The Policy and Advocacy Committee of the AIDS Committee of Toronto developed the first policy of any community-based organization in Canada on the use of criminal sanctions as a response to the transmission or threatened transmission of HIV. In the policy, ACT opposes the use of criminal sanctions and, recognizing that there may be isolated, extreme situations involving "substandard behaviour regarding the transmission of HIV," suggests that provincial health legislation contains suitable powers to provide adequate remedies. Home poker games are not specifically mentioned in the laws that were created to regulate home gambling. But in the past couple of years there has been a wide acceptance of poker by society as a game of skill (although it still has a long way to go). Therefore, it stands to reason that anyone caught organizing or playing in a home poker game will probably not be punished to the full extent of the law. Most home gambling laws were created for 2 reasons: to protect citizens from developing dangerous gambling habits as a results of easy access to gambling establishments and to keep citizens from profiting by running a gambling establishment. Home poker games, for the most part, are not guilty of either of these things. As long as they are unraked and low-stakes they are harmless and although they are breaking the letter of the law, they are abiding by the spirit of the law.
    ALASKA
    Article 2 (Gambling Offenses) in Chapter 66 (Offenses Against Public Health and Decency) states that it is an offense to engage in unlawful gambling, But that it is an "affirmative defense" to prosecution for the person to claim having been part of a "social game". A "social game" is defined as gambling in a home where there is no house player (barring Home Craps and other home casino games), no house money, or no house odds. There must also be no profit from the operation of the game (in poker this is the rake). A home poker game that is not being raked is legal in Alaska and it is legal to possess gambling devices - if it is for a "social game".

The following statutes relating to driving under the influence (DUI) and boating under the influence (BUI) are effective as of July 1, 2003: Recent DUI Legislation On 3/22/02 the Florida Legislature passed House Bill 1057 greatly affecting DUI laws. In summary, this new legislation provides in part as follows: Felony DUI Felony DUI's have been expanded to include the following:
  • As of July 1, 2002 any person who is convicted of a third time DUI within 10 years from his/her last DUI conviction can be charged with a third degree felony.
    "Serious bodily injury" language of felony DUI statute is expanded to include the words "contributes to causing" in addition to "the former language that provides: "causes." (Effective 7/1/02)
    Amends Florida Criminal Punishment code F.S. Section 921.0022 to include a third time felony DUI conviction as a level three offense.
Ignition Interlock Devices Recently, the Department of Motor Vehicles has begun to require the imposition of an interlock device in the vehicles of those convicted of Driving under the Influence. There is a possibility that this requirement is incorrect. If you were convicted of a DUI between July 1, 2002 and July 1, 2003 AND the Judge did not order the imposition of an interlock device in your car, then the DMV CANNOT impose that requirement.
YOU HAVE 30 DAYS FROM THE DATE OF THE DMV LETTER TO FIGHT THE DMV IF THEY IMPOSE THE INTERLOCK WITHOUT A COURT ORDER.

    Locking Up The Vote
    Disenfranchisement of former felons was the real crime in Florida By Nicholas Thompson Rosetta Meeks lives in Florida's Miami-Dade County, but she didn't get to vote in the presidential election. Nobody scrutinized her ballot for hanging chads or screamed himself hoarse trying to prevent officials from counting it. An African-American woman who has devoted her last six years to teaching computer skills to low-income people, Meeks wanted to vote and knew whom she wanted to vote for. But she was locked out of the mayhem. Rosetta Meeks was convicted of a drug felony seven and a half years ago and, under Florida law, every felon is permanently barred from the voting booth unless the governor and at least three of his cabinet members decide to restore her civil rights. Thirteen other states have similar laws: If you commit any felonybe it murder or lying on a customs formyou never again get to have a say in the election of the president or the town selectman. According to the best available estimates, this law kept 525,000 people in Florida, most of them poor and a great many of them black, away from the polls in a presidential election decided by just a few hundred votes. Like most ex-felons, Meeks didn't meet all 23 of the qualifications for Florida's process of fast-track enfranchisement. The qualifications range from the type of crime you committed (you can't, for example, have been found guilty of battery of a public transit official) to your financial status (you can't owe the state more than $1,000, not uncommon for poor ex-felons who are often subjected to large fines and restitution payments, or required by judges to pay the fees of their state-appointed attorneys.)

The Post-Revolution Period, 1776-1873 After purchase by the United States from Spain, the Territory of Florida was created in 1822 and all laws in force in Florida at the time of the organic law were retained. Later that year, Florida enacted a law that adopted the common and statute laws of England in their entirety as they existed on the date of the Jamestown settlement, an act that made consensual sodomy a capital offense in the state. In 1823, the law was ameliorated by limiting the penalty for a common-law offense to a year in prison or a fine of $500. This law was repealed in 1828, thus legalizing sodomy in the state.     Two significant, apparently unrelated, trends have emerged in American society and medicine. First, American medicine is reexamining its approach to dying. The Institute of Medicine, the American Medical Association, and private funding organizations have recognized that too many dying people suffer from pain and other distress that clinicians can prevent or relieve. Second, this past decade has marked a sharp increase in the number of physicians prosecuted for criminal negligence based on arguably negligent patient care. The case often cited as a watershed is People v. Einaugler , which involved a New York nursing home patient whose physician was convicted in 1993 of two criminal misdemeanors after he ordered an elderly dialysis patient to be tube fed through a peritoneal dialysis catheter. How is the growing awareness of dying patients' pain and the increasing willingness of prosecutors to charge physicians with crimes connected? Pain at the end of life is frequently treated with narcotics, prescription drugs that are closely regulated by state and federal law. That complex web of lawsand a growing fear of legal sanctionshas deterred physicians from prescribing controlled substances. As those legal sanctions move from disciplinary actions to criminal charges, physicians' fears may expand.
