Juvenile Law
Juvenile law relates to the actions and well-being of persons who are not yet legally adults. A person is considered a juvenile if he or she is not yet old enough to be held responsible for criminal acts. The precise age at which a child ceases to be a juvenile varies from state to state, with a range from sixteen to nineteen years. In most states, however, the law considers individuals less than eighteen years of age to be juveniles. Age distinctions are important because they determine whether individuals who commit wrongful acts will be charged with a crime and tried in adult criminal court or whether they will appear in juvenile court. Juvenile courts have a different mission than adult courts. They have no authority to order punishment, but rather focus on rehabilitation. The juvenile court's response to misconduct is generally more lenient that the adult court's would be. In certain cases, if the offense is particularly severe or the offender is near the age of adulthood, the case may be transferred to adult criminal court. Juvenile court decisions also may be appealed to adult court. Juveniles have the right to receive notice of the charges against them, to confront and questions witnesses, to be free from self-incrimination, and to be represented by an attorney. In some cases, if the juvenile cannot afford an attorney, the court will appoint one. Juveniles charged with a crime do not, however, have the right to a jury trial that an adult offender would. Rather, a juvenile court judge hears all juvenile cases. At trial, a prosecutor representing the state presents the case against the juvenile, and the juvenile has an opportunity to respond. The prosecutor must prove the case against the juvenile beyond a reasonable doubt, which is the same standard applied in adult criminal cases. Although juveniles may be sentenced to secure confinement, the court also has the options of imposing a fine, restitution, probation, or medical treatment. Alternatively, juveniles may be removed from their homes and placed in foster care or a non-secure state facility.

Two terms (30 units) An exciting course covering a range of legal issues affecting adults and children in the contemporary family. It explores the legal responsibilities of parents and the state in the context of child welfare and in the matrimonial context and explores the rights and responsibilities of the parties.
Our aim is to deliver a body of knowledge on rights and duties in the family context and to provide students with the opportunity of developing intellectually critical skills, to facilitate exploration and interrogation of hitherto accepted bodies of law and knowledge about family relationships, adult rights and children's rights. Our aim is to help students realise that they can be active agents in the development of law since it is lawyers who put up the points of law upon which the court decides. The course is delivered via 3 hours per week of lectures and fortnightly tutorials with the additional element of a 'theory meets practice' workshop. Dr Mary Welstead and Professor Susan Edwards are the course providers.

Basic Courses Child Advocacy Law, the basic children's law class, is offered as part of the school's new Child Advocacy Program (CAP) . Taught jointly by Professor Bartholet and Professor Minow, it looks at children's rights and interests with a special focus on child abuse and neglect, foster care, adoption, delinquency, and education, and considers how our society through its laws and policies shapes the meaning of childhood. The Role of Islamic Family Law in Preserving
Children's Health and Well-Being
Nurdeen Deuraseh inasanis@hotmail.com a lecturer in the Department of Government and Civili z ation Studies, Faculty of Human Ecology, University Putra Malaysia (UPM), 43400 UPM, Serdang, Selangor, Malaysia. In this paper, attempts are made to study the role of Islamic family law in preserving children’s health and well being by imposing Muslim families to fulfill the major rights of children most notably the rights of rada‘ (suckling), hadanah (custody) and khitan (circumcision). It is thought that proper maintenance is the right of a child whereby this duty is imposed on the respective father, while suckling and custody are imposed upon the mother. However, in the Muslim society, when parents are married and live together, have joined responsibility for the health and the well-being of their children i.e., the father is responsible to provide the material necessities, while the mother is responsible to take care on the welfare of their children bodily, mentality and moral.
