's complaint goes on to allege that the accident occurred solely due to the negligence of defendant. Defendant moves for summary judgment based upon a five page written Release of Liability (Release), signed by decedent and dated October 28, 1995 as said Release clearly and unequivocally released and discharged defendant from all liabilities, including injuries and damages caused by defendant's own negligence. The Court notes that the lengthy Release specifically refers to the "passive or active negligence of the released parties" in three different numbered paragraphs.

Carrboro has one of the most extensive bikeway systems in the state. For a copy of "Carrboro Bikeways Map: A Guide for Commuting and Recreational Cyclists," visit the Carrboro Recreation & Parks Department (100 North Greensboro Street) during regular business hours, or call (919) 918-7364. The folder gives a brief history of Carrboro and describes its bicycle facilities, lanes, laws, safety tips and points of interest. One of North Carolina's nine designated State Bicycling Highways runs across the southern portion of Orange County. NC Bike Route 2 (also called the Mountains-to-Sea Bikeway) is the longest of the nine at 700 miles! It enters Orange County at its southwestern corner on the Old Greensboro Highway, follows Jones Ferry Road to NC Highway 54 East, then south on Smith Level Road, east on Culbreth Drive, across US Highway 15-501, south along Mount Carmel Church Road and across a northern section of Jordan Lake before heading east into Wake County and beyond.

Horseback Riding Tips
Horseback riding, once a traditional mode of travel through backcountry terrain, has now become a recreational pastime for many people. Any group of 75 or more need to apply for and receive in advance a group use permit. The permit is free to non-commercial groups. The permit system helps the Forest determine recreation use and locate groups in case of a fire emergency. All groups must provide their own toilet facilities. Groups less than 75 should contact the District office and give the following information:
  • Name of the group Area in which the group intends to ride Number of people and horses in the group Inquire as to special conditions of the intended riding area.
Local outfitters are available for groups that might desire special services for extended rides, or overnight camping and cookouts. To encourage the implementation of proper horse handling, some horse use etiquette tips are included as follows:
  • Riding on trails and not short cutting will reduce erosion problems and unwanted paralleling of trails.

1.4.1 Historical Perspective
An was the case in the settlement of all new lands, trails played an important role in Humboldt County history. To the local Indian tribes indigenous to the northcoast as well as early pioneers such as Jedediah Smith, the trail served as the main route of travel. With the passing of time, many of these early transit routes evolved into wagon roads and further to the roadways with which we are familiar today. Interest pertaining to trails for recreation rather than transportation increased when the idea of establishing a statewide horeseback riding and hiking trail route was advanced by the California State Horseman's Association. Soon after passage in 1945 of the California Riding and Hiking Trails Act, a trail coordinating committee was formed in Humboldt County to determine a feasible route for that portion of the State Riding and Hiking Trail which was proposed through the area (Ref. map ). In the years following the committee's formation, a trail route was designated which made use of old roads and government trails. Shortly thereafter, the first Humboldt County Trails Plan was prepared and later adopted by the Board of Supervisors by Resolution #744 dated December 1953.

PAUL, Minn.Secretary of the Interior Gale A. Norton used National Trails Day (June 5) to launch the "America's Public Lands Get Fit with US" initiative. Norton also announced the designation of 27 new recreation trails in 15 states, as part of the National Recreation Trails System. "Our efforts to promote trails for health and recreation are part of a larger partnership initiated by President Bush," Norton said. "These partnerships are using the vast interconnected outdoor recreation network of federal, state and local lands and waters as a resource that can help provide inexpensive, enjoyable exercise for all Americans. The Get Fit with US initiative is a direct result of President George W. Bush's Executive Order, which was issued for the purpose of improving the health of all Americans. It is designed to promote a healthy lifestyle alliance between public health and recreation. The theme for this year's National Trails Day is "Trails and Health-A Natural Connection." Norton noted that the Interior Department manage public lands and water activities around the country that provide scenic vistas and breathtaking landscapes that attract nearly a half billion visitors per year.

The county sponsors 30 miles of ATV trail and routes. Parking is available in the city of Augusta and there is also a lot located on CTH G at Channey Road. There is also a parking lot on the southwest side of the village of Fairchild. Clark County trails are linked with this network of Eau Claire County ATV trails and routes. Boat Landings
The county maintains 7 boat landings on county land for access to area lakes. These include one at Lake Altoona county park, one on the Eau Claire river just upstream of Lake Altoona, two at Coon Fork lake (one on the dayside and one on the campground side of the lake), and three on Lake Eau Claire. Daily/annual vehicle entrance passes are required.

With dense stands of pine along its banks, with great opportunities for fishing and abundant wildlife, the Eau Claire River has a wilderness atmosphere as it flows through an almost uninhabited portion of the Eau Claire County Forest. In times of high water, its rapids give a challenge to even the most experienced canoeists. In summer months, periods of low water make it necessary to "walk" canoes through some rapids which may become too shallow for navigation. During these periods of low water canoeists may want to check water levels in advance to see if there is enough water in the river for good canoeing.

STATE FOREST RECREATION The South Carolina Forestry Commission currently manages the state's 4 state forests: Sand Hills, Manchester, Harbison, and Wee Tee . These forests provide a wide variety of benefits for everyone. No permits are required for recreation activities on Wee Tee State Forest at this time. Parking passes are required at Harbison State Forest in Columbia. These passes can be obtained at fee boxes located in each parking area on the Forest. Parking pass fee is included in bike permits, so no additional fee is required of those who purchase a daily or annual bike permit. Permits
Parking Passes (Harbison only): Daily - $2.00 Annual - $25.00.
Permits are valid on any of the three State Forests for allowed activities. All hunting and fishing is regulated under the Department of Natural Resources Wildlife Management Area Program. Regulations, bag limits, and seasons are available by contacting the SC Department of Natural Resources (opens in a new window) at 803-734-3886.
