In the late 1970s and early 1980s, the use of lignite coal in the former East Germany, the proximity to the highly polluting former Soviet bloc countries, and a large transportation sector in the former West Germany harmed forests and air quality throughout Germany. In a 1996 assessment, forests were damaged to the point where only 43% could be considered healthy. The Ministry for Consumer Protection, Food and Agriculture pointed out in its 2002 report of the status on Germany’s forests that although there have been marked improvements in all polluting sectors, the health of forests has improved only marginally since 1995. In 2002, 21% of all forests displayed visible forms of defoliation, according to the assessment. The report also pointed out that the decades of pollution are only now beginning to become visible, particularly on the forest floor, where the soil is acidifying after absorbing years of pollutants.

As of January 2004, Germany had a crude oil refinery capacity of 2,289,450 bbl/d, the seventh highest in the world, according to the Oil and Gas Journal Increasingly strict EU environmental regulations have been forcing refineries in Germany, as well as in all EU member states, to upgrade their refineries not only to reduce their emissions but also to meet new fuel specifications. The plan, reached Wednesday by the Social Democrats (SPD) and the Greens to ease citizenship requirements for immigrants, is one area of agreement in what have been difficult negotiations between the two parties as they try to form a coalition. The move by the future government is the first major policy shift resulting from the left's election victory last month and an important gesture to Germany's 7 million foreign residents, who make up nearly 10 percent of the population. "This government will recognize that Germany is a country of immigrants," said Kerstin Mueller of the Greens party, the junior partner in the incoming government coalition.

The Länder are not alone in subsidizing or supporting certain industries: the federal government does it to a massive and increasingly significant degree. Despite Germany's commitment to a social market economy, exceptions to market principles existed in West Germany and are proliferating in united Germany. German economic institutes and experts have repeatedly warned that authorities at various levels have supported many economic activities that should long ago have been discontinued or compelled to become competitive. Federal and Land authorities have ignored the complaints of the economists but have usually promised to reduce or eliminate subsidies as soon as feasible. Before unification, the West German government and various Länder supported a number of industries and services, such as coal, steel, aerospace, shipbuilding, and agriculture, with the federal government supporting activities across the board and the Länder supporting locally important and influential industries. Between 1970 and 1989, the total volume of subsidies, including those paid through the European Community (ECsee Glossary), rose from DM12 billion to over DM45 billion. The level of subsidies rose almost uninterruptedly, even after Kohl assumed office and his government had committed itself to reducing them. Although some categories of subsidiesfor example, those for agriculturewere not fully under West German but rather under EC control, even the portion specifically designated for German farmers also rose by 250 percent during the 1980s. Overall, the federal government provided about one-third of total West German subsidies. The other two-thirds came from the

There is disagreement about whether the president, in fact, has greater powers than the above description would suggest. Some argue that nothing in the Basic Law suggests that a president must follow government directives. For instance, the president could refuse to sign legislation, thus vetoing it, or refuse to approve certain cabinet appointments. As of mid-1995, no president had ever taken such action, and thus the constitutionality of these points had never been tested. The president is selected by secret ballot at a Federal Convention that includes all Bundestag members and an equal number of delegates chosen by the Land legislatures. This assemblage, which totals more than 1,000 people, is convened every five years. It may select a president for a second, but not a third, five-year term. The authors of the Basic Law preferred this indirect form of presidential election because they believed it would produce a head of state who was widely acceptable and insulated from popular pressure. Candidates for the presidency must be at least forty years old. The Basic Law did not create an office of vice president. If the president is outside the country or if the position is vacant, the president of the Bundesrat fills in as the temporary head of state. If the president dies in office, a successor is elected within thirty days.

The German government has signed a deal with IBM and Linux company SuSE that makes it easier for government offices to use the open-source operating system, a move that addresses concerns about relying too heavily on Microsoft products. The government isn't mandating the use of Linux, but the deal makes it possible for hundreds of federal, regional and local governments to purchase IBM computers running SuSE's version of Linux at a discount price, said German foreign ministry spokesman Dirk Inger. The purchasing framework covers both desktop computers, where Microsoft has its stronghold, and more powerful networked server systems where Linux is a stronger competitor. The deal provides an open-source counterweight to an earlier discount arrangement with Microsoft.

During his presentation on current issues affecting Israel and the Jewish world to the Knesset Immigration and Absorption Committee last week, Chairman of the Jewish Agency Sallai Meridor slammed the German government for enticing Jews to immigrate to Germany under refugee status. "The German government is enticing Jews to emigrate from the Former Soviet Union to Germany under refugee status, despite the fact that the State of Israel has already existed for over 56 years," said Meridor, who was infuriated by recently released figures indicating that around 19,000 Jews immigrated to Germany from the FSU in 2003, as opposed to only 12,000 who came to Israel in the same year. "The government of Israel must take serious steps to counter Germany since this situation drastically affects immigration to Israel." "No matter what we do we will be criticized," a representative from the German Embassy in Tel Aviv responded to Meridor's attack. "If we don't welcome Jews with open arms we will be accused of anti-Semitism and if we do welcome them with open arms, we are accused of enticing them away from Israel," he said. "Mr. Meridor's position is understandable. We don't want to hinder Jews from going to Israel. But if you want to have a favorable atmosphere for Jews in Germany, you have to accept that Jews will choose to live there." About a hundred thousand Jews have flocked to Germany since 1991, when Germany modified its refugee policies to accommodate Jews fleeing anti-Semitism and economic upheaval in the FSU. Under its Contingent Refugee Act, Germany supplies Jewish immigrants with benefits including language courses, unemployment benefits, health coverage, pensions and even rent, in accordance with a State treaty administered through the Central Council of Jews in Germany meant to reflect the nation's "historic responsibility" to make amends for its Nazi past.

The German economy is based on a "social market" (Soziale Marktwirtschaft), embracing a consensus approach between firms, unions, and Government, with a strong commitment to social welfare. At an average of 1.4% per annum, German GDP growth over the last decade was the lowest in the EU, after being among the highest for the previous thirty years. While the Government was projecting growth of 1.25% for 2002, it has now been revised to 0.4%. Any further slowdown and the economy may well slip into recession again. An important income tax reform passed in 2000 will be implemented as of January 1st, 2004. The reform will bring the lowest and highest income tax rates down to 15% and 42% respectively.
