626.99296 Transfers of structured settlement payment rights.
  • PURPOSE.The purpose of this section is to protect recipients of structured settlements who are involved in the process of transferring structured settlement payment rights. DEFINITIONS.As used in this section, the term: "Annuity issuer" means an insurer that has issued an annuity contract to be used to fund periodic payments under a structured settlement. "Applicable law" means any of the following, as applicable in interpreting the terms of a structured settlement: The laws of the United States; The laws of this state, including principles of equity applied in the courts of this state; and The laws of any other jurisdiction: That is the domicile of the payee or any other interested party; Under whose laws a structured settlement agreement was approved by a court; or In whose courts a settled claim was pending when the parties entered into a structured settlement agreement. "Applicable federal rate" means the most recently published applicable rate for determining the present value of an annuity, as issued by the United States Internal Revenue Service pursuant to s. 7520 of the United States Internal Revenue Code, as amended.

    [Note: information in this article was current as of 1994.] One day in 1977, New York mother Barbara Damon was banished from a public swimming pool when she refused to nurse her two-and-one-half-month-old infant in the ladies' room. As a result, her family's pool pass was revoked, and the village enacted an ordinance forbidding public breastfeeding at the pool! The legal battle that ensued took three years to settle, but eventually the ordinance was repealed, Barbara was paid damages, and a structure was erected where all mothers could feed their babies. While this litigation was pending, New York legislators were considering amending the state's indecent exposure statute to exclude the breastfeeding of an infant. It is rumored that the legislation was put on hold because it would have been a slap in the face to the municipality involved in the lawsuit. New York's amendment to the indecent exposure law was enacted in 1984, but largely in a vacuum, since it was not widely publicized. One reason why so few people may have known about it was that New York amended its administrative codes affecting hospital policies and actions regarding breastfeeding at the same time, and this generated more interest.

    n Bush v. Gore , candidate Bush challenged the December 8, 2000 decision of the Florida Supreme Court on two constitutional grounds. He argued that the decision of the Florida Supreme Court allowing a recount of disputed ballots violated both Article II, Section 1 and the Equal Protection Clause of the Fourteenth Amendment of the US Constitution. Although I will devote most of my attention to the Equal Protection issue, the Article II issue merits at least passing notice, for although only three Justices found any merit in this argument, it has received some attention recently from conservative legal commentators in their efforts to rescue the Supreme Court's decision.     Six Categories of Law Materials
    by Rich Gause, UCF Government Documents Librarian, January 1999 Many print legal resources fall into one of six categories. There are other important distinctions you will make in conducting legal research, such as civil/criminal and federal/state, but these six categories can help you understand the relationship between different sources of information. Resources for each of the three branches of government (Legislative, Executive, Judicial) are generally arranged either chronologically or by subject. The chronological version will usually be published first, so if you are looking for updates to information appearing in a subject resource, try to identify its chronological counterpart. If you can determine which category best describes a document, then you may find it easier to identify its relationship with other resources. A few documents may be a combination of two or more categories, such as the U.S. Code, Lawyers Edition , which is a subject arrangement of laws passed by Congress, but also provides a subject arrangement of judicial decisions associated with those laws. Examples are provided below for some Federal and Florida publications.

    Getting Started
    As in all projects, unless you are already knowledgeable about the topic area, it is best to start with introductory resources and then to consult more focused works; moving from secondary to primary resources. Articles and books can provide you with an overview of your topic and help you think of search terms that you might not have thought of otherwise. They will also cite primary authorities such as statutes and case law. You can then use the primary sources cited in the secondary sources as a jumping off point to find other primary sources.
