QUESTIONS AND ANSWERS ABOUT EPILEPSY IN THE WORKPLACE AND THE AMERICANS WITH DISABILITIES ACT (ADA)
INTRODUCTION
The Americans with Disabilities Act (ADA) is a federal law that prohibits discrimination against individuals with disabilities. Title I of the ADA covers employment by private employers with 15 or more employees as well as state and local government employers of the same size. Section 501 of the Rehabilitation Act provides the same protections for federal employees and applicants for federal employment. In addition, most states have their own laws prohibiting employment discrimination on the basis of disability. Some of these state laws may apply to smaller employers and provide protections in addition to those available under the ADA. The U.S. Equal Employment Opportunity Commission (EEOC) enforces the employment provisions of the ADA. This document explains how the ADA might apply to job applicants and employees with epilepsy. Topics discussed include:
  • when epilepsy is considered a disability under the ADA;

      Special Treatment
      Children with neurological disorders often need treatment that is different than what adults need. Our pediatric neurologists give that special care to infants and children under the age of 18.We offer comprehensive diagnostic evaluation and outpatient management of neurologic disorders, which include:
      Best of Both Worlds
      Our young patients get the best of both worlds. Our pediatric neurologists coordinate their care, but they also receive treatment from within our disease-specific programs and centers that are complete with multidisciplinary expertise. This way a child with epilepsy, for instance, will be attended by a pediatric neurologist, but receive treatment within our F.E. Dreifuss Comprehensive Epilepsy Program. Our physicians also work closely with physicians and staff of other UVa services and centers dedicated to children. These include:

Photosensitive Epilepsy
What is it? Photosensitive epilepsy is an uncommon condition in which visual stimuli, such as flashing or flickering lights (usually of high intensity, and/or certain patterns such as stripes) trigger epileptic seizures. It is one of a group of "reflex" epilepsies, so called, because the seizure is a direct response to a stimulus. Who has it? Around one person in every 130 is diagnosed as having epilepsy whereas only one in about every 10,000 has photosensitive epilepsy. Among people with epilepsy, only an estimated 3 - 5% have seizures triggered by light or patterns. Photosensitive epilepsy most commonly affects children. The age of onset is usually between 9 and 15 years. It is rare to have a first seizure due to photosensitivity before the age of 5 or after the early 20's. It is genetically determined. Girls are affected more often than boys. Some photosensitive people have seizures only when they are exposed to a flashing or flickering light source or to certain patterns; others may have spontaneous seizures as well as seizures due to photosensitivity. The type of seizure e.g. tonic clonic, absence, myoclonic will vary from person to person.

The individual will exhibit rigidity, followed by muscle jerks, shallow or temporarily suspended breathing, bluish skin, and possible loss of bladder control. This seizure may last a couple of minutes. The individual may experience some confusion and/or fatigue, followed by a return to full consciousness. Generalized absence seizures or petit mal seizures look like a blank stare, beginning and ending abruptly, lasting only a few seconds. Other behaviors exhibited may include rapid blinking or some chewing movements of the mouth.
