    GOVERNMENT The president (head of state) is appointed for a 5-year term by the Great Council of Chiefs, a traditional ethnic Fijian leadership body. The president in turn appoints the prime minister (head of government) and Cabinet from among the members of Parliament. Both houses of the legislature have some seats reserved by ethnicity. Other seats can be filled by persons of any ethnic group. The Senate is appointed; the House of Representatives is elected. Fiji maintains an independent judiciary consisting of a Supreme Court, a Court of Appeals, a High Court, and magistrate courts. The judiciary remained independent through the coups and the consequent absence of an elected government. All but one of the five judges on the Supreme Court also is a serving judge in Australia or New Zealand. There are four administrative divisionscentral, eastern, northern and westerneach under the charge of a commissioner. Ethnic Fijians have their own administration in which councils preside over a hierarchy of provinces, districts, and villages. The councils deal with all matters affecting ethnic Fijians.

Opposition political parties and media groups have protested over the risk to press freedom after the Government's sudden move in mid-February to buy a major stake in the Daily Post, a newspaper with a sharply critical editorial line. National unions and other critics have also challenged the buy out on economic grounds, citing what they see as the hypocrisy of Government policies seeking privatisation of key sectors such as water, electricity, health and other state services while buying an ailing newspaper business. The timing of the takeover comes just three months before a general election - the first under a new multiracial 1997 Constitution which paved the way for the republic regaining a place in the Commonwealth and which guarantees a free press and freedom of expression.

      The Pacific island of Fiji has hit back at the criticism it has received from international civil rights groups, after it jailed two gay men for having sex last week.
      The country's Prime Minister, as well as the Director of Public Prosecutions, have slammed the intervention by civil rights groups in the arrest and sentencing of Australian tourist Thomas McCoskar and local man Dhirendra Nadan.
      According to the Fiji Times, PM Laisenia Qarase told a local radio station that critics should not interfere with the legal processes of the country.
      The case has caused widespread alarm, with gay rights campaigners warning of a violation of human rights. Additionally, they say the arrests contravene the country's constitution, which offers protection for lesbian and gay people, despite homosexuality still being illegal in the country.
      The pair were granted bail earlier this week, after lawyers complained their sentencing was a result of prejudiced attitudes. The magistrate who ruled against them had said their 'crimes' would make "any decent person vomit".

    1 March 2001 New Zealand should foster new Fiji Government of National Unity The Green Party has welcomed today's court decision upholding the 1997 Fiji constitution. "New Zealand should push for a new broad-based Fiji government, based on this multi-racial constitution," said Green Party Foreign Affairs spokesperson Keith Locke. "There is now a political window to begin the healing process in Fiji. "A new constitutional government could include all political forces, with the aim of rebuilding the country and preparing the way for new elections," he said. "We should tell the interim government and military leaders that if they abide by the court decision, and assist the return of constitutional rule, they will have the full support of New Zealand. "But any obstruction of the will of the court will lead to continuing sanctions and the isolation of Fiji in the world community," said Mr Locke.

    Journalism Programme SUVA: Civilian gunmen leader George Speight today defied mounting international condemnation of the kidnapping of Fiji's elected cabinet, claiming that his regime was now the legal government of the Pacific nation. His self-styled interim government named a list of "advisers" last night but at least three of them denied any involvement on national radio and condemned the attempted coup. Prime Minister Mahendra Chaudhry, the country's first Indo-Fijian prime minister whose Fiji Labour Party was swept to a landslide victory in last year's general election, his cabinet, and MPs have been detained under armed guard in Parliament since yesterday morning. While the police and military forces appeared loyal to constitutional authority, Speight, a shaved-head timber industry businessman and undischarged bankrupt, claimed that indigenous Fijians supported the illegal regime.
