Following are excerpts of Senator McCain's speech from the July 25 Congressional Record: THE SITUATION IN FIJI
(Senate - July 25, 2000) Mr. McCAIN. Mr. President, let us imagine for a moment that a ragtag group of armed rebels in Australia was able to infiltrate the parliament in Canberra and put a gun to the head of the Australian Prime Minister. Let us imagine that these rebels, led by a failed indigenous businessman who claimed to speak for the native people and against those of European descent who had `colonized' the island, held the Prime Minister and members of his government hostage for several months in the Parliament building. Let us also imagine that, during this period, central government authority across Australia withered as armed gangs set up roadblocks, occupied police stations and military barracks, torched homes and businesses owned by those with different ancestry, seized tourist resorts, and generally terrorized innocents across the country. What would America's response be to such a violent takeover of a democratic government and the abduction of its prime minister by race-baiters who proclaimed that under their `new order,' there would be no place in government or, indeed, in society for those with different ethnic roots, and who reveled in the armed chaos they had inspired? At a minimum, I would expect the United States to impose tough sanctions on the illegitimate regime; mobilize our allies in Asia and at the U.N. Security Council to speak forcefully and with one voice against the coup; and join like-minded nations in resolutely affirming that the country in question would suffer lasting isolation and international condemnation until constitutional governance and the rule of law were restored.

The president in turn appoints the prime minister (head of government) and Cabinet from among the members of Parliament. Both houses of the legislature have some seats reserved by ethnicity. Other seats can be filled by persons of any ethnic group. The Senate is appointed; the House of Representatives is elected.
Fiji maintains an independent judiciary consisting of a Supreme Court, a Court of Appeals, a High Court, and magistrate courts. The judiciary remained independent through the coups and the consequent absence of an elected government. All but one of the five judges on the Supreme Court also is a serving judge in Australia or New Zealand.
There are four administrative divisionscentral, eastern, northern and westerneach under the charge of a commissioner. Ethnic Fijians have their own administration in which councils preside over a hierarchy of provinces, districts, and villages. The councils deal with all matters affecting ethnic Fijians.
The Great Council of Chiefs (Bose Levu Vakaturaga) is made up of 55 hereditary chiefs, most of whom are nominated to the Council by their respective provincial councils. It is established under the Fijian Affairs Act and recognized by the constitution.

      USP journalism programme Civilian gunmen leader George Speight today defied mounting international condemnation of the kidnapping of Fiji's elected cabinet, claiming that his regime was now the legal government of the Pacific nation. His self-styled interim government named a list of "advisers" last night but at least three of them denied any involvement on national radio and condemned the attempted coup. Prime Minister Mahendra Chaudhry, the country's first Indo-Fijian prime minister whose Fiji Labour Party was swept to a landslide victory in last year's general election, his cabinet, and MPs have been detained under armed guard in Parliament since yesterday morning. While the police and military forces appeared loyal to constitutional authority, Speight, a shaved-head timber industry businessman and undischarged bankrupt, claimed that indigenous Fijians supported the illegal regime.

    COMPERE: The high profile human rights' lawyer, Geoffrey Robertson, has agreed to act in a court case seeking to declare the recent Fiji coup illegal and reinstate the ousted Labor Government.
    The London-based QC will represent three members of the Chaudhry Government against a number of Fijian power brokers including the President, the Head of the Armed Forces, and the Chief Justice.
    The case is being described as a crucial test of democracy and the independence of the judicial system in Fiji but, as Lisa McGregor reports, there are now splits within the deposed government's ranks.

    Chris wrote, "Fiji got kicked out of the Commonwealth as a result of the coup d'etat in (I think) 1987. Didn't change its flag, which is a defaced pale blue British ensign." Apparently (according to The Flag Bulletin Brendan Jones , 10 August 1995 Fiji still retains very close economic and political ties with the UK, which may possibly have influenced its decision to retain the old flag. Remember that the British Foreign Office does not recognize Fiji's withdrawal from the Commonwealth and therefore treats Fijian citizens as through they were still in the Commonwealth. The Fijian ambassador is still the High Commissioner, for example, and Fijian students can still apply for Commonwealth scholarships (I know this because I used to help administer one). I think the Foreign Office is basically turning a blind eye to the problem (something they are very good at!) in the hope that it will somehow disappear. Stuart Notholt , 23 August 1995 Fiji held a competition on independence to design a new flag. The fact that they ended up with one so similar to the colonial ensign suggests a certain lack of imagination either on the part of the competitors or the judges! Anyway, the only main differences made were that the white disk behind the coat of arms was removed and the colour changed to light blue. A dark blue version, which must look virtually the same as the old colonial flag was adopted for use as the state ensign.

