Write a Will in 3 Easy Steps with LegalZoom
Making a No-Frills Will
We've all been told that if we do nothing else to take care of our legal affairs, we should write a will. That's pretty good advice. If you don't make a will before your death, state law will determine who gets your property (and it may well not be whom you would have chosen), and a judge may decide who will raise your children. In your will, you can make these decisions yourself. Most people can get by with only a basic will. Choosing a Guardian for Your Children
If you have children, you should choose a personal guardian someone to raise them in the unlikely event you can't. Why You May Not Need a Living Trust
Living trusts are an excellent way to avoid probate. But do you really need one? FAQ for Executors

This web site offers information on the need for estate planning, the importance of a will, and the impact of the new tax laws on estate planning. Every reader will not be interested in all the material presented; however, useful information is included for small and large estate owners. For those with large estates, planning is often less complicated than first thought. The planning decisions are strictly yours. But to fit your needs, you may get help from your bank, your insurance agent, and your accountant, along with your attorney. For the small estate owners, estate planning may be as easy as calling an attorney and having simple wills prepared for the husband and wife. If there is a question about costs, ask your attorney or more than one attorney. Most do not charge for initial consultations.

Write a Will in 3 Easy Steps with LegalZoom
    Estate Planning for Everyone
    by Mary Randolph , J.D.
Simple steps for creating an estate plan that will put your mind at ease.
    1. Make a will.
In a will, you state who you want to inherit your property and name a guardian to care for your young children should something happen to you and the other parent. For more information, see Making a No-Frills Will 2. Consider a trust. If you hold your property in a living trust, your survivors won't have to go through probate court, a time-consuming and expensive process. For more information, see the Living Trust FAQ 3. Make health care directives. Writing out your wishes for health care can protect you if you become unable to make medical decisions for yourself. Health care directives include a health care declaration ("living will") and a power of attorney for health care, which gives someone you choose the power to make decisions if you can't. (In some states, these documents are combined into one, called an advance health care directive.) For more information, see Health Care Declarations and Powers of Attorney for Health Care: How They Work 4. Make a financial power of attorney.

    http://www.pueblo.gsa.gov/cic_text/money/estate/estate.htm
Return to Federal Citizen Information Center Home Page Planning Your Estate Planning your estate is to distribute your assets according to your wishes after your death. Successful estate planning transfers your assets to your beneficiaries quickly and usually with minimal tax consequences. The process of estate planning includes inventorying your assets and making a will and/or establishing a trust, often with an emphasis on minimizing taxes. This pamphlet provides only a general overview of estate planning. You should consult an attorney, or perhaps a CPA or tax advisor for additional guidance. Do I Need to Worry? You may think estate planning is only for the wealthy. If your assets are worth $1,000,000 or more, estate planning may benefit your heirs. That's because generally taxable estates worth in excess of the amounts in the chart below may be subject to federal estate taxes, with rates as high as 45% to 50% of the taxable estate. Adding up the value of your assets can be an eye-opening experience. By the time you account for your home, investments, retirement savings and life insurance policies you own, you may find your estate in the taxable category. Even if your estate is not likely to be subject to federal estate taxes, estate planning may be necessary to be sure your intentions for disposition of your assets are carried out.
