He won the Presidency by one vote in the Electoral College. Some people accused Hayes of ‘stealing’ the election. But he turned out to be so honest and hardworking that both his own party and the Democrats respected him. Because of the close election, Hayes promised not to run for a second term. Rutherford married Lucy Webb in 1852 and they had eight children. The Hayses were very religious. Rutherford Birchard Hayes (1822-1893) was elected president by a margin of only one electoral vote. His victory over Samuel J. Tilden in 1876 climaxed one of the most disputed presidential elections in United States history. Congress had to create a special Electoral Commission to decide the winner.
Hayes was a studious, good-natured man who enjoyed books more than politics. Ohio Republicans nominated him for Congress while he was fighting in the Civil War. Hayes refused to campaign. He declared that any officer who "would abandon his post to electioneer for a seat in Congress, ought to be scalped." Hayes won the election. He later served three terms as governor of Ohio.
His presidency
When Hayes became president, the nation was suffering from a business depression and the political scandals of the previous Administration of Ulysses S. Grant. The unsolved problem of Reconstruction in the South still divided the American people, even though the Civil War had ended 12 years before. Hayes was not popular at first. Democrats charged he had "stolen" the election. His fellow Republicans were bitter because he refused to give special favors to party politicians.

    RUTHERFORD B. HAYES
    Rutherford B. Hayes In one of the most bitterly contested elections in U.S. history, Hayes won the Presidency by only one electoral vote. Despite this onus and strong opposition in his own party, he carried out a program of moderate reform, particularly in the civil service. In terminating the role Federal troops had played in governing the South, he virtually ended Reconstruction and dampened the lingering hostility between the North and South. Before rising to the Presidency, he had served as a general in the Civil War, U.S. Representative, and Governor of Ohio. Throughout his life, but especially in retirement, he devoted himself to humanitarian causes. Hayes, the youngest of five children, was born at Delaware, Ohio, in 1822. His father, a storekeeper and farmer, died before his birth. An uncle, Sardis Birchard, served as his guardian. After attending local schools, Hayes studied at academies in Norwalk, Ohio, and Middletown, Conn., and in 1842 graduated from Kenyon College, Ohio. He read law for a year at Columbus, and in 1845 completed Harvard Law School. He then took up practice at Lower Sandusky (present Fremont), Ohio. In 1849 Hayes moved to Cincinnati. There, he gained attention as a criminal lawyer as well as a defender of fugitive slaves, and became active in the Whig Party. In 1852 he married Lucy Ware Webb, who would be the first wife of a President to be a college graduate. They were to have seven sons and a daughter.

    On October 4, 1822, Rutherford Birchard Hayes was born in Delaware, Ohio. A Harvard Law School graduate, Hayes entered politics after a successful law career in Cincinnati and military service in the Civil War. He served as a Republican representative in Congress from 1865 to 1867 and was later elected governor of Ohio. Rutherford B. Hayes became the 19th U.S. president in 1877 after a bitterly-contested election against Democrat Samuel J. Tilden of New York. Tilden won the popular vote, but disputed electoral ballots from four states prompted Congress to create a special electoral commission to decide the election's result. The fifteen-man commission of congressmen and Supreme Court justices, eight of whom were Republicans, voted along party lines deciding the election in Hayes's favor. The electoral dispute has come to be known as the Tilden-Hayes Affair. Because of the tension surrounding this partisan decision, Hayes secretly took the oath of office in the White House Red Room . He was the first president to be sworn in at the residence.
