United Nations, New York Catholics for a Free Choice and women’s and human rights groups from around the globe are calling for a review of the Holy See’s Non-Member State Permanent Observer status at the United Nations. From opposing the use of condoms to halt the spread of AIDS to decrying the provision of emergency contraception for refugee victims of rape, the Holy See misuses its special status to erect real obstacles to the promotion of women’s health and well-being, despite the contention of resolutions recently introduced in the US Congress. The resolutions, introduced by several anti-choice members of Congress—Sens. Rick Santorum (R-PA) and Bob Smith (R-NH) and Rep. Chris Smith (R-NJ)—oppose any effort to review the status of the Holy See at the UN and laud the role played by the Holy See in the UN. “While the Roman Catholic church has made many positive contributions to peace and justice at the UN, neither these contributions nor the negative stands the Holy See has taken on women’s rights and reproductive health are the heart of the matter. The heart of the matter is the fact that the Holy See is not a state, but the government of the Roman Catholic church. To grant state status and special privileges to this religion over all others is simply unfair. The ‘See Change’ Campaign seeks a level playing field in the UN for all religions,” said Frances Kissling, president of Catholics for a Free Choice.

WHAT STATUS DOES THE CATHOLIC CHURCH HAVE AT THE UN?
The Holy See is a Non-member State Permanent Observer at the United Nations. This rarely-used designation gives it some of the privileges of a state, such as being able to speak and vote at UN conferences. No other religion is granted this elevated status. Other religions participate in the UN like most other non-state entitiesas nongovernmental organizations. Because UN conferences operate on consensus, the ability to disagree with the majority consensus has significant power. The Holy See was not invited to participate in the UN. The Holy See initiated requests to be recognized as a state in international bodies. No vote was ever taken on the Holy See's presence at the UN by the General Assembly.

If the United Nations treats the Holy See as a state because of its history as the ruler of European territories, the United Nations is deviating from its stated policies. If the United Nations treats the Holy See as a state with permanent observer privileges because of the Roman Catholic's religious authority, the United Nations is creating a precedent for similar claims by other religions. To ensure that the United Nations does not promote one particular religion, religious entities such as the Roman Catholic Church should not be permitted to participate in this forum as a non-member state. Fundamental to this "non-member state" status is the Holy See's claim to statehood. This claim is highly disputable. First, the Holy See's position as part of the government of the Catholic Church makes it a non-territorial entity. The Holy See is the supreme organ of government of the Catholic Church, with the Pope designated as its head in the Code of Cannon Law. The Holy See consists of the Pope, the College of Cardinals and the central departments that govern the Church. It is, by definition, a non-territorial religious entity.

I am sure that this refers to the pope and the Vatican. Am I right? Could you please explain the term? The term Holy See comes from the Latin Sancta Sedes , meaning "Holy Chair," and originates from the enthronement ceremony of the Bishop of Rome, the pope. Strictly speaking, the cathedra , i.e. the chair or throne, represents the position and authority of the Holy Father or a bishop, and the place where he resides in the territory of his jurisdiction. Here the Holy See refers to the "seat of government" of the universal Church. Geographically, this seat of government is located in the Diocese of Rome.     It seems unlikely that the three former British Ambassadors to the Vatican who wrote to The Times complaining about the downgrading of that ambassadorship were entirely wrong. The three, Mark Pellew, Andrew Palmer and John Broadley, said the Vatican was a “first-class listening post” in which all the other G8 countries had resident diplomats. It was “cheese-paring in the extreme” to relocate the British Embassy to the Holy See in the same compound as the British Embassy to the Italian Government just to save money, they said, and it gave the impression that the Government no longer thought British representation to the Holy See was important. The British Embassy to Italy is also being relocated in the new compound, and concerns about security – presumably against car bombings – offer one explanation. The Foreign Office has denied that any downgrading was intended. Unusually, it has advertised to fill the vacancy that will arise when the present ambassador to the Holy See, Kathryn Colvin, leaves her post in October. The possibility of someone without previous diplomatic experience being appointed prompts the three former ambassadors to plead for the appointment of a “properly supported professional diplomat of sufficient standing to make his or her voice heard in Whitehall”. They point out that the Vatican’s international agenda coincides with what Britain has been trying to do at the G8, particularly on debt relief and African aid and development.

    The Roman Catholic Church is uniquely positioned to influence international deliberation on a wide range of issues, including population, family planning, and women's rights. Since the inception of the United Nations, the Roman Catholic Church has been an active participant in numerous international conferences organized by this powerful organization. Recently the Church has been involved in the 1992 United Nations Conference on Environment and Development, the 1993 Vienna Conference on Human Rights, and the preparatory process of the 1994 International Conference on Population and Development. In some of these conferences, the Church has taken high profile positions that have sparked worldwide attention and raised questions regarding its status at the United Nations. It is my honour to convey to all present the cordial greetings of the new Pope, Benedict XVI, who in the choice of his name intended to recall one of the great architects of European civilization. In some of his previous talks and publications he has proposed a number of considerations, both historical and doctrinal, on the subject of European unity and values, which remain relevant and worthy of attention. 2. This theme, to which the present session is dedicated, is something particularly important for the Holy See. Pius XII in his Christmas message of 1944 proposed to Europe a "true democracy founded on freedom and equality" ( Acta Apostolicae Sedis 37 [1945] 14), and on 9 May 1945 he spoke of "a new Europe ... founded on respect for human dignity, for the sacred principle of equality of rights for all Peoples, all States, large or small, weak or strong" ( ibid , 129-130). Pope Paul VI (the sixth) dedicated keen and increasing attention to the same subject. And all are aware of the incessant, passionate and active commitment of Pope John Paul II (the second) to a Europe corresponding more fully to its geographical and especially to its historical identity. Here in his Polish home-land, I am particularly pleased to recall his great and lovable personality.

The cordiality of today's meeting also reflects the good relations that exist between your Country and the Holy See. I note with pleasure that the new Government of the Republic has expressed its intention to continue to build on these relations, maintaining its autonomy, carrying out its own different tasks and rigorously observing the respective provinces of each one. The Church and the public Authorities have converging goals: to foster the integral good of each person and the common good of society. I note the Government's concern to eliminate the poverty in which part of the population still lives by establishing the most favourable conditions for creating employment and measures in order to confront the scourge of corruption.