It is available at www.itc.gov.fj/docs/prepcom3_report.doc and I apologise for any cross-postings. Soft-copies can be e-mailed directly on request. Despite the great progress, Prepcom3 failed to agree on the final text of the Declaration and Action Plan, and had to be suspended and reconvened for 1 week from Mon 10 Nov - Fri 14 Nov (aka Prepcom4). It is generally agreed that Prepcom4 may be able to finalise the Declaration but that another week will be needed for the Action Plan.

    Fiji Government Sworn In
    Fiji's President Josefa Iloilo has sworn in a new government two months after an attempted coup led to the ousting of the previous democratic regime.
    The new cabinet is similar in line up to one announced last week, except for the removal of three men closely associated with rebel leader George Speight, who overthrew the government in May.
    The rebels had threatened trouble unless more of their supporters were named as part of government,including a replacement for Prime Minister Laisenia Qarase, whose appointment had already been announced. The swearing in ceremony was held amid tight security as the Fijian military remained on alert following the sporadic violence that accompanied the arrest of Mr Speight. Shortly after Friday's ceremony, Prime Minister Qarase said Mr Speight now posed "no more threat" and said the lawlessness had to stop. He also warned ousted prime minister Mahendra Chaudhry not to try to take back power.

    Rebel leader George Speight says he has not adequately been consulted in the formulation of Fiji's new government and its swearing-in has been indefinitely postponed. Mr Speight said the new President, Ratu Josefa Iloilo, had promised he would be included in negotiations, but he had not approved the cabinet list announced on Tuesday.
    Fiji is verging on civil war Joe Nata, rebel spokesman "I have been in touch with the president through a high-ranking chief of mine to express my disappointment," Mr Speight said. Earier the acting prime minister said the swearing-in had not taken place because President Iloilo was too ill to attend, but a rebel spokesman said the ceremony had been deferred to allow for further talks over the make-up of the new government. Fiji's new president has already been sworn in Fiji is "verging on a civil war," said the spokesman, Joe Nata.

    Downer The Government has, therefore, decided to impose, with immediate affect, a range of measures, which are intended to register our deep displeasure with the current situation in Fiji. I've spoken with the Fiji High Commissioner to Australia recently and explained these measures to him. First, Australia's High Commissioner to Fiji, Ms Susan Boyd, will be recalled for consultations for a limited period of time. Secondly, most non-humanitarian aid activities will be terminated, including all new scholarships and training and the following public sector projects - the Mineral Resources Department Project, the Fiji Customs Service Project, the Fiji Civil Service Reform Project, the National Planning Office Project, the Fiji Bureau of Statistics Project, and the UNDP Australia Information Services for Parliamentarians because there are no effective Parliamentarians there now. As I said on 29 May, the minister for Immigration and Ethnic Affairs has cancelled Mr Speight's visa. Any application for entry by other individuals involved in the hostage-taking will be considered in the light of those actions. I've also instructed our missions abroad to seek the cooperation of other like-minded governments to take equivalent measures against Mr Speight and his associates and many have said they will do so.

    Branches: Executive president (head of state), prime minister (head of government), Cabinet. Legislative bicameral parliament; upper house is appointed, lower house is elected. Judicial Supreme Court and supporting hierarchy.
    Major political parties: Soqosoqo Duavata ni Lewenivanua (SDL), Fiji Labor Party (FLP), Conservative Alliance Matanitu Vanua (CAMV), National Federation Party (NFP).
    Fiji Government The president (head of state) is appointed for a 5-year term by the Great Council of Chiefs, a traditional ethnic Fijian leadership body. The president in turn appoints the prime minister (head of government) and Cabinet from among the members of Parliament. Both houses of the legislature have some seats reserved by ethnicity. Other seats can be filled by persons of any ethnic group. The Senate is appointed; the House of Representatives is elected. Fiji maintains an independent judiciary consisting of a Supreme Court, a Court of Appeals, a High Court, and magistrate courts. The judiciary remained independent through the coups and the consequent absence of an elected government. All but one of the five judges on the Supreme Court also is a serving judge in Australia or New Zealand.
