    Search: News Indian Gaming In The Hoop Home News Headlines printer friendly version Judge dismisses $25B BIA boarding school suit Monday, November 8, 2004 A federal judge has dismissed a $25 billion lawsuit alleging sexual, physical and mental abuse at boarding schools formerly overseen the Bureau of Indian Affairs. A group of former boarding school students filed the case earlier this year in the U.S. Court of Claims. They said the federal government violated the 1868 Treaty of Fort Laramie by allowing "Bad Men" to come onto the reservation and abuse them. But in a 19-page decision, Judge Diane Gilbert Sypolt said the plaintiffs didn't follow an arcane procedure set out in the treaties regarding the "Bad Men." The former students should have first asked the BIA to hear and adjudicate the case before coming to the courts, she wrote. "Having failed to bring their claims administratively, plaintiffs are barred from seeking relief from this court," she wrote in the unpublished October 29 opinion that granted the Department of Justice's motion to dismiss. Sypolt also said the former students could not rely on the treaties to establish a trust relationship that gives rise to money damages if breached. She said the "physical, sexual, and physiological abuse claimed by the plaintiffs in this case, even if true" is beyond the limited authority of the claims court.

    Moon pitches Kona school
    A nonprofit foundation headed by the Rev. Sun Myung Moon is proposing to build a private high school in Kona.

    By Hunter Bishop
    Directors of the Pacific Rim Education Foundation announced plans last week to establish the "High School of the Pacific" on a 32 - acre site makai of Mamalahoa Highway, adjacent to the Kona Ocean View Properties subdivision in Pu'ukala. The proposed boarding school would house up to 200 students from Pacific island nations and Hawaii in a "shared - living experience," said Joe A. Tully, president of the foundation. Tully said the school was initiated by Moon after talks with Pacific island leaders, who identified secondary education as one of their countries' most pressing long - term needs. "This unique high school is being built primarily for students from Pacific island nations that are too small to have adequate education systems of their own," Tully said. A good education will enable the students and their nations "participate in the global advances in knowledge and technology," he said. "In addition, we believe that a common educational experience and the lifelong, cross - cultural friendships developed at this school can contribute to greater understanding and cooperation in the Pacific region," Tully said.

    Mid-Pacific Institute WHEN MOST people hear that a student attends Mid-Pacific Institute, the renowned School of the Arts comes to mind. For those unfamiliar with MPI School of the Arts, it is best described as a school within a school, where students may train in the performance arts (dance and theater), visual arts, media or instrumental music. A certificate program is offered to those who wish to excel in any of these programs, but noncertificate students may take a selected course as an elective during the school year. MPSA faculty members are professionals who are talented and active in the community in their art forms. In two years, however, there will be more to talk about than the School of the Arts.

Linda Lingle has recently repeated her call to break up Hawai'i's enormous, single public school district into smaller units. Hawai'i could dramatically improve its public school system by supporting the governor in her attempt to end Hawai'i's reign as the only state that does not provide its citizens with a choice in the public school system their children must attend. Multiple school districts would go a long way toward improving education by offering parents a choice in the public education provided to their children where currently they have none. Instituting multiple school districts would also provide schools with the proper incentives to compete for students by offering a quality education.

    Life in Hawaii, by Titus Coan
    Chapter XVI. Previous Chapter Next Chapter Notes on the Stations—Hawaii—Governor Kaukini— Maui—Crater of Hale-a-ka-la—Molokai—The Leper Settlement—Oahu—Kauai—The State of the Church. A FEW notes on other parts of the Hawaiian Islands may not be irrelevant in this narrative. The great awakening of which I have written so fully was felt in a greater or less degree over all the islands of the group, and the ingatherings into all the churches, from the beginning to the present day, have been more than 70,000. My visits to the different islands and stations, my fraternal communion with the faithful laborers, and the cordial interest I have found among many thousands of Hawaiians in the things pertaining to the kingdom of God, have been "as the dew of Hermon, and as the dew that descended upon the mountains of Zion" to my soul. On the north of Hawaii I have met my earnest brother Lyons, full of poetic fire; have passed several times through Hamakua, once a populous district of his field, and have seen the gathering thousands in their places of worship. I have visited at his cool and elevated station in Waimea, surrounded like Jerusalem by mountains, having Mauna Kea on the east, Mauna Loa on the south-east, Hualalai on the south, and the mountains of Kohala on the north, and all these towering heights in full view. In the midst of this amphitheater of hills stood his great stone church, where 1,000 or 2,000 natives would assemble on special occasions to hear the Gospel, to worship the Lord, and to unite in happy festivals.

