Excerpts from a cover letter accompanying the Health Law Standards Of Care: These new Standards of care were developed and adopted by consensus after a two year period by the Health Law Project of the International Conference on Transgender Law and Employment Policy. The Health Law Project's membership includes professionals in the fields of law, health care policy, and gender science, most of whom are transgendered themselves. The Health Law Standards of Care were developed in the wake of widespread dissatisfaction by many in the transgender community with the Harry Benjamin Standards of Care. Also relevant is the pending de-listing of transsexualism per se as a mental disorder from the DSM-IV. Many, if not most, of the patients doctors see for gender medical services (hormones; surgery) do not require any psychological services.

Model State Public Health Act
The Turning Point National Collaborative on Public Health Statute Modernization
seeks to transform and strengthen the legal framework for public health through a collaborative process to develop a model state public health law to better protect and promote the public's health. Funded by the Robert Wood Johnson Foundation as part of its Turning Point Initiative , the Collaborative is a multi-disciplinary group comprised of representatives from five states (lead state, Alaska, and Colorado, Nebraska, Oregon, Wisconsin), nine national organizations and government agencies, and experts in specialty areas of public health. Released on September 16, 2003 after three years of development and a national commentary period, the Turning Point Model State Public Health Act is designed to serve as a tool for state, local, and tribal governments to use to revise or update public health statutes and administrative regulations.

What is the HLI? The Health Law Institute was founded in 1977 by Madam Justice Ellen Picard (Alberta Court of Appeal) who was a Professor in the Faculty of Law, University of Alberta with a passionate interest in health law. The Institute began as a resource centre.
Over the past 10 years, it has developed into an international centre for health law providing public legal education and undertaking research on current issues.
As a non-profit organization, the Health Law Institute acknowledges the generous support of the Alberta Law Foundation . The HLI also receives support from the Faculty of Law, University of Alberta and the Alberta Heritage Foundation for Medical Research

health law: an overview
Improvements in technology and medical care have increased life expectancy by a considerable amount. Alongside these improvements, health care costs have risen dramatically. Because the health of the people in a nation reflects the health of the nation itself, health care law is vital for the stability of the Unites States. Preserving public health is a primary duty of the state. Health regulations and laws are therefore almost all state based. Many states delegate authority tosubordinate govermental agencies such as boards of health. These boards are created by legislative acts. Federal health law focuses on the activity of the Department of Health and Human Services (HHS). It administers a wide variety of agencies and programs, like providing financial assistance to needy individuals; conducting medical and scientific research; providing health care and advocacy services; and enforcing laws and regulations related to human services. An important part of the HHS are the Centers for Medicare and Medicaid Services , which oversee the Medicare and Medicaid Programs. Their goal is to ensure that elderly and needy individuals receive proper medical care.

workplace safety: an overview
Workplace safety and health laws establish regulations designed to eliminate personal injuries and illnesses from occurring in the workplace. The laws consist primarily of federal and state statutes. Federal laws and regulations preempt state ones where they overlap or contradict one another. The main statute protecting the health and safety of workers in the workplace is the Occupational and Safety Health Act (OSHA). Congress enacted this legislation under its Constitutional grant of authority to regulate interstate commerce. OSHA requires the Secretary of Labor to promulgate regulations and safety and health standards to protect employees and their families. Every private employer who engages in interstate commerce is subject to the regulations promulgated under OSHA. Under OSHA states are not allowed, without permission of the Secretary of Labor, to promulgate any laws that regulate an area directly covered by OSHA regulations. They may, however, regulate in areas not governed by federal OSHA regulations. If they wish to regulate areas covered by OSHA regulations they must submit a plan for federal approval. The amount of state regulation varies greatly. California is an example of a state that has chosen to adopt many of its own regulations in place of those promulgated under OSHA.
