Registration/Licensing/Accreditation: The Hawaii Council of Private Schools (performs the functions and assumes the responsibilities of the Hawaii Department of Education (HDOE) for the licensing of private schools in Hawaii. General Legislative Provisions
This first part of the review examines statutory provisions that have implications for, but do not necessarily address directly, students with disabilities or special education. Various provisions in state statutes grant charter schools varying levels of authority to govern themselves and to make decisions regarding the operation of the schools, including decisions related to personnel, curriculum, and expenditures. The extent of a charter school's operational autonomy will have an impact on how special education programs are implemented in these schools. As described in the following paragraphs, statutory provisions that give higher levels of autonomy include ones that allow or require charter schools to (1) operate independent from local school districts, (2) make their own personnel decisions, (3) be exempt from state and district education laws and regulations, (4) assume liability for their actions, and (5) receive their funding directly from the state. (a) The parent shall provide the local public school principal with a notice of intent to home educate the child before initiating home schooling, The purpose of notification is to allow the department, upon request of the parent, to assist in the educational efforts. The notice of intent may be submitted on a department developed form (Form OIS-4140) or in a letter containing the following items:
(1) Name, address, and telephone number of the child;
(2) Birthdate and grade level of the child; and (3) Signature of the parent. (b) The notice of intent shall be acknowledged by the principal and the district superintendent. The notice of intent is for recordkeeping purposes and to protect families from unfounded accusations of educational neglect or truancy. (c) If a child's annual progress report has been submitted as stated in S8-12-18(b), notification of intent to home school need not be resubmitted annually, except in cases where the child is transferring from one local public school to another, for example, transition from sixth grade to an intermediate school. Then the parents shall notify the principal of the child's new local public school.

    Charter schools offer
    empowering option
    HAWAII'S teachers and students work hard, but their efforts are hampered by an educational system that has been unchanged by the Legislature. While state government has devoted considerable money to education, earmarking $1.09 billion for lower education in 1999, public schools continue to suffer from unequal teaching and testing methods, dilapidated facilities, out-of-date textbooks and burgeoning class sizes. As recently reported in Education Week magazine, Hawaii educational standards slid from a "B" in 1997 and a "C" last year to an alarming "D-" for 1999. School climates were given an "F" for both 1998 and 1999; efforts to improve teacher quality are on an upward trend yet only merited a "C" rating against national standards. While Hawaii is not alone in its educational challenges, we must do better. Charter or student-centered schools afford flexibility to public schools to address student-specific needs. Charter schools also offer more choices to parents and the opportunity for teachers to have the autonomy needed to implement innovative ideas. Charter schools have the freedom and flexibility to supplement their curriculum and shape their academic program in ways not readily possible for traditional public schools.
