GOVERNMENT AND POLITICS
Government: Under 1983 Constitution, elected representative government divided into three branches. President, vice president, and Council of Ministers (cabinet) comprise executive branch. President directly elected for five-year term and may not be reelected; also serves as constitutional commander in chief of armed forces. Unicameral, sixty-member Legislative Assembly constitutes legislative branch. Judicial branch headed by Supreme Court of Justice; below Supreme Court are chambers of second instance, courts of first instance, and justice of the peace courts. Magistrates appointed by Legislative Assembly to fixed terms. Governors of departments (states) appointed by president; mayors and municipal council members directly elected. Military exerts political influence, particularly on issues relating to national security, but active-duty military personnel constitutionally prohibited from seeking office. Politics: Long characterized by military rule supporting dominance of economic elite, in late 1980s political system still adapting to demands for free elections, representative democracy, and more open public discourse. Civil conflict between government forces and Marxist guerrillas greatly exacerbated political polarization rooted in historical dichotomy between wealthy elite and impoverished and excluded majority. In late 1980s, the two major political parties were the moderate, center-left Christian Democratic Party (Partido Democrata CristianoPDC) and the right-wing Nationalist Republican Alliance (Alianza Republicana NacionalistaArena). As of late 1988, PDC held presidency, but Arena had one-seat majority in Legislative Assembly.

Declarations by the Government of El Salvador included with the Ratification of the Treaty of Peace with Japan 6 May 1952 T he United States of America and El Salvador were the only parties to the San Francisco Treaty which issued Declarations with their ratifications expressing reservations about some of the Treaty's provisions. I With respect to the Treaty of Peace with Japan , the Government of El Salvador makes the following Declaration: El Salvador does not accept nor ratify the commitments which the other nations may have contracted with respect to the transference or final disposition of those territories enumerated in Article 2 of the Treaty of Peace with Japan, in all those cases in which the freely expressed will of the affected populations was not consulted and respected. I don't believe in objectivity. Everyone has a point of view. But I won't be a propagandist for anyone. If you do something right, I'm going to take your picture. If you do something wrong, I'm going to take your picture also.

During the Vietnam War, John Hoagland filed for and received conscientious objector status. Paradoxically, nine years after that war's end, he died in El Salvador by a bullet from a U.S.-made M-60 machine gun. His parents first heard of his death on the radiothey later received their condolences from the State Department.
Hoagland's death was not unexpected since his name was on the death squads' lengthy"hit list." To the embarrassment of officials, his photographs recorded the brutal Salvadoran civil war, which was largely financed by the Unites States. According to Frontline: Our Forgotten War (WNET, New York, 1985), military and economic aid to El Salvador was 3 billion dollars since 1980. Two-thirds of the 750,000 people who fled El Salvador ended up in the U.S.: many were deported back to join the imprisoned or the disappeared. Archbishop Oscar Romero was gunned down in 1980 while conducting mass, and many church workers, mostly Jesuits, were assassinated. Three nuns and one layworker from the U.S. were also raped and murdered, their bodies found in a collective grave at a dumpsite. By the time of Hoagland's death in 1984, 65,000 civilians were murdered by the National Guard and right-wing paramilitary forces.

Brief history of El Salvador's government
Military government have been in power most of the time since 1931, often responding to political unrest with violent repression. Political violence increased sharply after the 1977 election in which General Carlos H. Romero became president. He was deposed in October 1979, but the military-civilian junta that replaced him was unable to stop the civil war between leftists and rightist. As a concession to the left, the junta proposed a limited land reform that affected about 25% of the land. At the same time, the junta, which was closeley linked to the right through the army, did little to control the rightist paramilitary National Guard. As a result, archbishop Oscar Arnulfo Romero, associated with the left, was assassinated in 1980 by the rightist. Under pressure from the U.S. to institute economic and human rights reform, the junta named Jose Napoleon Duarte, leader of the moderate Christian Democratic party, as president in December 1980. Although a small land-reform program was begun, fighting continued, as did rightist executions of farmers, peasents, and workers. The U.S. charging that the two main leftist groups, the Farabundo Marti National Liberation (FMLN) and the Revolutionary Democracy Front (FDR), were being helped by Nicaragua, Cuba, and the Soviet Union, increased its military and economic aid to the Salvadorian government (rightist) which were responsible for torturing and killing inocent people. They developed plantations of cotton, balsam and indigo. The European elite, consisting of 14 families, controlled almost all the land, and they enslaved the native Indians. El Salvador obtained independence in 1821, but the same wealthy elite maintained its domination of the land. There were various attempts in the early part of the 20 th century by the poor majority to redress the social and economic injustices, but they were repressed by the government. In 1932, Augustín Farabundo Martí, one of the founding fathers of the Central American socialist party, led a revolt by peasants and Indians. In response, the Salvadorian army murdered anyone who looked Indian or who supported the uprising. 30,000 people were killed during la Matanza , the Massacre.

