Breathalyzer Accuracy and DWI/DUI Conviction Rates
by David J. Hanson, Ph.D. Research indicates that breath tests vary at least 15% from actual blood alcohol concentration. At least 23% (that's about one out of every four) of all individuals tested will have a BAC reading higher than their actual BAC. Therefore, many people convicted of DUI/DWI simply on the basis of a breath test results alone will be innocent drivers who are falsely convicted. A thoughtful observer has emphasized that The law presumes every citizen innocent, even when charged with DWI. A judge violates the judicial oath when he or she presumes that a citizen charged with DWI is guilty, gives greater weight to the state's evidence, is predisposed to find for the state, or looks for ways to assist the state in the prosecution of a case. Judges with high conviction rates are NOT fair and impartial but proxies for the prosecution or result-oriented interest groups. The law imposes the highest burden of proof in criminal matters proof beyond a reasonable doubt of every element of the offense. Judges who lower this high burden in DWI cases make it probable that innocent people will be convicted, robbed of their liberty, their property, and their rights. When we permit or encourage judges to lower the burden of proof, we embark upon a slippery slope where expediency and results, rather than justice and law, guide decisions.

We the undersigned would like you to pass a city ordinance that would make it mandatory for all on-site alcohol retailers to post Anti-DUI/DWI warning signs in their restrooms. We believe that their successful implementation will prevent injury, death and the tremendous costs association with DUI/DWI.
50-55% of all DUI's are occurring from on-site alcohol retailers in San Diego County. Our goal is to make it mandatory for all on-site alcohol retailers to post Anti-DUI/DWI warning sign in their restrooms.
We propose the signs to be no smaller than 11 x 17 in size and contain images and language geared to prevent a person from driving impaired. Signs would also contain numbers to taxi’s and SafeRide programs and blood alcohol charts to assist one from understanding what their own level of impairment may be. This program will not cost the city or the on-site alcohol retailers a dollar. All signs will be provided for free by the Designated Drivers Association.
We believe it is time to put some education and awareness in the place where people are actually drinking the most. You are hard pressed to see anything in a bar that would make you think about not driving drunk, let alone helping you to understand how impaired you may be. Until now, on-site alcohol retailers have mainly advertised alcohol and DUI attorneys in their restrooms, but to our knowledge NONE have posted anything remotely geared to encourage their patrons to not drive impaired.

PROBLEM IDENTIFICATION
Hispanic Americans are the fastest-growing minority population in the United States. Arizona shares a border with Mexico and, as such, has welcomed increasing numbers of Spanish speaking motorists. Law enforcement agencies in Arizona are aware of communication problems, exacerbated by cultural differences, between law enforcement officers and motorists who speak only Spanish. The problems are particularly acute while performing field sobriety tests (FSTs), during which an officer may not be able to properly explain the tests. In the most extreme situations, impaired motorists have been released because the police officer could not communicate with the driver.
GOALS AND OBJECTIVES
The goal of the Basic Survival Spanish for Law Enforcement and Driving Under the Influence/Driving While Intoxicated (DUI/DWI) Protocols program, is to increase successful apprehensions of Arizona motorists who are driving while impaired by alcohol. Research indicates that the different types of laws summarized below help reduce the incidence of impaired driving. Illegal Per Se Laws make it illegal in and of itself to drive a motor vehicle with a BAC concentration at or above an established level. All 50 states and the District of Columbia have per se laws defining it as a crime to drive with a blood alcohol concentration at or above a proscribed level, .08 percent. Research indicates that virtually all drivers show impairment in driving ability at .08 BAC, and the majority exhibit serious deterioration. Virtually all highway safety organizations and transportation safety agencies support .08 BAC, and in October 2000, Congress passed .08 BAC as the national standard for impaired driving regulations.
