The movement's origin can be traced to 1974 when Families Need Fathers (FNF) was founded. At the local level, many activists spend much time providing support for newly separated fathers, most of whom are highly distraught. Although some have been accused of being sexist by uninformed and ostensibly politically correct commentators, these groups also campaign for better treatment for excluded mothers, women in second marriages, other step-parents and grandparents - all of whom suffer discrimination in respect of contact with their (grand)child(ren).

Historical Context
Prior to the twentieth century, common law jurisdictions typically treated children as the property of the father, and thus following divorce the father would gain custody as a matter of course. With the development of psychological science over the twentieth century, most jurisdictions completely transformed this presumption of paternal custody, instead imposing the so-called "tender years" doctrine which held that absent extraordinary circumstances young children should always be placed in the custody of their mothers. As it became apparent that both of these models were fundamentally flawed - two sides of the same bad penny - a wide assortment of alternative models arose, each of which attempts to discern the custodial arrangement that is in the "best interests" of the children. Typically, these models include a presumption that the parent who served as the primary caregiver during a marriage should be the primary custodian following divorce.
Goals of the Fathers' Rights Movement
The fathers' rights movement arose in response to the perception that fathers were not being given equal treatment in child custody litigation. Fathers' advocacy groups typically to focus upon some or all of the following goals:

The Rights of Unwed Fathers
By Joel R. Brandes and Carole L. Weidman The New York Law Journal
May 28, 1996 W ITH FATHER'S DAY fast approaching, children are preoccupied with thoughts of gifts, cards and sentimental visions. Many unwed fathers, however, do not have the rights of being a parent and, for them, obtaining those rights would be nothing short of miraculous. The long and often arduous road of unwed fathers seeking to secure their rights began in 1972. In Stanley v. Illinois the United States Supreme Court held that an Illinois statute violated Due Process and Equal Protection because it conclusively presumed every father of a child born out of wedlock to be a person unfit to have custody of his children. This presumption was held invalid because it automatically eliminated any custodial relationship without giving the father an opportunity to present evidence regarding his fitness as a parent. After Stanley , New York enacted legislation designed to protect an unmarried father's interest in assuming a responsible role in the future of his child. The legislation provided for establishment of a putative father registry and automatic notice of adoption proceedings to eight categories of putative fathers of children born out of wedlock. Fathers in those categories were statutorily designated as likely to have assumed some responsibility for the care of their natural children.

The Fathers' Rights movement has existed since the 1970s. No history of the movement has been written, but it can be viewed in the wider context of changes in family life during the 20th Century. One controversial idea being mooted today is that the traditional western nuclear family no longer fits society's requirements and that single mothers, with the support of the state, can provide an equally viable or even better solution to the 'problem' of bringing up a nation's children. The state benefits and support provided to single mothers can be viewed as making the father's parental role redundant when the parents don't live together. Children's and Fathers' rights campaigners oppose this notion and point to research showing that having an involved father is an important benefit for children, and that it is generally harmful to deny children the right to know and be cared for by both their parents when both parents are available to provide for the children's needs.

NATIONAL ALLIANCE FOR FAMILY COURT JUSTICE OPEN LETTER TO ALL MEMBERS OF THE FATHER RIGHTS MOVEMENT By Liz Richards In response to questions and concerns from father rights leaders about complaints from myself and others representing litigating mothers and family abuse victim, I would like fathers rights movement principals to respond to the following: A). Fathers Rights organizations have introduced into official proceedings inappropriate psychological standards meant to produce false negatives in child sex abuse litigation for the benefit of male sex offender. No professional body has endorsed the Gardner-PAS methodology as an appropriate standard in any family law forum. B) In fact most professionals are highly critical of this and similar standards created to deliberately discredit female complaints about male family violence offenders, promoted by fathers rights allies such as Gardner, Underwager, Farrell and more recently Braver. These are contrived standards for protecting male offenders from the law, and allowing them to continue their unlawful injurious conduct. C) Fathers rights leaders engage in a campaign of public disinformation about family law matters including child support enforcement standards, custody litigation, maternal conduct in domestic disputes and other issues. They do this for the sole purpose of confusing the public and lawmakers to achieve for themselves recognition as a "special class" on the grounds of acutevictimization by society and the legal system. Fathers’ rights literature discredits some of their own most widely disseminated claims, such as (i) widespread and extreme legal system bias against men in custody disputes (ii) automatic disenfranchisement of their parental relationships, (iii) frequent patterns of false allegations of child abuse made deliberately by vengeful women, and (iv) routinely blaming of men for family violence acts they disavowy that they did not commit, and (v) routine assessment on men of child support beyond their ability to pay.

More on Fathers' Rights: The State Matriarchy
    May 24, 2005
by Paul C. Robbins, Ph.D. Under the current system of family law, fathers typically lose their children in return for financing the destruction of their own families. When the system fails to work as promised, fathers are blamed and put in jail. But the system is at fault, not fathers. The system makes it far too easy for mom to expel dad, keep the children, and force him to pay for her decisions using the police power of the state. The theory behind the system holds that the traditional family and marriage can be destroyed with acceptable consequences, as long as mom gets the kids and dad (or the taxpayers) can be forced to pay. Feminist sociologist Stephanie Coontz presents a version of this theory in a recent Los Angeles Times editorial. According to Coontz, over the past decade "the number of families headed by single mothers rose five times faster than the number of married-couple families"and "the number of couples living together unmarried increased by more than 70 percent" but several negative trends decreased during this same time. She attributes this decrease in part to more dads paying their child support, then argues that "it doesn't help today's diverse families to be told their children are doomed unless they can shoehorn themselves into a traditional marriage."

Protester Jason Hatch sparked a security alert at Buckingham Palace There are many in the legal world who have a great deal of sympathy for the principle for which Fathers 4 Justice have campaigned in such a spectacular fashion.
This is because the law has failed to keep pace with changes in society and parenting over the last 20 years. When fathers tended to be on the margins of child care, it did not seem unreasonable for courts to limit access to children after a parental divorce. Now, as a growing number of fathers take an equal share in parenting, expectations about contact have changed. But the law has not. The law should be changed to enshrine the principle of equal parenting time
