I. Introduction
The end of the Cold War, which paralyzed the United Nations from its inception, was a cause for celebration and hope. Following the historic Security Council Summit Meeting of January 1992, the then Secretary-General of the United Nations, Boutros Boutros-Ghali, spoke of a growing conviction "among nations large and small, that an opportunity has been regained to achieve the great objectives of the U.N. Charter (Charter) a United Nations capable of maintaining international peace and security, of securing justice and human rights and of promoting, in the words of the Charter, 'social progress and better standards of life in larger freedom.'" He warned, however, that this opportunity "must not be squandered," and that the United Nations "must never again be crippled as it was in the era that has now passed."

Representatives of some 60 governments have been invited to Stockholm by Prime Minister Göran Persson to discuss key issues of a humanitarian, political and moral nature relating to genocide. They have taken a horrible toll in lost lives, and have shaken the nation to its foundations. We’ve felt a rush of emotions, including horror, fear, grief, sorrow, anger and even calls for revenge. As a person from New York, I take the terrorism very personally. I have family, friends and acquaintances there, and I’m still not sure about all of them. I’m very angry about the senseless deaths. These terrorists and their acts are despicable, and the perpetrators must be brought to justice. In response to these acts, our emotions are understandable, and we should do nothing to belittle these feelings. It almost seems blasphemous to suggest that we add to these emotions a part of us that also thinks about what happened and why. And yet there’s a need, beyond our feelings, also to understand. Why did this happen to us? Our leaders in Washington have rushed in with their response, and there’s the danger that we, the people, will be left behind or left completely susceptible to Washington’s lead rather than making up our own minds about why this happened, and what to do. Unfortunately, in trying to understand why this terrorism has occurred, we’ve been given little help by those upon which we rely for information. Our educational system has provided us neither the history nor the critical perspective to understand. Our officials refuse to ask the question “why,” except in terms of stereotypes that divert us from the causes and focus us instead on the symptoms. And most crucially, our mainstream media has almost exclusively parroted official analyses and solutions, acting not like watchdogs but rather like lapdogs. Officials and our media operate essentially under the assumption that there can be no question of “why,” since there’s nothing we could have conceivably done that has anything to do with provoking terrorism.

Thanks for the warm welcome, and thanks for inviting me to join you in this 20th anniversary of the National Endowment for Democracy. The staff and directors of this organization have seen a lot of history over the last two decades, you've been a part of that history. By speaking for and standing for freedom, you've lifted the hopes of people around the world, and you've brought great credit to America. I appreciate Vin for the short introduction. I'm a man who likes short introductions. And he didn't let me down. But more importantly, I appreciate the invitation. I appreciate the members of Congress who are here, senators from both political parties, members of the House of Representatives from both political parties. The Turkish Armenian Reconciliation Commission (TARC) requested that the International Center for Transitional Justice (ICTJ) facilitate an independent legal study on the applicability of the 1948 Genocide Convention to events which occurred during the early twentieth century. On February 4, 2003, the International Center for Transitional Justice provided an analysis on the subject.
THE APPLICABILITY OF THE UNITED NATIONS CONVENTION ON THE PREVENTION AND PUNISHMENT OF THE CRIME OF GENOCIDE TO EVENTS WHICH OCCURRED DURING THE EARLY TWENTIETH CENTURY LEGAL ANALYSIS PREPARED FOR THE INTERNATIONAL CENTER FOR TRANSITIONAL JUSTICE
This memorandum was drafted by independent legal counsel based on a request made to the International Center for Transitional Justice ("ICTJ"), on the basis of the Memorandum of Understanding ("MoU") entered into by The Turkish Armenian Reconciliation Commission ("TARC") on July 12, 2002 and presentations by members of TARC on September 10, 2002, seeking an objective and independent legal analysis regarding the applicability of the United Nations ("UN") Convention on the Prevention and Punishment of the Crime of Genocide to events which occurred during the early twentieth century.

...Article II of the U.N.'s 1948 Convention on Punishment and Prevention of the Crime of Genocide (UN GOAR Res. 260A (III) 9 December 1948; effective 21 January 1951) specifies five categories of activity to be genocidal when directed against an identified "national, ethnical, racial, or religious group," and therefore criminal under international law. Only one of these involves outright killing,
a) Killing members of the group;
b) Causing serious bodily or mental harm to members of the group;
c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
d) Imposing measures intended to prevent births within the group;
e) Forcibly transferring children of the group to another group.
Under Article III, the Convention makes the following acts punishable under the law;
a) Genocide; b) Conspiracy to commit genocide; c) Direct and public incitement to commit genocide; d) Attempt to commit genocide;
