Studying a Federal Statute:
Some Suggestions
Does your assignment require you to read the text of the statute, or to study its causes, interpretation, and effects? Generally, the causes, interpretation, and effects are more easily found OUTSIDE of the text of the statute itself. To start: Go to United States Code Annotated (Gov. Info. Ref. Y4.J89/1:UN3/3/West) Find the Index (paperback volumes) The last volume of the index will be the Popular Name Table
Look up your statute by name in the Popular Name Table . The first line describes the original statute and will read something like:

Information may change rapidly as the event progresses. Seal of the Supreme Court The Supreme Court of the United States is the highest federal court in the United States of America . It consists of the Chief Justice of the United States and eight Associate Justices , who are nominated by the President and confirmed with the " advice and consent " of the Senate . Justices of the Supreme Court are appointed to serve for life, and they can only be removed by resigning or by Congress through the Impeachment process. No justice has ever been successfully removed from office by Congress, though many have retired or resigned. The Supreme Court is the only court established by the United States Constitution ; all other federal courts are created by Congress . The Court holds both original and appellate jurisdiction, but the latter is by far used more often. Like other federal courts, the Supreme Court may exercise the power of judicial review , or the power to declare federal or state laws, as well as the actions of federal and state executives, unconstitutional. HISTORY AND PURPOSE
CONSTITUTION
The Canadian constitution originated from numerous statutes and is not based on a single document. Prior to April 17, 1982, the written component of the constitution consisted primarily of three British statutes enacted by the Parliament of Great Britain. The three statutes - the Colonial Laws Validity Act of 1865, the British North America Act of 1867 ("B.N.A. Act"), and the Statute of Westminster of 1931 - provided the basic framework for the Canadian constitution. The B.N.A. Act was the most important component of the written constitution. Any law passed by the Canadian Parliament or a legislature had to conform to the jurisdictional constraints set out in the B.N.A. Act.

The Supreme Court of the United States was created by Sec. 1 Article III of the Constitution. Its jurisdiction is set out by statute in Title 28 of the U.S. Code. The organization of the Court is also spelled out by legislation. The Court itself develops the rules governing the presentation of cases . One of the most important powers of the Supreme Court is judicial review . While the Supreme Court is a separate branch of government, outside factors do exert some influence on the Court.

Laws from the federal government are in two sets of documents, the U.S. Code , and the United States Statutes at Large
  • U.S. Code *Y 1.2/5:(volume), Documents Reference Collection
  • The U.S. Code contains federal laws that are currently in force. It is arranged by broad subjects called " Titles ." There are fifty titles or subject divisions in the set. The U.S. Code is reprinted at six year intervals and updated during the interim with supplements. Use the set if you need the federal laws about something, i.e., laws about aviation, child abuse, civil rights, education, persons with disabilities, etc. Look in the index volumes for your subject. The index will give a citation that looks like this: DRUG ABUSE PREVENTION, CONTROL AND TREATMENT

    The first number is the title or broad subject and the second is the section within that title. Title numbers are on the spine of the volumes. Find the volume with the title you want; then look at the top of the pages to locate the title and section. FINDING STATUTORY LAW-IDEA AS AN EXAMPLE The common law as known in 17th century England has virtually disappeared both in England and the United States. The law, as we know it, is statutory. The courts still decide cases, but the law interpreted and applied is statutory law. Education law is replete with state and federal legislation. The shorthand terms Title VII and Title IX and the acronyms IDEA and ERISA are workaday words in the school attorney's glossary. Indeed, the starting point for any legal inquiry is, what statute or statutes are involved, and how are they worded. "Individuals with Disabilities Education Act" (IDEA) will be used as an example of how to locate statutes as this Act enjoys more than its share of litigation, hence its selection.
