Pacific Salmon Fisheries are in Trouble

Ottawa, 30 November 1999 "The Pacific salmon fisheries are in trouble," said Denis Desautels. "Catches have declined overall, but the commercial catch has plummeted. The long-term sustainability of fisheries is at risk. Fisheries may be subject to closure in the short term, to allow stocks to recover." The Report underlines that the challenge for the Department of Fisheries and Oceans is to conserve existing stocks and rebuild those that are at low levels, while maintaining the viability of the fisheries. It says that the Department has finally taken the first steps to meet the challenge by developing a sustainable policy framework. It has taken a conservation-based approach to fisheries management and is testing selective fishing methods and gear. It is also implementing special programs such as fleet reduction and restructuring. However, important obstacles remain that need urgent attention:

Legal victory for Fisheries Act
Decision in Kingston water pollution case preserves integrity of Canada's strongest water pollution prevention legislation
May 13, 2004 KINGSTON, ON - In a unanimous decision, the Ontario Court of Appeal has upheld the effectiveness of Canada's most important water pollution prevention legislation, the federal Fisheries Act. The decision, released late yesterday, re-affirmed the standard for enforcement of the Act, which will assist water pollution prosecutions across the country.
"This decision maintains the Fisheries Act as the strongest legislation protecting against water pollution in Canada," said Sierra Legal Defence Fund lawyer Robert Wright. "The Act is "preventative" or "precautionary" at its core, which is a theme that other municipalities have picked up in making the connection between the health of our environment and the health of our citizens." The decision is the culmination of a court process begun in 1997 as a private prosecution by a concerned citizen, Janet Fletcher. Crown prosecutions followed in the fall of 1997 and the proceedings have progressed through the courts jointly. "This has been a long haul," said Ms. Fletcher. "It's all been worth it because the appeal court has upheld this important legal tool that enables strong enforcement of the Fisheries Act and a high standard of environmental protection. It can continue to be used to effectively to battle pollution at this site and others like it."

Judge's decision on dragger fishing: Fisheries Minister, not courts, must protect fish habitat
August 19 2004 HALIFAX, NS - Late last week, a Federal Court Judge released her decision in a case launched by the Ecology Action Centre (EAC) to protect fish habitat from destruction caused by dragger fishing. The Judge upheld arguments put forward by the Department of Fisheries and Oceans (DFO) that the Department acted within its powers when it permitted dragging to occur on Georges Bank, off the southwest coast of Nova Scotia.
"We at the EAC and our great legal team from Sierra Legal Defence Fund are deeply disappointed," said Mark Butler of EAC. "We began this case in 2001 because we wanted a sustainable fishery, and nothing that DFO presented in this three-year process has provided evidence that dragging isn't destructive to fish habitat and to the productivity of the fisheries. The Minister's silence speaks volumes about the government's total lack of integrity and leadership on this matter."
The Judge based her decision on matters relating to the powers of the Minister of Fisheries and Oceans and the lack of a direct link between an order allowing the opening of Georges Bank to fishing and the resulting damage to fish habitat from dragging. She also dealt with the issue of whether Section 35 of the federal Fisheries Act applies to fishing. However, she made no ruling on the question the groups specifically wanted to address: is DFO facilitating the destruction of fish habitat in contravention of the Fisheries Act by allowing dragging?

Liquefied natural gas (LNG) terminals pose a developing threat to commercial and recreational fishing in the Gulf of Mexico. While LNG is continually touted by the Bush administration as a critical part of our nation’s energy future, a growing and diverse group of fisheries scientists, commercial and recreational fishing groups, environmental and conservation organizations, and concerned citizens are opposing facilities proposed by the world’s largest oil and gas corporations. Imported natural gas, shipped to the U.S. in a liquefied form, needs to be warmed to be “re-gasified,” and then delivered to the existing gas pipeline infrastructure. Seven of the 22 facilities proposed for the Western Gulf intend to use an open-rack vaporizer, or open-loop system, running Gulf seawater through radiator-like racks. One terminal alone could use up to 200 million gallons of Gulf water a day to “re-gasify” the natural gas. The drastic temperature change and physical damage caused by the process will destroy fish eggs and larva by the billions. Proposed for areas that are considered essential fish habitat for a vast range of Gulf sea life, fisheries managers from the National Marine Fisheries Service, the Gulf States Marine Fish Commission and the Gulf of Mexico Fishery Management Council are unified in their opposition to the use of the open-loop system.
