Law has been a tool of public health practice from earliest times. Public health laws have been documented in American practice as early as the colonial period. Criminal laws regulating sexual activity include HIV-specific exposure/transmission provisions sexually transmitted disease statutes sodomy laws , prostitution laws, and older rarely enforced prohibitions against adultery and fornication. These laws, together with their enforcement records, comprise the legal climate in which some specific sexual activities of consenting adults may be prosecuted in virtually every state in the United States. The historical record illustrates continuing tensions in the regulation of sexually transmitted diseases. Because of the role of sex in transmission, activism and legislation has often been driven as much by moral as public health goals. Likewise, the desire to affect behavior was often matched by a desire on the part of some proponents of legislation to "send a message" about the immorality of certain sexual behavior. In many instances, the imperatives of sending the "right" moral message limited the ability of public health agencies to deliver preventive services. Criminal laws regulating unsafe sex are intended to influence individual behavior, or at least are to some degree based on the assumption that passage of such laws will reduce unsafe sex. Whether this assumption is correct is an important public health question, whose importance is not confined to HIV. Substantial amounts of law intend or assume the ability to influence sexual behavior that puts people at risk of HIV. At the same time, researchers have expended significant resources on studies of HIV-related sexual risk behavior, but almost none of it addresses the possible influence of law. This project will provide empirical evidence and methodological tools to bridge the gap between adopted laws and evidence of behavior change.

The Indiana University School of Law - Indianapolis recently established a new specialty law review focused on health care law and policy: the Indiana Health Law Review . Now in its third full year of publication, the journal is continuing to provide informative articles on important health law topics that academic professionals and practitioners encounter. The Law Review complements the school’s existing health law program, which is consistently recognized as one of the top ten programs in the nation. It benefits from the expertise of the Williams S. and Christine S. Hall Center for Law and Health, co-directed by Professors Eleanor Kinney and David Orentlicher, as well as our faculty advisors, Professors Lawrence Wilkins and Robert Katz. The scope of the Indiana Health Law Review includes bioethics, malpractice liability, managed care, anti-trust, health care organizations, medical-legal research, legal medicine, food and drug, and other current health-related topics.
