Bob Schaeffer, FairTest (239) 395-6773 FLORIDA STATE SCHOLARSHIP PROGRAM UNFAIRLY DISCRIMINATES, SAY CIVIL RIGHTS AND EDUCATIONAL GROUPS (MIAMI, FLORIDA) On the eve of the day the College Board plans to release reports detailing national SAT results, MALDEF, a Latino civil rights organization, and FairTest, an advocacy group for fair and open testing, have filed a legal complaint against the state of Florida's "Bright Futures" scholarship program, charging that its use of college admissions tests such as the SAT I and ACT discriminates against Latino and African American students. In addition, a number of other civil rights and educational groups have joined the complaint, including the Hispanic Coalition, Inc., the Florida NAACP, LULAC, Jacksonville Urban League, and the Hispanic American Alliance.
At a press conference, the groups outlined their complaint filed with the Office for Civil Rights of the U.S. Department of Education, whose regulations implement Title VI of the Civil Rights Act of 1964. Florida's discriminatory actions in administering its $164 million a year scholarship program could endanger federal Title I educational funding for the state, which has amounted to about $1 billion over the last three years.

LENDING A HAND TO KATRINA VICTIMS Many storm victims from Louisiana, Mississippi and Alabama have relocated to Florida in the wake of Hurricane Katrina. Specialists with the Department of Financial Services are helping provide information and assistance to evacuees with questions on insurance. We have already deployed more than 40 law enforcement personnel from the department’s Division of Insurance Fraud and Division of State Fire Marshal to assist in search and rescue efforts in Mississippi. Evacuees are being encouraged to contact the department’s toll-free Consumer Helpline at 1-800-22-STORM to get answers and guidance on insurance questions. I encourage storm victims to contact their insurance companies to tap into funds for additional living expenses covered under their homeowners’ policies and to discuss filing claims. Evacuees should keep all receipts during the recovery period. Other helpful information includes:

Hunting Handbook Table of Contents HUNTER SAFETY REQUIREMENT A person born on or after June 1, 1975 may not be issued a hunting license in Florida without first having successfully completed a hunter safety course. Hunters affected by this requirement must present proof of satisfactory completion of Florida’s hunter safety course or an approved course provided by another state or province when purchasing a license. Children under the age of 16 may hunt with adult supervision even though they have not completed a hunter safety course. Hunters who need proof they’ve passed the Florida Fish and Wildlife Commission’s (FWC’s) Hunter Safety Course can print out duplicate certificates from the FWC’s Web site at MyFWC.com, click on “hunting” and scroll down to “hunter education.” See “Free Hunter Safety Course” page 20.     Recordkeeping/Reports: Parochial, denominational, and private schools must keep a register of student enrollment and daily attendance in a manner prescribed by the state and open for inspection by the local superintendent or attendance assistant. Fla. Stat. Ch. 232.021. The register may be used as evidence in a court procedure for the enforcement of the Florida compulsory education statute. Fla. Stat. Ch. 233.19(5). Prior to admission to pre-kindergarten or kindergarten, a private school principal must require that the child provide evidence of age such as a transcript of the child?s birth record or certificate of baptism. Fla. Stat. Ch. 232.03. Nonpublic schools which become defunct must arrange for the transfer of student records to the local public school superintendent, or if a member, the principal office of a nonpublic school system or association. Notice of transfer must be given to the Department of Education. Fla. Stat. Ch. 228.092. Nonpublic schools serving K-12 students must file a database survey form with the Florida Department of Education indicating the name of the institution, address, telephone number, type, administrative officers, enrollment by grade or special group, number of graduates, number of instructional and administrative personnel, number of school days, and other data as needed under ?228.092 and 232.021. Fla. Stat. ch. 229.808 (1),(2),(3),(4)-(7).

Click here to download it. The Individuals with Disabilities Education Act (IDEA), 20 U.S.C.  1400 et seq., provides federal funds to assist state and local agencies in educating disabled children. The IDEA conditions the receipt of such funds upon a state's compliance with certain goals and procedures. State legislatures and departments of education have enacted statutes and promulgated regulations respectively to ensure compliance with the IDEA requirements. While the federal IDEA statutes and regulations require schools to conduct functional behavioral assessments (FBAs), they provide little to no guideance on what an FBA is or how to conduct one. Therefore, states have begun to step into the void and pass laws and regulations that are more specific.     The Program Development and Support Section is responsible for providing training on the environmental resource permit program, the wetland resource permit program and the sovereign submerged lands proprietary program. In addition to training staff of the Department and of other agencies, this section also teaches the public about these programs and about wetlands and aquatic resources in general. TRAINING EVENTS: Training for agency staff is presented in the form of printed materials, periodic conference calls and meetings, small seminars around the state, and an annual conference. In addition to these traditional modes of education, we have recently started to develop our own training videos. TRAINING VIDEOS: The videos are written to CDs in MPEG format for the purpose of desktop viewing on a PC. The training videos cover a range of topics related to the ERP Program, including "Hydrologic Indicators," "Sovereign Submerged Lands" and "Restoration and Mitigation: Hints and Highlights."

    NAEYC Update January 6, 2005 Florida Voluntary Universal Prekindergarten
    In 2002, Florida voters approved a constitutional amendment to establish a voluntary, high quality prekindergarten program for four-year-olds in the state by 2005. The constitutional amendment did not define quality or dedicate a funding source for the program. Last spring, Governor Bush vetoed a version of the bill. This enacted legislation is the product of a short special session held in December 2004. In the spring, the legislature will determine the funding. Advocates in Florida will continue to work to improve the quality components and funding for the program. Overview of state prekindergarten programs
    When we say "state prekindergarten programs", we mean those programs for 4-year olds (and in some states 3 year olds as well) that are funded with state dollars. In general, state prekindergarten program standards set a higher bar than state child care regulations. Prekindergarten programs have been important in public policy not only in terms of the focus on early learning, but because when prekindergarten programs are delivered in child care, it provides a mechanism for improving the quality of child care and providing more resources to child care programs.
    • Most states do allow a range of types of providers who can meet the standards to receive state prekindergarten funds, not just schools. In some systems, public schools have oversight and contract with other community-based child care providers and Head Start. Some states supplement Head Start with state funds as their state prekindergarten program.
