Case Summary This case involved a challenge to Proposition 4, an initiative adopted by the California voters in 1998 that banned the use of steeljawed leghold traps and certain poisons to capture or kill wildlife in the state. Among other provisions, the initiative made it generally illegal to trap furbearing and nongame animals with steeljawed leghold traps, and to buy, sell or exchange the fur of animals captured with such traps.

There are over 20 thousand pesticide products registered for use in the United States. Several laws govern the Federal regulatory program for these pesticide products. Endangered Species Act
This act makes it a Federal offense to use any pesticide in a manner that may adversely affect an endangered species. A special statement will eventually be added to each pesticide label that will warn pesticide applicators to comply with county-specific use limitation bulletins based on the location of endangered species in that county. Beginning in 1998, the EPA may begin enforcing their pesticide use policies under Endangered Species Act. This policy will prohibit the use of some pesticides in specific locations. The labels of those pesticides so restricted will state that the use of the pesticide is prohibited in specific areas within counties. In order to use the pesticide, the user must obtain an "EPA PESTICIDE USE BULLETIN FOR PROTECTION OF ENDANGERED SPECIES." These bulletins will describe all pertinent restrictions in each affected county. Bulletins may be available from a variety of sources including pesticide dealers, and county SCS, ASCS, and Extension offices. Pesticide users should obtain and read all pertinent information about endangered species before buying and using pesticides that have endangered species restrictions.

Requirements Under 40 CFR Part 264 Requirements Under 40 CFR Part 264 Description: Subpart X does not specify minimum technology requirements or monitoring requirements for miscellaneous units. Subpart X specifies an environmental performance standard that must be met through conformance with appropriate design, operating, and monitoring requirements. Other Requirements Appropriate to Subpart X Units Subpart I - Containers Description: Subpart I addresses the use and management of containers and portable devices in which material is stored, transported, treated, disposed of, or otherwise handled. Portable, fabricated devices used for OB operations or operations at shredders or crushers may be similar to containers. Subpart J - Tanks Description: Subpart J establishes requirements for tank systems. Certain types of miscellaneous units may resemble tanks, such as certain OB units or units performing physical handling operations such as drum shredders or crushers.

INFORMATION ON BABBITT’S "PROOF" THE ENDANGERED SPECIES ACT WORKS On May 5, 1998 Interior Secretary Bruce Babbitt announced that the following list of thirty-three endangered and threatened species would be considered for removal from the list of species protected under the Endangered Species Act. Babbitt said, "Our new policy, to emphasize delisting, could alter the terms of debate over the future of the landmark 1973 conservation law. For we can now finally prove one thing conclusively: The Endangered Species Act works. Period." Despite such pronouncements, the facts indicate that the ESA has done little, if anything, to help most of these thirty-three species. EXTINCTION: One of the simplest ways to get off the list is to go extinct. These five species will join the seven that have already been delisted due to extinction. Although extinction may be a valid reason for delisting, it hardly proves the Endangered Species Act works. Guam broadbill Mariana mallard Oahu tree snails (3 species) DATA ERROR: This means that the data upon which the species was originally listed was incorrect. In many cases surveys found that the species was actually more abundant. In other cases scientific research on the species’ taxonomy revealed that the listed species was actually not genetically different than a more common species. Because scientists have realized that some of these are not separate species does not mean the Endangered Species Act works; rather it shows that species are often listed based on faulty or incomplete data.

Endangered Species: Difficult Choices
SUMMARY The 107th Congress may consider whether to reauthorize and amend the Endangered Species Act of 1973 (ESA). Major issues in recent years have focused on whether to incorporate further protection for property owners and reduce regulatory impacts, whether to increase the protection afforded listed species, or whether to clarify various aspects of the Act, such as the role of science in decision-making. The Clinton Administration made significant changes to ESA regulations, and many have advocated including these changes in the law itself. The ESA has been one of the more contentious environmental laws. This may stem from the strict substantive provisions of this law, which can affect the use of both federal and non-federal lands. Under the ESA, certain species of plants and animals (both vertebrate and invertebrate) are listed as either "endangered" or "threatened" according to assessments of the risk of their extinction. Once a species is listed, powerful legal tools are available to aid the recovery of the species and the protection of its habitat. The ESA is administered by the Fish and Wildlife Service (FWS) for terrestrial and freshwater species and some marine mammals, and by the National Marine Fisheries Service (NMFS) for marine and anadromous species.     The Bustard Group of the International Council for the Protection of Wild Birds met in Dubai between 13th and 15th November 1984, and unanimously adopted a resolution to implement strict protection measures for especially vulnerable populations of bustards. The Arabian 'houbara' has been in decline for several years. The symposium urged that all bustard species should be listed under Appendix II of the Convention on International Trade and Endangered Species. Over a million saplings were planted throughout the country on Tree Day, February 13th 1985, the trees for the most part being supplied by the various municipalities. New public parks in Umm al Oawain and Dibba were also inaugurated. A visit to Kalba on 17th February provided the Group's bird recorders with further evidence of the existence of the White-collared Kingfisher, Halcyon chloris kalbaensis. It was low tide and five birds were observed resting on the mud flats at one time. Identifiable photographs were taken though the image is small. For previous articles on this rare bird see Bulletins 13 and 23. The 'Khaleej Times' reported on 25th March that the import of agricultural pesticides would in future be subject to clearance by the Ministry of Agriculture and Fisheries to ensure that internationally banned materials are not brought into the UAE market. The local press noted on 3rd May that some 54 plant species in the south west of Saudi Arabia are threatened with extinction because of overgrazing, clearance and agricultural expansion. Four plant species had already become extinct since 1975, and a further 100 species were reckoned to be on the danger list.

    It is now almost a weekly ritual: a member of the ossifying liberal establishment, looking very defeated and victimized, complains vaguely about some lost privilege. The person will couch his narcissistic complaint in the form of accusing someone of "turning the clock back," not sufficiently respecting "precedent," disregarding "scientific consensus," and so on. All they mean is: the monopoly power liberals once enjoyed across the culture is now gone, and that the public should regard the left's erosion of power as a great loss to the republic.
