By Joanna Lyn Grama The sixty-five and older age group is the fastest growing segment of the U.S. population. By 2020, more than 40 million older adults will be licensed drivers. Encouraging an older adult, particularly a client, that it may be time to more carefully regulate their driving, or perhaps quite driving altogether can be a daunting task. Media stories regarding tragic accidents involving an older adult driver are sobering. However, it appears that older adult drivers may be more of a danger to themselves on the road than to others. Drivers over the age of sixty-five have higher per mile crash death rates than all other drivers other than teen drivers. Drivers over age 65 who are injured in motor vehicle crashes are more likely than younger drivers to die from their injuries.

Epilepsy, Driving and the Law
Case Scenario A 23-year-old woman with a history of a seizure disorder presented to the walk-in clinic, requesting antiepileptic medication. She said she had not been taking her antiseizure medication for more than one year because she did not have medical insurance. During that time, she had contacted an organization to seek help in obtaining medication, but her efforts were unsuccessful. She now had a new job with medical benefits and had come to the clinic to establish care a few weeks before this visit. At that time, she was not given antiseizure medication because her medical records had not yet arrived at the clinic. The patient described herself as having a seizure once a month, with loss of consciousness and tonic-clonic movements. She also said she had daily seizures that did not generalize. Her medical records had arrived by the time I saw her. They confirmed her history and listed her previous antiepileptic medications. I wrote a new prescription for her, but before doing so, I asked if she was driving. She said that she had been driving all year. I asked if she was concerned about having a seizure while driving. "As a matter of fact," she said, "I did have an accident during a seizure. I drove into a guardrail, but nobody was hurt." And then she smiled as if to say I was crazy if I thought she was going to give up driving. Commentary Driving is critical to life in American society. Without a driver's license, it is difficult to be mobile, to be employed and to be a full participant in all aspects of living. Our society recognizes the need for a driver's license and generally makes one available to everyone as long as they meet certain criteria. However, the young woman in the case presented here would face drastic legal consequences if she were to hurt someone while driving, by choosing to drive despite having uncontrolled seizures. The woman's physician may also face some legal concerns that he or she needs to address in a formal manner.

Drive Safer America! Offers Tips for Summer Driving Safety
By the Staff Learn More AUBURN HILLS, Michigan - Continental Automotive Systems today offered motorists reminders for safer and more enjoyable driving during the heavily traveled summer months, with safety belt use number one on the list. National Highway Traffic Safety Administration (NHTSA) and other safety-minded groups last week kicked off the annual "Click it or Ticket" national safety belt enforcement mobilization. The effort encourages motorists to buckle up and local police to enforce state belt laws. About 20 percent of motorists still don't buckle up and police will be on the lookout for them with ticket books in hand. Philip W. Haseltine, Executive Director of the Air Bag and Seat Belt Safety Campaign points out that seat belts are 45 percent effective in preventing fatalities in passenger cars and 60 percent in light trucks.

There is no one statute (regulation) to cover the posting of labor law notices in general. Basically the Federal Department of Labor and various State equivalents have their own statutes which require various notices to be posted in the workplace. For instance, Title 29, Chapter 22, Section 2003 of US Code requires the posting of the Employee Polygraph Protection notice. 29CFR825.300 requires the Federal FMLA and the 29CFR1903.2(a)(1) requires the OSHA posting to be posted.

What They Do: They roll through stop signs and run red lights They speed - 15 miles over the limit or more on a daily basis They ride on people's bumpers to "encourage" them to move out of their way They pass on shoulders They change lanes frequently, without signaling, and come very close to the vehicle they're passing when they do it Unable to judge the speed of oncoming traffic - they don't merge - they just drive right in and expect others to make way for them What They Think: They see driving as a contest...whether against the clock or another driver They believe that everyone else is a bad driver, displaying an 'it's not me' mentality They don't think that going 70 mph or more in a 55 mph zone is speeding. They believe the laws should be changed to increase the speed limits.
