Monetary Rewards Employees are motivated to seek other employment based on monetary gains. Every state in the US has some form of "alternative" punishments. Appeal Following a conviction , the convicted person may apply for his or her case to be brought before a higher court in order to "appeal" the previous judgment of the case. All states allow some kind of appeals process, but it varies from state to state. Most allow two appeals: one "as of right" to an intermediate appeals court, and the second as a "discretionary" appeal to the state's highest appeals court. The second appeal is called discretionary because the court can decide whether or not to take the case. The intermediate appeals court has no choice about taking the first appeal.

This would give lay people easy access to the laws that they must follow and it would allow attorneys to do legal research without having to leave their office to go to a law library, or pay for expensive collections of casebooks. Unfortunately, economic realities dictate that we may never see all of the substantive law of all the states on the Web. Several states receive quite a bit of income by selling the exclusive rights to publish that state's caselaw. In addition, it is quite expensive to publish and maintain a web site, and money for such a project is not available in all states. Caselaw on the Web ideally would include decisions from at least the last 30 years, a sophistocated search engine for locating relevant law, case summaries, headnotes, etc. Providing all of these on a Web site would be very expensive. Crimes are generally broken down into two categories: felonies and misdemeanors. Felonies are crimes that are punishable by a sentence that includes more than one year in jail. Misdemeanors are less serious offenses. These categories are normally further divided. For example, in Florida, there are five classes of felonies (capital felonies, life felonies, first degree felonies, second degree felonies, and third degree felonies). Misdemeanors in Florida are divided into first degree misdemeanors (punishable by up to one year in ' jail and a $1,000 fine) and second degree misdemeanors (punishable by up to 60 days in jail, and a $500 fine). ARE TRAFFIC TICKETS CRIMINAL? In some states some traffic offenses (usually moving violations) are classified as criminal offenses. Other states consider minor traffic violations to be "infractions" and do not consider them criminal. Because a non-criminal traffic infraction is not a crime less evidence is necessary to prove the infraction and a jury trial is usually not available. Once charges have been filed, the suspect is ordered to appear before a court. If the person is not yet in police custody, an arrest warrant may be issued. In some cases, an order or summons to appear may be used in place of an arrest. A court will initially determine if there is probable cause to believe the suspect committed the crime charged. Bail must also be set "promptly". The exact timing of these steps will vary from state to state, but must be within 72 hours of an arrest.

In addition to the twenty-three (23) criminally charged defendants, another twenty-nine (29) other individuals have been taken into custody by ICE and face administrative charges for violations of immigration laws. Of the fifty-two (52) individuals taken into custody, thirty-six (36) had obtained Florida state commercial driver’s licenses, certifications to haul hazardous materials, or access to ports of South Florida. As reflected in the criminal complaints, the scheme included three (3) Driver’s License Examiners and associates working outside that would recruit the commercial license recipients. After contact with a recruiter, the prospective recipients would contact an examiner and conspirators would then contact an examiner and present her with the necessary paperwork. The examiners, as charged, would then falsely certify the illegal alien’s citizenship as legal or United States citizen. The examiners would charge a fee of $100 to $200, while the recruiters would charge $1,500 to $3,000 thousand dollars. “This investigation has demonstrated how the corrupt acts of driver’s license examiners can circumvent our state’s licensing procedures,” said Mr. Jiménez. “We will continue to vigorously investigate and prosecute anyone who violates the licensing procedures in this state.”

CEELI in Russia Success Story: Read about CEELI and the New Criminal Procedure Code in Russia Background CEELI initiated its program in Russia in 1992 with the placement of its first rule of law liaison in Moscow. CEELI added its Criminal Law Reform Program in 1995. In 1999, CEELI opened an office in Samara, from which it conducts programs throughout the Middle Volga District. CEELI presently has two offices in Russia and is preparing to open a third. The Moscow office provides overall direction and programming; it is staffed by three American attorneys (the country director, a gender issues legal specialist and a criminal law liaison), five Russian lawyers (an advocacy program director, one staff attorney each for the advocacy and gender issues pro-grams and two for criminal law) and local support staff. A field office set up in Samara in 1999 to serve south central Russia is staffed by a rule of law liaison, a Russian staff attorney and a program coordinator. CEELI intends to open an office in Vladivostok in the near future to expand its rule of law efforts to the Russian Far East. Advocacy CEELI pioneered clinical legal education in Russia. This code is more strict than the ABA Codes, particularly on the subjects of confidentiality and initiating sexual relationships after the commencement of the attorney client relationship. The Model Rules of Judicial Conduct were adopted by the A.B.A. Standing Committee on Ethics and Professional Responsibility in August of 1990. This Code was adopted by the U.S. Judicial Conference at their September 22, 1992 session, and is referred to by them as the Code of Conduct for United States Judges. The Code of Judicial Conduct was adopted in 1972 by the American Bar Association House of Delegates to replace the Canons of Judicial Ethics which had been in force for nearly fifty years. Back to Menu Substance Policy As an educational institution, the University of North Florida is committed to providing an environment that enhances and supports the intellectual process. The academic community, including faculty, administrators, staff, and students, has the collective responsibility to ensure that this environment is conducive to healthy intellectual growth. The use of harmful and addictive substances poses a threat to the educational environment. Thus, it is necessary to promulgate this substance policy to assist members of the University community in their understanding of the harmful and addictive potential associated with the use of drugs and alcohol, the incompatibility of illegal drugs with the educational mission of the University, and the consequences of the use, possession, manufacture, or sale of such drugs. The main thrust of this substance abuse policy is that any illegal use, possession, manufacture, and attempted sale and consumption of controlled substances and paraphernalia is expressly prohibited both on-campus, and off-campus when a staff member or student is acting as a representative of the University. Anyone found guilty of violating this policy is subject to specific sanctions and penalties as described herein. The University of North Florida expressly prohibits the use and possession of dangerous drugs and other controlled substances by students as well as employees, unless such students or employees have a valid license or prescription.

Feinerman , Georgetown University Xiaoqun Xu deals with the prison reform that started in the final years of Qing and continued in the Republican era, driven by a nationalist goal to end extra-territoriality and nonetheless informed by Western models. Mary Buck examines the introduction of Western legal distinctions, the criminal/civil distinction in particular, embodied in the continental procedural law adopted by the new, "modern" courts of the early Republican period. Buck asks how they resonated with Chinese concepts of procedural and substantive justice and popular and professional expectations of the function of law in a modern society. In contrast, Harold Tanner questions the form/content dichotomy and the myth of Chinese uniqueness that it supports by looking into the use of the criminal justice system as a means of moral transformation in the PRC, in light of comparable historical cases in the West. Acknowledging the differences between the PRC and the West, Tanner hopes to underline the common features of the historical experiences of both.
