Here you can research both the law and science of paternity. Your situation is far from unique, out-of-wedlock births are now commonplace. In fact, paternity cases outnumber divorce filings in many courts. If the alleged father signs a voluntary acknowledgment of paternity, the courts don't have to decide parentage, but custody, visitation and child support often remain at issue. However, if legal paternity is at issue, i.e. the alleged father (and sometimes the mother) denies paternity, the parent who wishes to establish paternity must bring a paternity suit or action. Unlike more conventional legal cases, contested paternity actions are decided primarily on the scientific evidence of DNA testing. Therefore, if biological fatherhood is in question, your first step is to conduct a paternity test. If parents can't agree to the test, the court will order it. These genetic test results are often conclusive, although courts often allow contradicting evidence, such as proof that the alleged father had no physical access to the mother at the time of conception.

JUDGES: Judges are at the top of the court pyramid. Although other judges can hear custody cases, the trend in California is to have particular judges assigned to unified family courts and given special training. There are also commissioners, judges pro tem, referees, and private or retired judges who hear cases. All of these justices have complete power over your case.
  • The advantage to having a unified court is that one judge hears and coordinates a family's problems. These problems may include domestic violence, temporary restraining orders, divorce and custody issues.
  • The disadvantage is that one judge may be prejudiced against women, burned out, or uncaring. Many judges are biased against women, according to studies.
You will want to find out the judge's reputation early. You have the right to have a judge hear your case, and to dismiss one judge without a reason given, up to 10 days after you know s/he is assigned to your case, before any contested hearing begins

The Fathers' rights movement is a loose network of interest groups , primarily in western countries, established to campaign for equal treatment by the courts in family law issues such as child custody after divorce child support , and paternity determinations.

    History
    The Fathers' Rights movement has existed since the 1970s. No history of the movement has been written, but it can be viewed in the wider context of changes in family life during the 20th Century. One controversial idea being mooted today is that the traditional western nuclear family no longer fits society's requirements and that single mothers, with the support of the state, can provide an equally viable or even better solution to the 'problem' of bringing up a nation's children. The state benefits and support provided to single mothers can be viewed as making the father's parental role redundant when the parents don't live together. Children's and Fathers' rights campaigners oppose this notion and point to research showing that having an involved father is an important benefit for children, and that it is generally harmful to deny children the right to know and be cared for by both their parents when both parents are available to provide for the children's needs.
