  • Rosanne McInnes is a stipendiary magistrate in Adelaide, South Australia. In January 1994, the Adelaide Youth Court began to administer the implementation of new juvenile offender legislation in all major metropolitan court areas, with the exception of the Port Adelaide court area. Rosanne McInnes was transferred to the Port Adelaide Magistrates Court, where she was responsible for implementing the new legislation until the Adelaide Youth Court was able to take over, in April 1994. At Port Adelaide, she used Family Conference as a sentencing option.
  • Sue Hetzel was the Senior Youth Justice coordinator who introduced Family Conference into options for dealing with juvenile offending in South Australia, under the new legislation. She has a private social work practice, which provides private counselling and conducts human resources management education programmes. The material for dealing with the role of the conference coordinator is extracted from a chapter Sue Hetzel has contributed to a book about Family Conference around the world, which is being published in the USA in early 1996. The editors are Hudson, Galloway, Morris, and Maxwell, who are based at universities in Canada.

EFFECTIVE: SENATE SPONSOR: Zaffirini House Bill 360 amends the Family Code to expand the definition of "abuse" to include causing, permitting, encouraging, engaging in, or allowing a sexual performance by a child. The bill also adds to the description of sexual conduct harmful to a child's mental, emotional, or physical welfare the offense of indecency with a child, sexual assault, and aggravated sexual assault. View Text of HOUSE BILL 593 HOUSE BILL 594 HOUSE AUTHOR: Goodman EFFECTIVE: SENATE SPONSOR: Harris House Bill 594 amends the Family Code to require a court that has issued a judgment in a suit for the dissolution of marriage that divides the parties' estate, at the request of either party, to state in writing the court's findings of fact and conclusions of law concerning the characterization of each party's assets, liabilities, claims, and offsets and the value or amount of the community estate's assets, liabilities, claims, and offsets on which disputed evidence was presented.

    Table of Contents Next: FINANCIAL INSTITUTIONS HOUSE BILL 888 HOUSE AUTHOR: Dutton EFFECTIVE: SENATE SPONSOR: Whitmire House Bill 888 amends provisions of the Family Code relating to progressive sanctions programs for juvenile offenders. The bill changes references from progressive sanctions guidelines to a progressive sanctions model; eliminates the requirement that deviations from the progressive sanctions by a juvenile court or probation department be reported to the juvenile board; and adds to the purposes of the progressive sanctions model the recognition that departures of a disposition from the model are in some cases desirable. House Bill 888 removes the limitation on terms of probation at levels four and five of the sanctions model and removes the upper limitation, making it not less than six months, for level three. The bill removes the requirement that the Criminal Justice Policy Council analyze compliance with progressive sanctions and the impact of sanctions on recidivism rates. View Text of HOUSE BILL 888 HOUSE BILL 1828 HOUSE AUTHOR: Farabee EFFECTIVE: SENATE SPONSOR: Whitmire House Bill 1828 amends the Code of Criminal Procedure to change the name of the county graffiti eradication fund to the county juvenile delinquency prevention fund and to add to the authorized uses of the fund. The bill authorizes the fund to be used to provide funding for teen recognition, recreation, and local teen court programs and for the local juvenile probation department and to provide certain educational and intervention programs designed to prevent juveniles from engaging in delinquent conduct.

    JUVENILE DRUG COURT This program is a collective effort involving the Nevada County Courts, Probation Department, District Attorney's Office, Public Defender's Office, County Counsel's Office, Human Services Agency/Behavioral Health Services, the Superintendent of Schools, Community Service Providers and Nevada County Systems of Care Project.
    Information Sheet and Eligibility Criteria Juvenile Drug Court is a voluntary program for persons under the age of 18 who have a drug/alcohol problem and want help for that problem. Clients may be eligible if they:
    • Have committed a crime which has drugs or alcohol involved Have a history of drug or alcohol abuse Are at risk for out-of-home placement due to substance abuse Have no serious sex offenses Have no pending 707(b) offenses Have no extensive history of serious or violent felony crimes
    The program consists of case-managed substance abuse treatment, counseling, ancillary services (education, health, employment) and witnessed urine testing. Clients may be required to return to Court every week, but generally it will be every other week. The testing and counseling requirement may decrease as clients gain recovery. Clients are required to attend self-help meetings (i.e. Alcoholics Anonymous, Narcotics Anonymous and other selected sobriety activities).

    Abstract
    The contributors to this work share a concern about the possible effects of the criminal justice system on juvenile offenders. However, they have different views as to how justice should be administered. They question whether it is possible to punish without stigmatisation and whether the prevention of re-offending can be achieved. They consider whether family conferencing is the best alternative.
