It is a privilege to be here in the Southwest Region of the Organized Crime Drug Enforcement Task Forces. It truly was the opportunity to be a part of the OCDETF renaissance that was one of the things that lured me from private practice back into Government service. And I particularly want to thank Core City U.S. Attorney Mike Shelby for his leadership in moving this important OCDETF program forward. It was Mike who observed immediately that the effective administration of OCDETF demands accountability and full time, focused management by the regional coordinators. Other OCDETF Regions are now beginning to follow Mike's lead. Presently, our country and the Department of Justice are grappling with some of the most profound perils it has ever faced . the continuing threat of terrorism of unspeakable dimensions, and pervasive corporate fraud that corrupts our economy and destroys the important investor confidence in our market. Yet, the drug problem in this country remains one of our most serious and crippling. We cannot ever forget this. And think about this: Terrorists may have taken 3,000 souls from us on September 11 . but drug traffickers take at least 16,000 American lives every single year. These same traffickers cost the United States $400 billion each year in substance abuse and addiction. The stakes are too high. We simply cannot afford to ignore this crisis or let other issues in this country divert our attention from drug enforcement.

11.1 Illicit drugs have a significant negative impact on Canada and on individual Canadians. They are a major source of funding for organized crime and for terrorism. The economic costs, including health care (for example, HIV/AIDS and hepatitis), lost productivity, property crime, and enforcement are estimated to exceed $5 billion annually. In 1999 there were over 50,000 persons charged with drug offences and an estimated 400,000 court appearances. 11.2 If Canada is to reduce the impact of illicit drugs, it will need to address weaknesses in leadership and co-ordination, information, and comprehensive public reporting. We found the following:
  • Canada requires stronger leadership and more consistent co-ordination to set a strategy, common objectives, and collective performance expectations. It must be able to respond quickly to emerging concerns about illicit drug use or the illicit drug trade. The present structure for leadership and for co-ordination of federal efforts needs to be reviewed and improved. The mechanisms for co-ordination with the provinces and municipalities also need review since they cross three levels of government.

Statement by Rand Beers, U.S. Assistant Secretary of State for International Narcotics and Law Enforcement Affairs, in the Third Committee, Fifty-Fourth UN General Assembly, on Agenda Item 107, Crime Prevention and Criminal Justice and Agenda Item 108, International Drug Control, October 18, 1999 Mr. Chairman, The expansion and sophistication of transnational crime represents one of the most dangerous threats we confront in the next millennium. While it has already manifested itself in illicit drug trafficking, trafficking in persons (particularly of women and children), alien smuggling, financial crimes, including money laundering, illicit manufacture and trafficking in firearms, transnational criminals are constantly seeking ways to circumvent law and order. And, we must adapt our strategies to prevent them from doing so. The United Nations offers one of the most powerful defenses against these evolving threats: international cooperation. We have learned that such cooperation can lead to the identification and dismantling of criminal syndicates, prosecution and imprisonment of criminal leaders, freezing and seizing of criminal assets, and the development of ways to counter the crime networks. Moreover, we have an advantage in that the tools developed, the lessons learned, and the increased communication that has resulted from such cooperation can be wielded against both drugs and crime. In recent years, we have begun to capitalize on these strengths and those of the United Nations to map out more effective strategies for the new millennium.

At any given time, the Alliance is working with up to 30 states on specific issues related to the implementation of the model laws, their policy elements, supporting programs, and summit recommendations. Additionally, related information is regularly distributed to our network of state contacts in all 50 states. Here are examples of the Alliance’s work with states and the outcomes:
  • Iowa passed an economic crimes package containing the model forfeiture and money laundering legislation. The Iowa Attorney General used the model wiretap act to effect amendments to the state wiretap law. Alliance staff/experts, as requested, are providing ongoing assistance to the Office of Drug Control Policy regarding enhanced implementation of state drug-free workplace programs.
  • Kansas passed significant portions of the model forfeiture act. A state senator introduced an expedited eviction bill based on the Alliance's model and consulted with Alliance resource people throughout legislative discussion of the bill. The state also passed stronger methamphetamine penalties and a basic framework to begin monitoring chemicals distributed in the state. This effort resulted from the Alliance's assistance to the Kansas Attorney General on chemical control legislation. The Attorney General's office and the Alliance are collaborating to create a training which builds teams of enforcement, child protection and environmental officials to coordinate the application of state laws regarding precursor chemicals and meth labs.

View this document in PDF - PDF The Proceeds of Crime Act 2002 was passed on 11 October 2002 and came into operation on 1 January 2003. The Act provides a scheme to trace, restrain and confiscate the proceeds of crime against Commonwealth Law. In some circumstances it can also be used to confiscate the proceeds of crime against foreign law or the proceeds of crime against State law (if those proceeds have been used in a way that contravenes Commonwealth law). Section 298 Programs of Expenditure Section 298 (1) of the Act provides that the Minister for Justice and Customs may approve a program for the expenditure, in a particular financial year, of money standing to the credit of the Confiscated Assets Account (CAA). Programs of expenditure, as approved by the Minister for Justice and Customs, may be applied under one of the four following purposes (Section 298 (2)).
  • Crime prevention measures;
  • Law enforcement measures;
  • Measures relating to treatment of drug addiction; or
  • Diversionary measures relating to the illegal use of drugs.
