Background
Historically, following the death of a child, an acrimonious divorce leaving custody with a child's former spouse, or the breakdown of their relationship with a child, grandparents have been without any legal right to secure granparenting time visitation with their grandchildren. With the aging of the population, and with increased divorce rates, state legislatures started to enact statutes which granted grandparents some rights to seek court-enforced time with their grandchildren, even against the wishes of the grandchild's parents. The circumstances under which grandparents could seek grandparenting time, and the nature and amount of grandparenting time which could be made available, varied from state to state. GRANDCHILDREN/grandparents,Inc. are groups of parents and grandparents working together through education and legislative action to change the the perception that children are chattels of their parent. THAT: "All of the Children" Regardless of where or how or with whom they live. WILL BE ASSURED that their rights and concerns are paramount to any and everyone's. That society has a responsibility to make sure that children are given a chance to grow into mature, responsible adults, and able to reach the highest potential that they are capable of obtaining with the least amount of exposure to abuse, mental, physical, or sexual but with the most stability and love that is possible to provide. To make sure that all in charge of doing so, do it with the utmost of care and responsibility and are held accountable for their actions.   • Voluntary, progressive and monogamous marriage in which husband and wife are equal.
  • Marriage between Vietnamese citizens of different ethnicity and/or different religions, between religious and non-religious people, and between Vietnamese citizens and foreigners is respected and protected by law.
  • Husband and wife are obliged to implement the population and family planning policy.
  • Parents are obliged to bring up their children to become useful citizens in society; children are obliged to respect, care for and support their parents; grandchildren are obliged to respect, care for and support their grandparents; family members are obliged to look after, care for and help one another.

    Under C.R.S. 19-1-117, a grandparent can petition a Colorado family law court for reasonable grandchild visitation rights in the following situations: 1. The grandchild's parents have obtained a dissolution, annulment, or legal separation, 2. The child has been placed into the legal custody of someone other than a parent, or 3. The child's parent, who is the child of the grandparent seeking visitation, has died. There is no automatic right to grandparent visitation - the Colorado family law court must find that it is in the best interests of the child to have grandparent visitation. And, once granted, Colorado grandparent visitation may be modified or terminated if it is in the best interests of the child. Finally, Colorado grandparent rights and visitation are terminated by the child's adoption, or termination of the parental rights of the child's parent who is the child of the grandparent.

    Introduction
    The purpose of this annotated bibliography is to help elderly laypersons find useful resources about their rights as grandparents. The site can offer guidance to grandparents in regards to what rights they have in various situations with their grandchildren. The world is changing - and no family member can tell you more about how the world is changing and has changed than grandparents. With the dawning of the 21st century, there is a greater realization that families come in every imaginable shape and size. For some children, grandparents play a major role in their upbringing - whether it is in the "traditional" grandparent role or whether it is in situations in which grandparents are raising their grandchildren. 1Grandparents are now, more than ever, finding that their defined roles within their grandchild's life are challenged - whether it is because of divorce of the child's parents, incarceration of the parents, death of one of the parents, or other unfortunate circumstances for the children. Grandparents can face many legal situations in regard to their grandchildren that take informed, intelligent decisions. In this regard, it is necessary that grandparents have the most accurate, reliable information in making their decisions.

The U.S. Supreme Court recently decided that grandparents do not have an automatic right to visit their grandchildren. That decision was based on a Washington State case involving the grandparents of two sisters, ages 8 and 10.     California - like every other state has a grandparent visitation law: Under the law, courts can order that grandparents be permitted to visit their grandchildren, even if the children's parents object. Recently, in the case of Butler v. Harris, the California Supreme Court upheld the law against a constitutional challenge.
    Butler was decided in the shadow of a very similar 2000 decision by the U.S. Supreme Court, Troxel v. Granville. There, the Court struck down, as unconstitutional, an order granting visitation to grandparents over the objection of the children's mother.
    The Court found the state's visitation statute "breathtakingly broad." It also found fault with the court order itself - holding it invalid because it failed to sufficiently defer to the constitutionally protected right of parental autonomy.

A 1990 Supreme Court of Texas case required the non-parent to identify some act or omission committed by the parent which would demonstrate that naming the parent as a managing conservator would significantly impair the child’s physical health or emotional development. The U.S. Supreme Court's decision to affirm the right of a mother to prevent her daughters from seeing their grandparents may not be quite the victory for parental rights that observers first thought, a University of Illinois family law expert says. On the face of it, last month's closely watched decision (Troxel vs. Granville) was a defeat for grandparents seeking court-ordered visitation rights in cases where the parents have divorced or one of the parents has died. What was most striking about the split decision, said David D. Meyer, a UI law professor, was the narrow grounds on which the majority of justices based their ruling. "The court did not rule on the constitutionality of the Washington state law itself, holding only that the judge's application of the law in this case was unconstitutional. This seems to leave the door open for a better balancing between the rights of parents to raise their children without interference and the rights of other members of the family to continue a meaningful relationship with the children."