    Alumni in Georgia Live Lives of Meaning and Impact; Give Credit to Academy Relationships and Atmosphere
    By Walter Grubb, President Fall 2001 Volume 122 No. 01 One of the pleasures of my job is being able to travel a bit and meet some truly wonderful people. There are academy alumni in almost every state of the U.S. If my schedule would permit, l could be on the road every week, visiting with people and sharing current academy news with them as they share their academy stories with me. If there are any alumni who do not have some great stories about their academy days, I haven't met them yet. Every one I have met loves the school and is grateful for the experiences the academy offered.
    On a very enjoyable and memorable recent trip to the Atlanta, Georgia, area, I talked with four very different graduates. Their school days span the 1930's, 1940's and 1950's. Although their stories were different, their love for the school and the relationships they spoke of reflect a consistent theme.
    These delightful people received me graciously. l enjoyed meeting them and talking about their lives, especially their academy days. I am happy to share some of their stories with you.

Eight of the islands are inhabited, viz., Kauai, Niihau, Oahu, Molokai, Lanai, Maui, Kahoolawe, and Hawaii. Their population (1910) was 191,909. The first Catholic priests arrived at Honolulu on 9 July, 1827. They were the Rev. Alexis Bachelot, prefect Apostolic, the Rev. Abraham Armand, and the Rev. Patrick Short. The first two were natives of France, and the third of Ireland. All three were members of the Congregation of the Sacred Hearts of Jesus and Mary, called also the Society of Picpus, from the name of the street in Paris in which its mother-house is situated. They had been sent by Pope Leo XII Protestant missionaries had arrived from New England as early as 1820, and had gained the king and chiefs over to their cause. As soon as the priests began to make converts a fierce persecution was raised against the natives who became Catholics. They were ill-treated, imprisoned, tortured, and forced to go to the

    * Be complex and perceptive thinkers.
    * Be effective communicators.
    * Be culturally-aware individuals.
    * Be responsible individuals.
    * Be wholesome young men and women. Founded in 1949, HPA is an independent, coeducational school providing a full range of opportunities for students from kindergarten through grade 12. One unique aspect of HPA is its courses and activities that make use of Hawaii's geographical and social setting and give students a strong sense of Hawaii and its culture. Offerings also include programs in the visual and performing arts as well as an Upper School interscholastic athletic program that stresses school-wide participation and teaches the values of sportsmanship and fair play. The school has two campuses in the town of Waimea (Kamuela) on the Big Island of Hawaii. The Lower and Middle Schools are located on six acres in the heart of Hawaii's ranching country, while the Upper School is located just two miles away at the foot of the Kohala Mountains.

    I am only just waking up from the violence and spiritual/ physical and sexual oppression that can only be brought clarity/understood or invoked by combining in ones head what is going on now at Abu Grabe Prison in Iraq and the first five minutes of the movie “Rabbit Proof Fence”; showing the removal of part White part Aboriginal children from their parents in Australia in an attempt to educate them and selectively breed them back into the white population (the film shows their first days in boarding school not far from my first days at Dorset House).
    I witnessed violent abuse and beatings on my body and on the body of others, homosexual and sexual acts performed on me by staff and other boys, racism public humiliation and spiritual degradation and mental torture in both these schools.
