Seminar:
Introduction to the Civil Code
Fall 1999
Professor Pedro A. Malavet
The Course: A practical application of the comparative method to the study of the law that gives the civil law system its name: the Civil Code. We will focus on black-letter rules applicable to institutions common to most civil codes in the areas of Family Law, Property, Contracts and Torts. The introduction will include a discussion of the comparative method in the context of our course, and an overview of the civil law, its historical antecedents, structure and interpretation. Students will write a paper on a topic related to our subject matter. The paper will be drafted in stages that will include several oral presentations in class. Comparative law is not a prerequisite. Text: Materials Handout. A Civil Code Supplement and reading materials will be included in this handout. Because of the large number of pages in the material, a copy charge may be required. Students must get two binders in which to keep their materials. Office Hours : I will have regular office hours on Mondays, from 2:30 to 4:30 p.m. and on Wednesdays, from 11:00 a.m. to 12:00 noon. My office is in Room 337. You may also see me after class or schedule appointments. My office telephone number is 392-2234. If you feel lost, or if you have doubts that cannot be resolved during class or during the period immediately following it, please do not hesitate to come and see me. Office time is also a good opportunity to explore matters that are not directly related to the material being discussed in class. You may also e-mail me at: malavet@law.ufl.edu.

Statutory Supplement
Introductory Note:
The legal supplement for my seminar is the Puerto Rico Civil Code. I have chosen it because it is easily available on-line in English. This is a much cheaper and quite adequate alternative to the translations of the French or Spanish codes.
The Puerto Rico code is substantially modeled after the Spanish Civil Code, which itself was heavily influenced by the French Civil Code. During the semester, I will hand out a table of equivalence for the Puerto Rico Code, the Spanish Civil Code and Civil Code of Louisiana.
Here, I post only the table of contents of the code, in order to provide you with ideas for paper topics.

CIVIL ACTION - The generic term used to describe court proceedings that are not criminal in nature. This includes lawsuits by private parties as well as those involving governments. Except in cases concerning civil contempt (actually a quasi-criminal matter) there is seldom a possibility of incarceration to the losing party. In most jurisdictions actions are divided only into two kinds, namely, criminal and civil. A criminal action is prosecuted by the state as a party, against a person charged with a public offence, for the punishment thereof. Every other action is a civil action.

Back to Research Guides page Florida Forms Much of a lawyer’s time is spent drafting forms. To assist lawyers in this aspect of their practice, there are many different types of form books available. When using form books, one should keep in mind that they are all general in nature. Therefore, before using a form, extreme care should be exercised to make sure that the language is entirely suitable for the purpose for which it is to be used. This pathfinder will look at two different categories of Florida legal forms: transactional forms such as for wills, contracts, sale of goods, and formation of business entities; and those for pleading and practice (litigation) purposes. The following list includes sources of Florida forms updated on a regular basis. The list is not all inclusive. Use it as a starting point. (This list, for the most part, does not include form books which are not regularly updated. The forms in those books may or may not still be valid. Check the Baron computer catalog for their availability. Transactional Form Books Index to Forms and Checklists : (Florida Collection KFF61.I52) Published by the Florida Bar. Serves as an index to all forms and checklists currently available in the Florida Bar’s CLE Publications. As of August 31, 1996, there were 77 CLE Publications practice manuals and rules pamphlets available. Very useful tool.

Back to Research Guides page Sexual Harassment Law Introduction Federal Sources of Law Civil Rights Laws Selective Case Law ... Online Sources Introduction Sexual harassment law is a form of discrimination based upon the sexualized treatment of a victim. A cause of action for sexual harassment can arise in the context of federal, state, or local law. While sexual harassment claims most often occur in the area of employment law, they can also arise in other arenas. The legal principles found in employment based discrimination cases may or may not be applicable in a non-employment context, depending on the facts and jurisdiction. Thus, depending upon the basis for the sexual harassment claim, the researcher may have to consider a variety of federal and state law sources. This research guide provides the main sources of law for sexual harassment, primarily in the employment context, and guides the researcher to several good sources for sexual harassment law on the federal level, and under Florida law. No attempt is made to be comprehensive; rather, the research guide provides sources that are current, well-focused, and that provide information and good starting points for further research, including non-employment sexual harassment. Both sexual harassment sources and gender discrimination civil rights sources are given where they are helpful. Sources of Law - Federal The Equal Employment Commission has published a pamphlet entitled Facts About Sexual Harassment . It gives a brief explanation of sexual harassment as it violates federal law.

Brandt, The Origins of Civil Statutes and Codes, Vol. 12, No. 1, TEX. LAWYER , March 18, 1996, at 31. In our Jan. 15 column, we learned that West Publishing Company("West") prints Texas statutory law in two arrangements: the civil statutes in Vernon's Texas Revised Civil Statutes Annotated ("civil statutes"), and the codified statutes in Vernon's Texas Codes Annotated ("Codes") [ See " Making Vernon's Volumes Work for You , " page 26]. Now let's test your legal research acumen. Question 1: What is the origin of a civil statute? Question 2: How and why is a civil statute enacted into a code?
THE 1925 BULK REVISION Answer to Question 1: The 1876 Texas Constitution contains the following provision: "The first session of the Legislature under the Constitution shall provide for revising, digesting and publishing the laws civil and criminal; and a like revision, digest and publication may be made every ten years thereafter; . . . ." Since the adoption of the 1876 Constitution, Texas has had four bulk revisions of its statutes. A "bulk revision" involves major changes to the substance of the law by reenactment of all of the statutes (in contrast to those statutes on a particular subject), eliminating repealed, invalid, duplicative and other ineffective provisions. The four bulk revisions occurred in 1879, 1895, 1911 and 1925. See Joseph H. Pool, "Bulk Revision of Texas Statutes," 39 Tex. L. Rev. 469 (1961). The civil statutes are the statutes enacted in the 1925 bulk revision, and subsequently amended.

WHAT'S A PRACTITIONER TO DO? Reproduced with permission of the Texas Lawyer from Lydia M.V. Brandt, The Case of the Disappearing Statute , Vol. 12, No. 23, TEX. LAWYER , August 19, 1996, at 23-24. Let's assume that we want to represent a "body politic" in an aeronautics matter. In Tex. Civ. Stat. art. 46c-1(a), the term "person" included a "body politic." This statute, however, was selected as one of the statutes that was part of the statutory revision project culminating in the Transportation Code. We are asked to research whether a "body politic" is a person within the meaning of the Transportation Code. The Disposition Table in the temporary pamphlet that contains the Transportation Code, does not contain an entry for Tex. Civ. Stat. art. 46c-1(a) that shows us where the term "person" was codified in the Transportation Code. We flip through the index and the table of contents in the temporary pamphlet and cannot find our answer. What's a practitioner to do?
In this column, we will explore the work product of the Texas Legislative Council in order to solve
