    In a Memorandum sent to the Guatemalan government one year on since President Oscar Berger took office, Amnesty International (AI) presents a series of recommendations aimed at tackling human rights violations against women and human rights defenders. The Memorandum also includes recommendations to end abuses committed in the context of agrarian disputes and in regard to the potential impact of free trade policies on human rights.
    During 2005, human rights defenders continued to be at risk of attack. AI received reports that between 1 January and 25 February 2005, 26 human rights defenders were victims of abuses including attacks and death threats. AI is also concerned at reports of killings by members of security forces in the context of demonstrations organized to protest against mining and the recently ratified free trade agreement.

    Mining Guatemala: Government, church leaders consider moratorium on gold pit
    Posted April 1, 2005 Ramazzini said the church seeks a permanent ban on all open pit metallic mining and cyanide-leaching techniques, and stricter standards for evaluating environmental impact.
    Open pit mining and cyanide use for leaching minerals from rock have brought increasingly harsh criticism from environmental and social activists around the world. Contamination of water sources from open pit mines and chemical spills have damaged ecological and human health in areas of Indonesia, Peru, the United States, and other countries. Critics also said mining should provide greater economic benefits for local people and the country. Currently, mining companies operating in Guatemala pay 1 percent in royalties, half of which goes to the municipality where the mine is located, and half to the central government.
    The cash-strapped Guatemalan government will receive around $60 million in taxes and royalties from the mine, according to Baumann.

    The Inter-American Court on Human Rights found the Guatemalan state and military responsible for the disappearance, torture and execution of Efraín Bámaca, a.k.a. "Commandant Evarardo," a guerrilla leader from the Guatemalan National Revolutionary Unity (URNG) who disappeared in 1992. Click here to receive a FREE copy of the current issue Or subscribe to the Report with our Subscription Form Bámaca's case became a key human rights test for the Guatemalan government, and the United States, in large part because of the persistent efforts of his wife, US lawyer Jennifer Harbury, to uncover the truth about his fate. Bámaca disappeared on March 12, 1992, after being captured alive by Guatemalan armed forces. He was held on various military bases following his capture where he was apparently savagely tortured and interrogated, then finally executed one to two years later. Some of Bámaca's family members believe he was put into a plaster body cast to prevent him from escaping, and then was later thrown from a helicopter.

    against peaceful protestors of hydroelectric project On Sept. 23, the Guatemalan government formally brought charges against the leaders of the Coordination of Communities Affected by the Chixoy Dam. This took place days after the government agreed in writing with this very group to negotiate compensation and reparations owed to communities affected by the dam/hydroelectric project (1975-1985) which was supervised by the World Bank and the Inter-American Development Bank. The government formally accused massacre survivors and displaced people with terrorism for their occupation of the Chixoy Dam installations on Sept. 7, 2004, where they peacefully protested and demanded compensation for land, homes, property and livelihood destroyed, stolen and lost as a result of the dam project. The action of the Guatemalan government endangers not only the possibility of a negotiated settlement in spite of having signed on Sept. 8 an agreement to do so, but also the ability of the massacre survivors' ability to participate in the trial scheduled for Oct. 19, 2004 to bring the perpetrators of the massacre to justice. The massacre on March 13, 1982 which killed 107 children and 70 women in Rio Negro is only one of approximately 600 massacres committed by the Guatemalan government to come to trial in national court. UUSC partners have been part of this effort.

    GOVERNMENT Guatemala's 1985 constitution provides for a separation of powers among the executive, legislative, and judicial branches of government. The 1993 constitutional reforms included an increase in the number of Supreme Court justices from 9 to 13. The reforms reduced the terms of office for president, vice president, and congressional representatives from 5 years to 4 years, and for Supreme Court justices from 6 years to 5 years; they increased the terms of mayors and city councils from 2-1/2 years to 4 years. The president and vice president are directly elected through universal suffrage and limited to one term. A vice president can run for president after 4 years out of office. Supreme Court justices are elected by the Congress from a list submitted by the bar association, law school deans, a university rector, and appellate judges. The Supreme Court and local courts handle civil and criminal cases. There also is a separate Constitutional Court. Guatemala has 22 administrative subdivisions (departments) administered by governors appointed by the president. Guatemala City and 331 other municipalities are governed by popularly elected mayors or councils.
