GOVERNMENT AND INSTITUTIONS
The Pope exercises supreme legislative, executive, and judicial power over the Holy See and the State of the Vatican City. Pope John Paul II, born in Poland, is the first non-Italian Pope in nearly five centuries. Elected on October 16, 1978, he succeeded John Paul I, whose reign was limited by his untimely death to only 34 days.
The term 'Holy See' refers to the composite of the authority, jurisdiction, and sovereignty vested in the Pope and his advisers to direct the worldwide Roman Catholic Church. As the 'central government' of the Roman Catholic Church, the Holy See has a legal personality that allows it to enter into treaties as the juridical equal of a state and to send and receive diplomatic representatives. The Holy See has formal diplomatic relations with 174 nations, including the United States and many predominantly Muslim countries. The Holy See also maintains relations of a special nature with the Russian Federation and the Organization for the Liberation of Palestine.
Created in 1929 to provide a territorial identity for the Holy See in Rome, the State of the Vatican City is a recognized national territory under international law. The Holy See, however, enters into international agreements and receives and sends diplomatic representatives.

When the U.S. Senate approved the appointment of William A. Wilson as the U.S. ambassador to the Holy See at the end of 1983, most people expected the debate over diplomatic relations with the Vatican to fade away. Not so. The fight has merely moved from the executive and legislative branches of government to the judiciary. Americans United for Separation of Church and State, the American Baptist Churches in the U.S.A., the National Association of Evangelicals, the National Association of [Catholic] Laity and a number of other organizations filed suit in the Federal District Court of Philadelphia alleging that diplomatic relations with the Holy See violates the establishment clause of the First Amendment and the liberty and equal protection clauses of the Fifth Amendment. The Justice Department summarizes the plaintiffs' complaints that the appointment of an ambassador to the Holy See "creates a formal official relationship between the United States" and a church; "prefers one religious denomination over all others;" "creates a special benefit for one religious organization and a corresponding detriment for all others;" "provides the potential for excessive governmental entanglement between church and state," and "results in political and religious divisiveness." The plaintiffs also argue that the Holy See is not a state but a church and that the Fifth Amendment prohibits "the creation of any permanent church-state linkage."

    Shanghai ( AsiaNews ) – Mgr Giuseppe Xing Wenzhi, 42 years, was today ordained auxiliary bishop of Shanghai. The prelate said publicly that he received the nomination of the Holy See. In future, he will able to take the place of Mgr Aloysius Jin Luxian, who is now nearly 90 and very ill. Mgr Xing studied in the United States and until today, he was vicar-general of the diocese. With this move, the Chinese government hopes to find a way of healing the rift between the underground – unofficial – Church and the official Church, which is recognised and registered by the government.

    Delegation From Communist Government Visits Rome VATICAN CITY, JULY 3, 2005 ( Zenit.org ).- The Holy See and Vietnam may be close to establishing full diplomatic relations, the Vatican says.
    A Vatican note published Saturday revealed that a delegation of the Vietnamese government's Religious Affairs Commission visited Rome from June 27 to July 2. The delegation also included representatives of the foreign ministry.
    "The working session in the Secretariat of State, directed in a climate of cordial respect and fruitful dialogue by the undersecretary for relations with states, Monsignor Pietro Parolin, concentrated, as usual, on some aspects of the life of the Catholic Church in Vietnam, reflecting on evolutions noted since the last meeting and problems that continue" unresolved, disclosed the Holy See.

I just saw in the news a short coverage of an Vatican meeting where the Pope came by car that was addorned with two flags that were sometimes reported as Pope's personal flag. There were of the same design as the state flag of Vatican, but the Vatican Coat of Arms being replaced with the papal personal Coat of Arms (blue, golden cross and letter M) of Pope John Paul II.
Even if these flags are somtimes (rather often?) seen in various occasions, I think that this is first time I have seen them used by the Pope himself or the Vatican government - otherwise these flags were always seen (more or less) as ornamentation hoisted by Catholics in various occasions. The two flags on the car were rather in the triangualr pennant form, with the white fields therefore being considerably larger then the yellow field, so that it could contain the CoA confortably.
, 21 May 2001 The square, yellow-white "flag" with John Paul's arms which appears on the is more difficult for me to address. I left Rome in 1994 and have never seen it. I assume that you have seen it used as a "car flag," which is not out of the question. Again, I doubt there are legal directives in its regard. I am confident, however, that it would never be displayed from any Vatican buildings as a full-size flag in any official capacity.

    States of the Church
    (Ital. Lo Stato della Chiese Consists of the civil territory which for over 1000 years (754-1870) acknowledged the pope as temporal ruler. The expression "Patrimonium Sancti Petri" originally designated the landed possessions and revenues of various kinds that belonged to the Church of St. Peter at Rome. Until the middle of the eighth century this consisted wholly of private property, but the term was later applied to the States of the Church, and more particularly to the Duchy of Rome. Our subject may thus be conveniently treated under the following heads: I. Patrimony of St. Peter (tracing the origin of the States of the Church to the time of Charlemagne ); II. History of the States of the Church.