    20 Years in El Salvador: From Civil War to Peace
    A look at what El Salvador has been through in the last two decades, and what lies ahead. by Jorge Flores
    The Salvadoran people are known throughout the world for their spirit of survival. That spirit is as evident in their struggles to overcome foreign interference and economic dependency as it is in their struggles with societal issues and natural disasters. These young girls were among many Salvadoran refugees in Nicaragua in the 1980s. Photo: Dick Bancroft During the 1970s, El Salvador found its hope for change in electoral politics, only to have that frustrated by frauds imposed by the traditional oligarchy and the armed forces. In 1972, the Salvadoran army imposed Col. Arturo Armano Molina of the National Conciliation Party (PCN) as dictator. To do so, they overturned the electoral victory of the National Opposition Union (UNO). In 1977, electoral victory was once again snatched away from UNO by the PCN, which this time installed dictator General Carlos Humberto Romero. By 1977, all political opponents of the regime were in danger. Many disappeared, some to be found later, tortured and dead. Popular discontent led every important sector of society to organize. Following the popular saying, "Now even the stones speak," the rocks at the sides of footpaths and highways were painted with messages opposing the dictatorship and calling on the people to organize.

    By 1968 the López Arellano regime seemed to be in serious trouble. The economic situation was producing growing labor conflicts, political unrest, and even criticism from conservative groups such as Fenagh. Municipal elections were held in March 1968 to the accompaniment of violence and charges of open fraud, producing PNH victories but also fueling public discontent and raising the concern of the United States Embassy. Efforts at opening up a dialogue were made in mid-1968 but had little success. Later in the year a general strike was kept brief by government action that helped break the strike and exiled the leader of the major Caribbean coast labor federation. Unrest continued, however; in the spring of 1969 new strikes broke out among teachers and other groups. As the political situation deteriorated, the Honduran government and some private groups came increasingly to place blame for the nation's economic problems on the approximately 300,000 undocumented Salvadoran immigrants in Honduras. Fenagh began to associate Salvadoran immigrants with illegal land invasions, and in January 1969, the Honduran government refused to renew the 1967 Bilateral Treaty on Immigration with El Salvador that had been designed to regulate the flow of individuals across their common border. In April INA announced that it would begin to expel from their lands those who had acquired property under agrarian reform without fulfilling the legal requirement that they be Honduran by birth. Attacks were also launched in the media on the impact of Salvadoran immigrant labor on unemployment and wages on the Caribbean coast. By late May, Salvadorans began to stream out of Honduras back to an overpopulated El Salvador.

    February 4, 1992 HAVING SEEN: 1. The petition received by the Inter-American Commission on Human Rights, dated July 21, 1989, whereby: On July 18, at 10:00 a.m., Mr. Leonardo Ramirez Murcia, Legal Counsel to the Human Rights Commission of El Salvador (CDHES), was abducted by members of the Treasury Police dressed in civilian attire, as he was leaving the "La Esperanza" Prison Facility in Mariona, San Salvador, after taking care of certain professional duties. During his captivity, they assured Mr. Ramirez Murcia that they had proof of his ties to the FMLN and that his job was to "release guerrillas and terrorists captured and taken into custody by security forces." Ramirez Murcia was beaten at the Headquarters of the Treasury Police to force him to admit to the charges made against him, such as his supposed involvement in the murder of Dr. Antonio Rodriguez Porth and the attack on the home of the Vice President of the Republic, Lic. Francisco Merino. The charges were utterly groundless, which only serves to show the methods used by the Treasury Police to conduct their investigations. Basically, these methods rely on physical and psychological torture to obtain extra judicial statements from innocent people. 2. Through a note dated September 6, 1989, the Commission began its processing of the case and requested the Government of El Salvador to supply the pertinent information on the facts denounced in that communication and any other information that would show whether the remedies under domestic law had been exhausted in the case in question; the Commission informed the Government that it had 90 days in which to reply.

His captors were heavily armed, in civilian dress and driving a pick-up without license plates. 2. Through a note dated May 7, 1987, the Commission began its processing of this case and requested the Government of El Salvador to supply information relevant to the facts reported in that communication and any other information that would make it possible to establish whether in the instant case the remedies under domestic law had been exhausted; the Government was told that it had 90 days in which to reply. 3.
